Sec. 9.34.010. - Violation; posted property.

It is unlawful and a misdemeanor to enter upon or go across any "posted property" without the written permission of the owner, tenant, or occupant in legal possession or control thereof. Every person who so enters upon such "posted property" without such written permission is guilty of a separate offense for each day during any portion of which he enters upon or goes across or remains upon such "posted property."

Sec. 9.34.020. - Incorporation of Vehicle Code § 27150.

Vehicle Code § 27150 of the state is incorporated by reference.

Sec. 9.34.030. - Noise level.

No person shall operate a motor vehicle whose noise level is in excess of that provided under state law.

Sec. 9.34.040. - Spark arrester and muffler.

Any motor vehicle operated within the city shall be equipped with a spark arrester and also with a muffler as defined in Vehicle Code § 27150. No person shall operate a motor vehicle unless it is so equipped with a spark arrester and muffler.

Sec. 9.34.050. - Exemptions.

(a) The provisions of this chapter shall not apply to operation of vehicles upon property used for raceways or racing facilities in accordance with a license or permit issued by the city pursuant to chapter 9.36.

(b) The provisions of this chapter shall not apply on land that is vacant or unimproved private property unless the land is immediately adjacent and contiguous to residential property, or enclosed by fence, or under cultivation, or posted with signs forbidding trespass displayed at intervals of not less than three to a mile along all exterior boundaries and at all roads and trails entering private land.

(c) This chapter does not apply to any entry, in the course of duty, of any peace officer or other duly authorized public officer, nor does it apply to the lawful use of an established and existing right-of-way for public road purposes.
