4-4-201: DEFINITIONS:

ANCILLARY PARKING FACILITY: An off street parking facility that accommodates the parking of motor vehicles by the occupants, customers, clientele and employees of an on site or adjacent structure where the primary use of that structure is for office, retail or hotel purposes.

ATTENDANT PARKING FACILITY: An off street parking facility in which one or more attendants or valets assist motorists with the parking of vehicles.

PARKING STRUCTURE: An off street parking facility with a ramp type garage or other enclosed parking facility. A parking structure may be either a vehicle parking facility or an ancillary parking facility.

VEHICLE PARKING FACILITY: An off street parking facility, where the primary use of the property is to accommodate the parking of motor vehicles by members of the public. The term "vehicle parking facility" does not include "ancillary parking facilities". (1962 Code § 6-16.01 et seq.; amd. Ord. 01-O-2375, eff. 6-1-2001; Ord. 02-O-2420, eff. 1-17-2003)

4-4-202: PARKING FEES:

A. Vehicle Parking Facilities: At each vehicle entrance to a vehicle parking facility, the operator of the facility shall prominently display in a manner satisfactory to the city and in a manner readily ascertainable and clearly visible to a motorist driving on the adjacent street, a sign or signs setting forth the following information:

  1. A schedule of the rates charged;

  2. A statement of the maximum fee charged or, if there is no maximum, a statement to such effect;

  3. A statement of the closing hour of the facility.

This information shall also be posted at one additional location at the vehicle parking facility that is satisfactory to the city and designed to notify patrons of parking rates before they exit their vehicle.

B. Ancillary Parking Facilities With Attendant Parking: Patrons of ancillary parking facilities with attendant parking shall be notified of parking rates through one of the following means:

  1. One moveable ground sign, placed at or near the location where parking attendants accept vehicles. Such ground sign shall be in a location satisfactory to the director of transportation. The ground sign shall comply with the size limitations set forth in sections 10-4-655 and 10-4-656 of this code, as applicable.

  2. One wall sign placed at the station for the parking cashier or in a location visible to motorists at the time that a parking attendant accepts the vehicle. Such sign shall not be visible from the public right of way and shall be at least one hundred twenty five (125) square inches.

  3. A ticket handed to a motorist at the time that a parking attendant accepts a vehicle. The applicable parking rate or a parking rate schedule shall be printed in bold and in a minimum 8-point type. Nothing in this section is intended to prohibit the inclusion of other information on the ticket.

C. Ancillary Parking Facilities Without Attendant Parking: Patrons of ancillary parking facilities without attendant parking shall be notified of parking rates through one of the following means:

  1. One or more signs shall be placed within the parking facility in a location satisfactory to the director of transportation and designed to provide notice of parking rates to motorists before they exit their vehicle. Such signs shall comply with the requirements of section 10-4-655 of this code and shall not be visible from the public right of way.

  2. Upon approval by the director of planning, one sign shall be posted at each vehicular entrance which would be plainly visible to motorists traveling on the adjacent right of way. The director of planning may disapprove any such sign if the sign is not consistent with the aesthetic character of the surrounding neighborhood or does not provide the information required by this article.

All signs and notices required by subsections B and C of this section shall include the following information: rates to be charged, a statement of the maximum fee, and if there is no maximum, then a statement to that effect, and the closing hour of the parking facility, if applicable. 4-4-203: SIGNS REQUIRED WHEN LOT FULL OR ENTRANCE BLOCKED:

A. Whenever a vehicle parking facility is filled to capacity, or where any entrance from any public street or alley to such facility is occupied or otherwise obstructed in a manner which prevents an automobile from entering completely upon the premises of such facility, there shall be placed at such entrance a sign complying with the following requirements:

  1. The sign shall not be less than three and one-half (3.5) square feet in size, and

  2. In clearly visible letters, not less than six inches (6") in height and one inch (1") in stroke, shall state either "Lot Full" or "Entrance Closed"; and in clearly visible letters, not less than three inches (3") in height and three-eighths inch (3/8") in stroke, shall state either "Waiting Prohibited by Law" or "Blocking of Entrance Prohibited by Law".

B. The permittee and each attendant at such facility shall have the duty and responsibility to comply with the provisions of subsection A of this section. (1962 Code § 3-6.1017)

4-4-204: LOCKING UNATTENDED VEHICLES:

Each attendant parking facility shall comply with the following:

A. At each closing time of such facility, each unlocked vehicle remaining in or upon such facility shall be securely locked if a key therefor is available, and such key shall be deposited with a responsible person at a safe and convenient place approved in advance by the transportation official, to be delivered to the person who parked the vehicle upon the surrender of the parking receipt or ticket therefor.

B. Whenever a vehicle is found in or upon any such facility unlocked and with its key available in or about the vehicle and there is no attendant in or upon such facility, it shall be presumed that the facility is closed and that the vehicle was unlocked and remaining in or upon the facility with its key available at closing time. 4-4-205: LOCKING PARKING STRUCTURES:

A. At all times after nine o'clock (9:00) P.M. of each day and before six o'clock (6:00) A.M. of each day, every entrance to and exit from each parking structure in the commercial and industrial zones shall be closed and locked by a gate, chain, or door, except during such times as there is on duty at such structure a parking attendant.

B. The transportation official may authorize, in writing, an exemption to subsection A of this section where special circumstances exist which ensure adequate security to such parking structure. (1962 Code § 6-16.01 et seq.)

4-4-206: RESPONSIBILITY FOR COMPLIANCE:

It shall be the responsibility of each attendant at each attendant parking facility to comply with each of the requirements of this article during the time working at such facility, and it shall be the responsibility of each operator of each vehicle parking facility to ensure that each of the requirements of this article is complied with.
