Sec. 8.5-20. - Mandatory electronic filing.

(a) This section applies to any elected officer, candidate, or committee who is required to file a campaign statement under the Political Reform Act or the Regulations of the Fair Political Practices Commission (FPPC) with the city clerk, the elected officer, candidate, or committee except an elected officer, candidate, committee, or other person who receives contributions totaling less than $2,000 and makes expenditures totaling less than $2,000 in a calendar year.

(b) An elected officer, candidate, committee or person to whom this section applies must file the statement electronically utilizing the system and method prescribed by the city clerk.

(c) If the system for receiving electronic filings is for any reason unavailable to timely receive filings as determined by the city clerk, the statement may be filed in paper format as prescribed by the city clerk.

(d) In accordance with Government Code Section 84615(h), a fee may not be charged for filing.

Sec. 8.5-21. - Permissive electronic filing.

When an original statement, report, or other document is required to be filed with the Secretary of State and a copy of that statement, report, or other document is required to be filed with the city, a copy of the document may but is not required to be filed online or electronically in the manner provided in this article.

Sec. 8.5-22. - Electronic statements as originals.

Any statement, report, or other document filed electronically or online under this article will be accepted as an original statement and need not be filed in paper format.

Sec. 8.5-23. - Filing confirmation.

(a) The city clerk shall cause a person who files a statement, report, or other document online or electronically to be issued an electronic confirmation that notifies the filer that the statement, report, or other document was received. The confirmation shall include the date and the time that the statement, report, or other document was received by the city clerk and the method by which the filer may view and print the data received by the city clerk.

(b) The electronic confirmation required by subsection (a) may be generated either manually by the city clerk or automatically by the system.

Sec. 8.5-24. - Access.

(a) In accordance with Government Code Section 84615(f), the city clerk shall make all the data filed available on the city's website. The data made available may not contain the street name and building number of the persons or entity representatives listed on the electronically filed forms or any bank account number required to be disclosed by the filer.

(b) The city clerk shall make a complete, unredacted copy of any statement, report, or other document filed under this article, including any street names, building numbers, and bank account numbers disclosed by the filer, available to any person upon request.
