2-3-901: CREATION AND FUNCTIONS:

The office of the city clerk is established as provided by section 36501 of the Government Code of the state. The city clerk shall have all of the powers, duties, and responsibilities granted to and imposed upon the office of the city clerk by the provisions of chapter 2, part 3, division 3, title 4 of the Government Code of the state, other general laws of the state, the provisions of this code, and the ordinances and resolutions of the council. The city clerk shall administer the office of city clerk and shall be responsible for the performance of its functions.

The primary function and duties of the city clerk shall include:

A. Attend all meetings of the council and be responsible for recording and maintaining a record of all actions of council;

B. Promptly after each formal council meeting, the city clerk shall cause a copy of the minutes thereof to be forwarded to each council member, the city manager, and department heads. The city clerk shall maintain a book of council minutes, with a record of each particular type of business transacted; provided however, the city clerk shall only be required to record such business as was acted upon by vote of council, and shall not be required to record the remarks of any council member, or any other person, except at the special request of a council member. The city clerk's record of the meeting shall also include the names and addresses of persons addressing the council, the title of the subject matter to which their remarks related, and whether they spoke in support of or in opposition to such matter;

C. Keep all ordinances and resolutions and other official records of the council in such a manner that the information contained therein will be readily accessible and open to the public. The city clerk shall attach to the original copy of each ordinance a certificate which shall state the date the ordinance was adopted, and that the ordinance has been published or posted in accordance with law;

D. Keep all records of the council and of the office of the city clerk in such a manner that the information contained therein will be readily accessible and open to the public until such time as any of the records may be destroyed, or reproduced and the original thereof destroyed, in accordance with state laws;

E. Be the custodian of the seal of the city;

F. Administer oaths or affirmations, take affidavits and depositions pertaining to the affairs and business of the city, and certify copies of the official records;

G. Have charge of all city elections;

H. Be responsible for the publication of all the official advertising of the city;

I. Be responsible for the maintenance and distribution of the municipal code;

J. Appoint, direct and supervise the deputy city clerk;

2-3-902: DELEGATION OF CERTAIN FUNCTIONS TO DIRECTOR OF FINANCE ADMINISTRATION:

The city clerk shall not be required to perform the following functions which are delegated to the director of finance administration.

A. The financial and accounting duties of state Government Code section 40802 et seq., which are transferred to the director of finance administration pursuant to state Government Code section 40805.5.

B. Functions and duties relative to warrants under state Government Code section 37203 et seq., which are transferred to the director of finance administration pursuant to state Government Code 37209. (1962 Code § 2-4.701; amd. Ord. 09-O-2576, eff. 1-15-2010)
