§ 8-1.01 ADOPTION OF THE 2022 CALIFORNIA BUILDING CODE.¶
The California Building Code, 2022 Edition, based on the 2021 International Building Code, published by the International Code Council (ICC), as adopted and amended by the California Building Standards Commission in the California Building Standards Code, Title 24 of the California Code of Regulations, is hereby adopted by reference. Also adopted by reference are Appendix Chapter 1 Administrative; Appendix Chapter I; Patio Covers, and Appendix Chapters J; Grading. Copies are on file in the offices of the Building Official.

§ 8-1.02 VIOLATIONS.¶
It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of the Code. Penalties may include citation and/or doubling of original permit fees.

§ 8-1.03 ISSUANCE OF BUILDING PERMITS.¶
No building permit shall be issued pursuant to this chapter unless the Building Official or his designee determines that the application complies not only with the structural requirements of the California Building Code, but with other pertinent laws and ordinances of the city or any other governmental body having jurisdiction within the city. Nothing stated in this section shall create any liability of the city or its officers to any person or other governmental authority for failure to observe such laws or ordinances.

§ 8-1.04 LOCAL PROCEDURES.¶
The following sections of the Municipal Code are amended, or additions are made thereto, to read as follows:
(A) The Finance Department shall keep a permanent, accurate account of all fees and other monies collected and received under this code, the names of the persons upon whose account the same were paid, date and amount, together with the building permit number.
(B) The fee for each permit shall be as set forth in The City of Antioch Master Fee Resolution. The determination of value shall be determined by the Building Official.
(C) Fees for inspection of various buildings and valuation per square foot of those buildings shall be determined by reference to the average cost column of the Building Valuation Data, excluding the regional modified, published in the "International Conference of Building Officials Building Standards", January/February Edition, and shall be modified yearly in accordance with each additional January/February Edition.
(D) Fees not calculated by the square foot method shall be established in the City's Master Fee Resolution.
(E) A signed copy of a contract of reconstruction may be used in lieu of valuation per square foot. On all work for which additional square footage is not added, a signed copy of the contract shall be submitted to determine valuation of work.
(F) The Building Official may authorize refunding of any fee paid hereunder, which was erroneously paid or collected. No refund shall be made for any permit costing $40 or less, or for any plan check fee. Eighty (80%) percent shall be refunded for any permit voided while it is still valid. No refund shall be made for any permit under which construction has commenced, nor for any permit, which has become voided by the passage of time.

§ 8-1.05 SIDEWALKS.¶
No building permit shall be issued pursuant to the terms of this chapter, nor shall any persons perform any act or thing, the doing or performance of which requires a building permit under the provisions of this chapter, unless proper public sidewalks are already in existence abutting the permittee's property, or unless the permittee's plans for the proposed construction or alterations include plans of the installation and construction of such sidewalks. Any such sidewalk must be completed within 30 days after completion of the permitted construction or alteration.

§ 8-1.06 SPECIFICATION OF FEES FOR CALIFORNIA CODES.¶
Whenever in this title a California Code refers to fees, the fees imposed by the city shall be the fees established in the Master Fee Resolution.
