Chapter 9.57 — TOBACCO USE AND POSSESSION

9.57.010 - Authority and title.¶
Under the authority granted in Section 22964 of the California Business and Professions Code, the City of Anderson, by and through its city council, does enact this chapter of its Municipal Code, which shall be known as the Tobacco Use and Possession Ordinance.

9.57.020 - Definitions.¶
For the purpose of this chapter the following definitions apply:
"Fire ignition device" means a lighter or any other instrument that ignites or causes to ignite a spark or flame.
"Paraphernalia" means any product where the intended purpose is to be used to consume nicotine or to be used in the preparation of tobacco or designed for smoking of tobacco.
"Tobacco" means any product containing nicotine.
"Tobacco product" means any product prepared from tobacco.
"Underaged person" means any person under the age of eighteen years.

9.57.030 - Restrictions on use and possession of tobacco and tobacco products.¶
A.
Every person under the age of eighteen years who purchases, receives, or possesses any tobacco, cigarette, e-cigarette, nicotine vaporizer, cigarette papers, any product where the intended purpose is to be used to consume nicotine, or any other product used in the preparation of tobacco, or any other instrument or paraphernalia that is designed for the smoking of tobacco, products prepared from tobacco, or any controlled substance shall be in violation of this code.
B.
Every person under the age of eighteen years who purchases, receives, uses or possesses any lighter or fire ignition device without the direct supervision of an adult over the age of eighteen shall be in violation of this code.

9.57.040 - Penalties.¶
Unless otherwise provided in this chapter or by state law, a violation of any of the provisions of this chapter shall, upon conviction, be punishable by a fine of seventy-five dollars or thirty hours of community service work.

Nothing herein is intended to limit the city from pursuing any other remedy available at law or in equity against any person or entity maintaining, committing, or any other violation of the code or state or federal law.
