9.36.010 Purpose and application.

This chapter shall apply to all land within the Open Space, Parks, and Recreation (O) zone district. This zone is intended primarily for application to those areas of Avenal where it is necessary and desirable to provide permanent open spaces, whether public or private, which are necessary to safeguard the health, safety, and welfare of the people; provide active and passive recreation; provide spaces for the location and preservation of public facilities such as parks, playgrounds and other public uses or private uses of a similar nature; and, reserve, in a substantially undeveloped state, the areas planned for future urban use.

9.36.020 Permitted uses.

Uses shall be permitted or not permitted, conditionally permitted, administratively permitted, or temporarily permitted as prescribed in the land use table in Section 9.08.030.

9.36.030 Lot area.

9.36.040 Lot dimensions.

There are no minimum lot dimensions.

9.36.050 Coverage.

The maximum coverage of a lot shall be determined by the combined building setback area requirements, accessory structure limitations, open space requirements, and off-street parking requirements.

9.36.060 Building setback areas.

  • A. No structure shall be placed within a building setback area.

  • B. The front building setback area shall be a minimum of 25 feet, except as modified by (F.).

  • C. There is no rear building setback area.

  • D. There is no interior side building setback.

  • E. There is no street-side building setback, except as modified by (F.).

  • F. The minimum setback shall be 55 feet from the legal centerline of any existing or proposed local street or minor collector, 70 feet from the legal centerline of any existing or proposed secondary highway or major collector street, or 80 feet from the legal centerline of any existing or proposed primary highway or arterial street.

9.36.070 Distance between structures.

The minimum distance between structures shall be 10 feet, unless a greater distance is required by the building code.

9.36.080 Height of structures.

The maximum structure height shall be 30 feet, except that a height up to 100 feet may be permitted in accordance with Chapter 9.60 Conditional Use Permits.

9.36.090 Driveways.

Driveways should be minimized to protect the maximum amount of open space. Driveways shall be the minimum width and length necessary to support the use, as determined by the Director.

9.36.100 Other setback standards.

Mechanical equipment shall be located a minimum of five (5) feet from every lot line, except the setback shall be a minimum of 25 feet from a lot line abutting a residential or commercial zone.

9.36.110 Off-street parking.

  • A. Off-street parking and off-street loading facilities shall be provided on the site for each use as prescribed in Chapter 9.54.

aaa. No parking spaces shall be provided within any front, side, or rear building setback area.

9.36.120 Usable open space.

9.36.130 Landscaping.

Areas around buildings and parking areas that have been disturbed from their natural state shall be landscaped with natural landscape plants and materials that blend in with the natural environment on the site.

9.36.140 Screening, fences, and walls.

  • A. A minimum six-foot-tall solid wood or masonry fence shall be provided along any lot line that abuts any residential zoned property to separate the site development from the adjoining residential district. A three-foot wall shall be permitted in the front yard area.

  • B. The outdoor storage of equipment or materials shall be screened from view from any adjoining public right-of-way with a seven-foot-tall solid fence, wall, or chain-link fence with slats and landscaping.

  • C. Fences and walls shall be provided on the site for each use in accordance with Sections 9.50.110 and 9.50.120.

9.36.150 Signs.

Signs placed in the OS zone shall be subject to the requirements and standards prescribed in Chapter 9.56.

9.36.160 General provisions and standards.

Structures and the use of structures or land shall be subject to the requirements and standards prescribed in Chapter 9.50.
