§ 5-16.01. Purpose.

The City Council may designate a building, landmark or other property within the City as a local historical landmark in special recognition of the property's role during the formation or existence of the City.

§ 5-16.02. Method of Designation.

Local historical landmarks may be designated as follows:

(a) Petition. An individual, organization, or City official may petition the City Council to designate a building, landmark or other property as a local historical landmark by filing a petition stating the name and location of the building, landmark or other property and the basis of such designation.

(b) City Council Review. Upon review of the facts presented, the City Council may approve or deny the petition, or may first refer the petition to a City Commission for review. Action of the City to approve or deny the designation of a building, landmark or other property as a "Local Historical Landmark" shall be by resolution of the City Council based on findings of the property's role during the formation or existence of the City.

(c) Certification. When a building, landmark or other property is designated as a "Local Historical Landmark," the City Clerk shall submit a certified copy of the resolution indicating such designation to the State Historical Society, the property owner, and the individual or organization originally submitting the petition for designation.

(d) Removal from Designation. Upon petition of an individual or organization, the City Council may approve or deny a petition for removal of the building, landmark or other property from its local historical landmark status, or may first refer the petition to a City Commission for review. Action of the City to approve a petition for removal of local historical status shall be by resolution of the City Council and be based on findings that such designation is no longer appropriate based on the particular facts of the building, property or site or that extraordinary benefits to the community outweigh the retention of the local historical status. Upon approval of such a petition, a copy of the resolution shall be sent to the State Historical Society, the property owner and to the person or organization submitting the petition for removal of designation.
