Sec. 2-406. - Composition; appointment.

The personnel board shall consist of five members to be selected as follows: two shall be appointed by the city council; two shall be elected by the classified employees at elections held under the rules of the personnel board; one shall be appointed by the other four.

Sec. 2-407. - Appointment; council procedures.

The two members of the board are to be appointed by the mayor of the city with a majority vote of the city council and may be removed from the board pursuant to section 2-32.

Sec. 2-408. - Terms; vacancies.

The terms of office shall be for three years in accordance with section 2-32.

Sec. 2-409. - Qualifications; compensation.

The members of the board shall be residents of the city for a continuous period of at least one year immediately preceding appointment to the board, shall be qualified electors of the city and shall receive such compensation as the city council may determine from time to time by ordinance. No person shall be eligible to be appointed to the board who holds any salaried public office or employment in the service of the city, nor shall any member, while a member of the board or for a period of one year after he has ceased for any reason to be a member, be eligible for appointment to any classified position in the service of the city.

Sec. 2-410. - Election of officers.

At the first meeting of the board and annually thereafter, the board shall elect a chairman and vice-chairman.

Sec. 2-411. - Duties.

The board shall determine the order of business for the conduct of its meetings and shall meet regularly if so required by the rules or on call of the chairman or three members of the board. Three members of the board shall constitute a quorum for the transaction of business. The powers and functions of the board shall be to:

(1) Consider and recommend to the city council a set of rules and regulations to supplement divisions 7 through 10 of article III of this chapter and revisions and amendments thereof. All rules and regulations so recommended shall be consistent with the provisions of divisions 7 through 10 of article III of this chapter and the retirement contract.

(2) Act in an administrative capacity to the city council on problems concerning personnel administration.

(3) As provided by divisions 7 through 10 of article III of this chapter and by rules adopted by the board, hear appeals submitted by any person in the competitive service relative to any situation connected with his employment status or condition of employment. Upon the conclusion of any such hearing the board shall certify its findings to the city council, and except for bad faith or lack of evidence, such findings shall be final. For bad faith or lack of evidence, the council shall be the final review board to whom an employee may appeal under this section. The council's decision shall then be final.

(4) In any investigation or hearing conducted by the board, examine witnesses under oath and compel their attendance of the production of evidence before it by subpoenas issued in the name of the city and attested by the city clerk. The chief of police shall cause all such subpoenas to be served, and refusal of a person to attend or to testify in answer to such a subpoena shall subject that person to prosecution in the same manner set forth by law for failure to appear before the city council in response to a subpoena issued by the city council. Each member of the personnel board shall have the power to administer oaths to witnesses.

(5) Hold hearings and make recommendations to the city council on the adoption or revision of the position classification plan. The city council shall adopt a position classification plan and class specifications and revisions thereof from time to time within the scope as recommended by the board and allocate and reallocate positions in the competitive service to classes within the scope as recommended by the board. The board shall recommend all salaries to the council.
