1.12.010 - Authority.

The ordinance codified in this chapter is adopted under the authority granted to the city to call general municipal elections for the same day as the statewide general election pursuant to Section 36503.5 of the Government Code.

1.12.020 - Intent.

The intent of this chapter is to reduce the costs of conducting general municipal elections in the City of Banning by permitting the consolidation of the general municipal election with the statewide general election conducted by the clerk of the county of Riverside.

In addition, it is anticipated that there will be an increase in voter participation in the general municipal election under this chapter because of the traditionally greater voter participation in statewide general elections.

This chapter will govern the calling of general municipal elections in the city until repealed by the city council.

1.12.030 - Calling of the election.

The general municipal election shall be held in the City of Banning in the same day as the statewide general election as prescribed in Section 2550 of the Elections Code, on the first Tuesday following the first Monday in November during even-numbered years. At that election, a general municipal election will be held for the offices of city council, city clerk or city treasurer whose four-year terms are due to expire during the year in which the election is held.

Those elected officials whose four-year terms of office would have, prior to the ordinance codified in this chapter, expired on the Tuesday succeeding the second Tuesday in April shall, instead, continue in their offices until not later than the fourth Tuesday after the day of the general municipal election.

1.12.040 - Request for consolidation.

A. At the same time the resolution calling the general municipal election is adopted, the Riverside County board of supervisors may be requested, by resolution, to order that the general municipal election for the City of Banning be consolidated with the statewide general election to be held on the first Tuesday following the first Monday in November. Such resolution shall set forth the exact form of any question, proposition, or office to be voted upon at such election, as the same is to appear on the ballot.

B. Pursuant to Section 23314 of the Elections Code, each such consolidated election will be held and conducted, election officers appointed, voting precincts designated, ballots printed, polls opened and closed, ballots counted and returned, returns canvassed, results declared, certificates of election issued and all other proceedings incidental to and connected with the election shall be regulated and done, in accordance with the provisions of law regulating the statewide election with which the Banning general municipal election is consolidated.

1.12.050 - Nominations.

The period for the filing of nomination documents by candidates in each general municipal election for the City of Banning shall commence on the one hundred thirteenth day prior to the election. The nomination documents shall be filed not later than five p.m. on the eighty-eighth day prior to the general election in the office of the county clerk of the county of Riverside during regular office hours.

1.12.060 - Notice to voters.

Within thirty days after the ordinance codified in this chapter shall become operative, following its approval by the board of supervisors of the county of Riverside, the city clerk is ordered to cause a notice to be mailed to all registered voters informing the voters of the change in the election date. The notice shall also inform the voters that as a result of the change in the election date, elected city officeholders' terms in office shall be extended and that no terms shall be decreased.
