Chapter 8.28 — PROHIBITING SMOKING ON CERTAIN PROPERTY OWNED OR CONTROLLED BY THE CITY…

The following words and phrases, whenever used in this section, shall have the following meanings:

A.

"City property" means any real property and any buildings or structure located on said real property in which the City of Arvin has a fee simple interest or an easement allowing the city to control the use of said real property.

B.

"Smoke" shall have the meaning set forth in section 9.24.035(A).

C.

"Smoking" shall have the meaning set forth in section 9.24.035(A).

D.

"Tobacco products" shall have the meaning set forth in section 9.24.035(A).

A.

In addition to any prohibitions on smoking set forth in state law and the prohibition on smoking in city parks set forth in sections 9.24.030 and 9.24.035, no person shall smoke or chew tobacco products on or in any city property, except on sidewalks, on streets and alleys, or in designated parking lots.

B.

Nothing in this section prohibits any person or entity with legal control over any property from prohibiting smoking on any part of such property, even if smoking is not otherwise prohibited in that area.

C.

No person shall dispose of used smoking waste in or on city property.

"No smoking" signs, with letters of not less than one (1) inch in height or the international "no smoking" symbol (consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it) shall be clearly, sufficiently and conspicuously posted in places regulated by this section. Notwithstanding the above, the lack of signage in or on any city property does not excuse failure by any person to comply with this chapter.
