2.86.010 Definitions.

For the purposes of this chapter, the following words and phrases shall be defined as set forth in this section.

A. "CORPUS" means the Alameda County Criminal Oriented Records Production System, which system is a computerized record and automated data processing system containing confidential information for law enforcement purposes.

B. "Person" means an individual, group, association, organization, corporation or any combination of the foregoing.

C. "Unauthorized access" means the act or attempted act of obtaining information or data from the City’s CORPUS computer terminal by any person not authorized to do so by the Chief of Police.

D. "Unauthorized dissemination" means the wilful delivery or provision of CORPUS information or data from the City’s CORPUS computer terminal, or the attempted delivery or provision of such information or data, by any person authorized or not authorized to obtain such information or data to any person not authorized to receive such information or data. 2.86.020 Lists of persons or agencies authorized to use or have access to

CORPUS information--Chief of Police preparation.

A. The Chief of Police is hereby empowered to prepare or cause to be prepared a list setting forth by position, classification or job title those persons authorized to use or have access to CORPUS.

B. The Chief of Police is further empowered to prepare or cause to be prepared a list of persons or law enforcement agencies authorized to receive CORPUS information or data obtained from the City’s CORPUS computer terminal.

C. The lists referred to in subsections A and B above, along with an explicit, written warning regarding the use of such information or data, shall be posted on or affixed to CORPUS data processing equipment in a manner designed to inform persons of the existence of this prohibitory chapter and the limitations and penalties contained herein. 2.86.030 Use of information deemed misdemeanor when.

A. Any unauthorized person who wilfully obtains criminal information or personal data from CORPUS shall be guilty of a misdemeanor.

B. Any authorized person who obtains criminal information or personal data from CORPUS and disseminates or provides such information or data to any person or law enforcement agency not specifically authorized by the Chief of Police to receive such information or data shall be guilty of a misdemeanor.

C. Any unauthorized person who knowingly receives CORPUS criminal information or data from any authorized or unauthorized person shall be guilty of a misdemeanor. (Ord. 4949-NS § 3, 1976)
