3.60.010 - Definitions.¶
The term "contractor" as used in this chapter shall refer to any individuals or entities entering into contracts with the city as well as to individuals or entities granted licenses, permits or franchises by the city.

3.60.020 - Indemnity agreement.¶
The contractor shall indemnify, defend and hold harmless the city, its officers, agents and employees from any and all claims, losses, damages, injuries and liabilities arising from the damage or destruction of any properties, caused by or connected with the activities of the contractor, his agents, subcontractors or employees.

3.60.030 - Liability insurance.¶
A. The contractor, at his own cost and expense, shall procure and maintain a policy of liability insurance issued by an insurance company acceptable to city and insuring the city, its officers, agents, consultants, and employees, as additional insureds, against loss or liability caused by or connected with the activities of contractor, his agents, subcontractors and employees in amounts not less than:
Five hundred thousand dollars for injury to or death of one person and, subject to such limitation for the injury to or death of one person, of not less than one million dollars for injury to or death of two or more persons as a result of any one accident or incident; and
Five hundred thousand dollars for damage to or destruction of any property of others.
B. The policy of insurance shall include a provision that the policy shall not be reduced or canceled without thirty days prior written notice to the city and a provision that the insurance provided by the policy shall be primary as to any other insurance available to the additional insureds.
C. Prior to approval of the contract, the contractor will be required to file with the city a certification of his insurance carrier to the effect that:
By endorsement to Policy No. _____, the City and its employees, consultant, agents, and officers are named as additional insureds.

3.60.040 - Worker's compensation insurance.¶
The contractor, at his own cost and expense, shall procure and maintain a policy of worker's compensation or employer's liability insurance, issued by an insurance company acceptable to city, for the protection of his employees, including executive, managerial and supervisorial employees, engaged in any work required by this contract.

3.60.050 - Subcontractor's insurance.¶
The contractor shall require each subcontractor employed by him to perform labor or furnish materials to procure and maintain, at such subcontractor's own cost and expense, during the performance of such labor or the furnishing of such materials, a policy of worker's compensation or employer's liability insurance, issued by an insurance company acceptable to the city, for the protection of such subcontractor's employees, including executive, managerial and supervisorial employees, engaged in any work on behalf of contractor or city.

3.60.060 - Evidence of insurance.¶
Before the contractor shall commence work and before any subcontractor shall commence work under any subcontract, the contractor shall deposit, or cause such subcontractor to deposit, a certificate evidencing each policy of insurance required by law.

3.60.070 - Cancellation.¶
Each policy of insurance required by law shall contain a provision requiring that written notice be given to the city at least thirty days prior to cancellation or reduction of coverage. Should any such notice be given before completion of the work hereunder, or should any such policy be canceled before completion of such work, the city may renew such policy or procure a new policy conforming herewith and deduct the cost thereof from any amounts due the contractor.
