8-6-1: FARMERS' MARKET DEFINED:

For the purposes of this chapter, a "farmers' market" shall mean a location for the sale of agricultural products directly to consumers, approved by the Los Angeles County agricultural commissioner, and operated by the city of Beverly Hills in compliance with the requirements of title 3 of the California Code of Regulations. 8-6-2: SALES AUTHORIZED IN PUBLIC RIGHT OF WAY:

Notwithstanding any other provision of this code, persons who have been permitted by the city, in writing, to sell products in the public right of way at a farmers' market, or in conjunction with a farmers' market, may encroach into the public right of way for the purpose of participating in the farmers' market and associated city approved vending in those areas closed to vehicular traffic. Such encroachment shall be limited to the extent authorized by the city in writing and shall be conducted pursuant to the city's market rules. In addition, notwithstanding any other provision of this code, such persons may conduct business outside of a permanent and substantial building during the operation of the farmers' market and pursuant to the city's market rules. 8-6-3: MARKET MANAGER:

The city manager shall designate a market manager who shall be empowered to implement and enforce the rules, regulations and policies of the city relating to the farmers' market and associated activities. (Ord. 94-O-2210, eff. 8-19-1994)

8-6-4: MARKET RULES:

The city manager shall adopt, and may from time to time amend, market rules governing the admission and removal of producers from the market and such other subjects as may be required by title 3 of the California Code of Regulations as the prerequisite to certification of the city's farmers' market. The market rules may also address any other topic deemed appropriate by the city manager for the purpose of operating the farmers' market in the best interest of the community. 8-6-5: MARKET FEES:

The city manager shall establish an appropriate fee to be paid by a producer who participates in the farmers' market. The fee shall include the business license tax required pursuant to title 3 of this code. (Ord. 94-O-2210, eff. 8-19-1994)

8-6-6: PARKING REGULATIONS:

During the hours of operation of any farmers' market, no vehicle over six feet (6') in height, nor any trailer or semitrailer with a load, shall be parked within two hundred fifty feet (250') of an intersection that is within five hundred feet (500') of the farmers' market. In addition, no vehicle engaged in vending from a public street shall be parked within five hundred feet (500') of the farmers' market. (Ord. 94-O-2210, eff. 8-19-1994)
