Chapter 14.06 — SUBSTANDARD PROPERTY REHABILITATION CODE

Sec. 14.06.010. - General provisions.

The provisions of this chapter shall apply to all substandard property as defined in section 14.06.020.

Sec. 14.06.020. - Definition of substandard property.

Structures, grounds or premises maintained in such a manner that any one or more of the following conditions are found to exist shall constitute substandard property:

(1)

Unpainted buildings causing dry rot, warping, splitting or termite infestation.

(2)

Broken windows and doors constituting hazardous conditions and inviting trespassers and malicious mischief.

(3)

Overgrown trees and other vegetation that are:

a.

Causing detriment to neighboring properties and property values; or

b.

Dangerous to public safety and welfare.

(4)

Dead trees, weeds and debris that are:

a.

Constituting unsightly appearances;

b.

Dangerous to public safety and welfare; or

c.

Detrimental to nearby property or property values.

(5)

Any premises which are painted in a garish manner or which contain signs of such size, type, and/or quantity which are inconsistent with section 19.06.060.

(6)

Property, including, but not limited to, building exteriors which are maintained in such condition as to become so defective, unsightly, or in such condition of deterioration or disrepair that the same causes appreciable diminution of the property values of surrounding property or is materially detrimental to proximal properties and improvements. This includes, but is not limited to, the keeping or disposing of, or the scattering over the property or premises of any of the following:

a.

Lumber, junk, trash, or debris.

b.

Abandoned, discarded or unused objects or equipment, such as automobiles, trailers, campers, boats, bus bodies, and similar objects or equipment.

c.

Any device, decoration, design, fence, structure or vegetation which is unsightly by reason of its inappropriate location.

d.

Any wall, fence or hedge in such condition as to constitute a hazard to persons or property or to cause depreciation in the value of any adjacent or nearby property.

e.

Any premises upon which there exists or is conducted, maintained or permitted any public nuisance known at common law or in equity jurisprudence, including, but not being limited to, abandoned or unused wells, shafts, basements, excavations or foundations.

Any one or more of the conditions listed under Health and Safety Code § 17920.3 as an endangerment to the life, limb, health, property, safety, or welfare of the public or the occupants of a building or portion thereof, including any dwelling unit, guestroom or suite of rooms, or the premises on which the same is located.

Sec. 14.06.030. - Administration.

The State Administrative Code, as adopted in chapter 15.08, shall govern the administration of the chapter.

Sec. 14.06.040. - Enforcement.

Chapter 2, Enforcement of the Uniform Housing Code, as adopted in chapter 14.04, shall govern enforcement of this chapter.
