10.04.010 - Definitions.

For the purposes of this title, the following words and phrases shall have the meanings respectively ascribed to them by this section:

A.

"Intersection" means the area embraced within the prolongation of the curb lines of two or more streets which join at an angle, whether or not one such street crosses the other.

B.

"Loading zone" means that space adjacent to a curb reserved for the exclusive use of vehicles actually engaged in loading or unloading of materials.

C.

"Official traffic signal" includes any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and to proceed, and which is placed or erected by authority of a public body or official having jurisdiction.

D.

"Official warning and direction signs and signals" includes all warning and direction signs and signals not inconsistent with this title placed or erected under this title or by authority of the city council or by any one person with authority given such person or agency by the city council.

E.

"Operator" includes the driver, rider or leader of a horse, and a person who pushes, draws, propels, operates or who is in charge of a vehicle.

F.

"Park" means the standing of a vehicle, whether occupied or not, otherwise than temporarily, for the purpose of, and while actually engaged in, loading or unloading passengers or materials.

G.

"Parkway" means that portion of a street other than a roadway or a sidewalk.

H.

"Passenger loading zone" means that space adjacent to a curb reserved for the exclusive use of vehicles actually engaged in loading or unloading of passengers.

I.

"Pedestrian" means any person afoot.

J.

"Right-of-way" means the privilege of the immediate use of the street.

K.

"Roadway" includes that portion of a street between the regularly established curb lines and that portion of any street, parkway, bridge or tunnel which is included between the curbs.

L.

"Safety zone" means that marked portion of a roadway reserved for the exclusive use of pedestrians.

M.

"Sidewalk" means that portion of a street other than a roadway or a parkway.

N.

"Stop" or "stop when required" means a complete cessation of movement.

O.

"Street" means every way more than thirty feet in width between property lines.

P.

"Streetcar" includes every device traveling exclusively upon rails.

Q.

"Traffic" includes pedestrians, vehicles and streetcars, either singly or together, while using any street for purposes of travel.

R.

"Vehicle" includes every device in, upon or by which any person or property is or may be propelled, moved or drawn upon a street, except a device moved by human power or used exclusively upon stationary rails or tracks.

S.

"Vehicle Code" is the Vehicle Code of the state.

10.04.020 - Scope of title.

It is the intention of the city council to provide reasonable traffic and parking rules, regulations and laws. All intersections, safety zones, crosswalks, roadway or curb parking, loading, standing regulation markings, stop signs, boulevard stop signs, speed limit signs, slow signs, danger signs, caution signs, warning signs, traffic signals and all other traffic-control signs and devices, parking limit signs, roadway markings relative to traffic direction and control and also relative to parking, now painted, marked, posted, in place, designated or authorized by existing county ordinances, or by the county road commission, or by the sheriff or State Highway Patrol, or by other agencies to whom such authority was delegated by the state or county, shall so continue as if found, established or designated by the city council and shall be enforced pursuant to this title as part of the traffic regulations, or laws to the contrary. No person shall drive, stand or park a vehicle in violation thereof. The foregoing shall remain enforceable as long as they conform with the provisions of the Vehicle Code or until changed by the city council. Hereafter, future designations relative to traffic regulations shall be done pursuant to authorization given or granted by the city council to any person, agency or organization.

10.04.030 - Authority of the city council to adopt vehicle and traffic regulations.

Except as otherwise provided in this chapter, the city council shall have the sole and exclusive authority to adopt vehicle and traffic regulations which control or restrict the use of public streets, sidewalks, and other public ways and places within the city by the operators of vehicles, bicyclists, roller skaters, pedestrians and persons using other means of transport or travel; to cause the installation of traffic control devices necessary to implement such regulations; and to cause the preparation of the studies or performance of such other duties required to adopt such regulations or to install such devices.

10.04.040 - Establishment of traffic committee.

A traffic committee is established to review traffic and parking rules, regulations and laws and to consider each request for installation of traffic control devices and restricted parking zones. The traffic committee shall be an advisory committee to the city council. The traffic committee shall consist of the following three members who are entitled to vote: the police chief or designee; the public works director or designee; and the community and economic development director or designee.

10.04.050 - Traffic committee secretary.

The engineering supervisor shall serve as the secretary to the traffic committee.

10.04.060 - Items reviewed by the traffic committee.

The traffic committee shall review traffic-related and parking matters and each request for installation of traffic control devices and restricted parking zones upon receipt of:

A.

A written request concerning a potential traffic hazard in the public right-of-way;

B.

A written request to install traffic control devices such as, but not limited to: stop signs, traffic signals, speed limit signs, or other warning signs;

C.

A written request for restricted parking zones;

D.

A written request from city council, staff or other agencies to review traffic and parking rules, regulations and laws.

10.04.070 - Traffic committee procedures.

A.

The traffic committee meets as necessary in order to review traffic and parking matters. The secretary will schedule a meeting within fourteen days of receipt of a request for consideration unless the public works director determines a potentially serious hazard exists and requires the committee to convene immediately.

B.

All interested parties shall be notified of the time and place of the meeting. The committee, after viewing the request and all relevant information, shall vote on the matter. The secretary shall keep written minutes of each meeting and provide the person who requested action written notice of the committee's recommendation within ten calendar days of the decision. If the committee's recommendation requires installation of traffic control devices regulated by Section 10.04.020 of this chapter, the committee's recommendation shall be presented to the city council for its consideration at its next regularly scheduled meeting.

10.04.080 - Appeals.

Anyone may appeal in writing a decision of the traffic committee to the city council within ten days of the decision being made.
