9.74.010 Purpose.

The purpose of requiring an administrative use permit (AUP) for certain uses is to determine whether or not a particular use meets the standards set forth in this title that are specific to that use, with the intent that uses that meet all of the standards will be approved.

9.74.020 Applicability.

This chapter shall apply to all uses listed as permitted uses, subject to an administrative use permit.

9.74.030 Application procedure.

Applications for an administrative use permit shall be filed pursuant to Chapter 9.70 with the Director and processed consistent with Section 9.70.050 and, if applicable, Section 9.70.060.

9.74.040 Findings.

In order for an application to receive administrative approval, the following findings must be made by the reviewing authority listed in Chapter 9.70:

  • A. The use meets the standards and requirements in this title that are specific to that use.

  • B. The use would be compatible with existing land uses and future permitted land uses within the zoning district in which the proposed use is to be located.

  • C. The use is consistent with the General Plan.

  • D. The proposed location, size, design, and operating characteristics of the use would not be detrimental to the public interests, health, safety, convenience, or welfare of the city, and any incompatible impacts of the proposed use are mitigated by conditions of approval.

9.74.050 Appeals.

Appeals to a decision of the reviewing authority of an administrative use permit shall be submitted and processed consistent with the procedures in Section 9.70.200.

9.74.060 Life of permits and extensions of time.

An administrative use permit shall expire one year from its approval date unless a building permit application has been submitted or the use has commenced.

9.74.070 Revocation.

Revocation of an administrative use permit shall be conducted consistent with procedures and notice requirements in Chapter 9.74.
