2-5-101: ESTABLISHED; CIVIL SERVICE SYSTEM:

Pursuant to the authority granted to the legislative body of any city within the State by the provisions of sections 45000 through 45210 of chapter 1, division 5, title 4 of the Government Code of the State, in order to establish an equitable and uniform procedure for dealing with personnel matters, and to place Municipal employment on a basis of merit so that the best qualified persons available shall be brought into the service of the City, a civil service system is established for the City.

All appointments, promotions, and personnel transactions within the classified civil service of the City shall be based upon merit and fitness ascertained by means of recognized personnel practices and techniques, and without discrimination due to race, color, religion, political affiliation, marital status, sex, age, or any other similar discriminatory basis recognized by State or Federal law. 2-5-102: CLASSIFIED SERVICE INCLUSIONS:

The classified service of the City is hereby continued. The provisions of this chapter concerning appointments and tenure shall apply to every employee in the classified service. Other provisions of this chapter shall apply to every employee in the service of the City. The classified service of the City shall consist of those positions which are designated in the classified service list approved by the Council and filed with the City Clerk's Office. Every officer and employee who is not expressly included on such list shall be exempt from the classified service.

The council, by ordinance, may place additional departments, appointive officers, or employees under the operation of the civil service system. All employees and officers placed under the civil service system shall be deemed to be in the classified service of the city. Nothing contained in this article shall prevent the employment in the classified service on a part time basis of any officer or employee if the council, by ordinance or resolution, determines such employment to be in the best interests of the city. For the purposes of this article, "part time" shall mean continuous and regular employment at less than forty (40) hours per week. (1962 Code § 2-6.104)

2-5-103: SOLICITATION PROHIBITED:

No officer or employee of the city or any other person, directly or indirectly, shall solicit or receive, or in any manner be directly or indirectly involved in soliciting or receiving, from anyone on the eligible lists or employed in the classified service of the city any assessment, subscription, contribution, or political service for aiding or assisting in the campaign for election or appointment to any political or official position in the city service or to any position in the classified service of the city. (1962 Code § 2-6.115)
