Benicia Municipal Code Ch. 13.04 Definitions

In this chapter, unless the context otherwise requires, the following words and phrases are defined for use in this division.

"Applicant"

means a person who applies for water service, water service installation, or water system extension.

"Consumer"

means a person who receives or takes water.

"Cost"

means the actual or estimated value of materials, equipment rentals, personnel services and other expenses and includes taxes, engineering, overhead and contractor's profit.

"Customer"

means a person who receives water or other services from the water system.

"Demand"

means the rate of delivery of water for a specific period of time.

"Director"

means the director of public works or the person designated to perform the responsibilities imposed by this division.

"Local distribution facility"

means a pipeline of eight-inch and smaller diameter and includes hydrants, water service connections and appurtenances required to serve premises adjacent to these facilities.

"Main"

means a transmission or distribution pipeline of the water system.

"Major distribution facilities"

mean piping, storage, and control works and appurtenances, and treated water pipelines larger than eight-inch diameter whose functions affect water service to a major portion of a pressure zone, or to an area of at least several square blocks and extends beyond the area owned or controlled by the applicant.

"Off-site"

refers to facilities located outside the site covered by the applicant for water service.

"On-site"

refers to facilities located within the area owned or controlled by the applicant and within streets or easements immediately adjacent to such area.

"Premises"

means a separate identifiable and transferable parcel of real property. A portion of a parcel having a well-defined boundary, such as a wall, fence, or hedge which prevents the common use of the property by all occupants, is a separate premises.

"System extension"

means the extension of water system facilities to serve an area to which service is not available from existing distribution facilities.

"Water service"

means the delivery or receipt of water.

"Water service installation"

means the service connection including service pipes, meter boxes, and appurtenances through which regular water delivery is made.

(Prior code § 14-101(15))

"Water supply facilities"

includes the source of supply, pumping, transmission, treatment, and other water supply works whose functions affect water supply to a major portion of the total utility service area.

"Water system"

means the physical plant of the water system, including but not limited to real property reservoirs, treatment plants, pumping stations, transmission and distribution facilities and appurtenances.
