1.08.010 FISCAL YEAR ESTABLISHED.

The fiscal year of the City of Anaheim shall commence on July 1 and shall terminate on June 30th of each year. (Ord. 617 (part); May 10, 1938; Ord. 5774 § 40; July 24, 2001.)

1.08.020 SPECIAL GAS TAX STREET IMPROVEMENT FUND — CREATED.

To comply with the provisions of Article 5 of Chapter 1 of Division 1 of the Streets and Highways Code, with particular reference to the amendments made thereto by Chapter 642, Statutes of 1935, there is hereby created in the City treasury a special fund to be known as the "Special Gas Tax Street Improvement Fund." (Ord. 597 § 1; October 15, 1935.)

1.08.030 SPECIAL GAS TAX STREET IMPROVEMENT FUND — PAYMENTS INTO.

All moneys received by the City of Anaheim from the State of California under the provisions of the Streets and Highways Code for the acquisition of real property or interests therein for, or the construction, maintenance or improvement of streets or highways other than State highways shall be paid into said fund. (Ord. 597 § 2; October 15, 1935.)

1.08.040 SPECIAL GAS TAX STREET IMPROVEMENT FUND — EXPENDITURES FROM.

All moneys in said fund shall be expended exclusively for the purposes authorized by, and subject to all of the provisions of Article 5, Chapter 1, Division 1 of the Streets and Highways Code. (Ord. 597 § 3; October 15, 1935.)

1.08.050 SPECIAL FUND FOR CAPITAL OUTLAYS — CREATED.

A fund is hereby created for capital outlays under the provisions of that certain act of the Legislature of the State of California entitled "An Act to provide for the levy and collection of taxes and assessments for the purpose of creating a fund for capital outlays by cities, counties, cities and counties or districts," approved July 1, 1937, and being Chapter 717 of the Statutes of 1937, as amended by Chapter 341 of the Statutes of 1941 of the State of California. (Ord. 652 § 1; May 19, 1942.)

1.08.060 SPECIAL FUND FOR CAPITAL OUTLAYS — EXPENDITURES FROM.

Such fund shall be known as "Special Fund for Capital Outlays" and it shall remain inviolate for the making of any capital outlays, and no moneys shall be disbursed therefrom excepting for such a purpose, excepting upon consent of the electors obtained as provided in said Act as amended. (Ord. 652, § 2; May 19, 1942.)

1.08.070 SPECIAL FUND FOR CAPITAL OUTLAYS — TAX LEVIES.

Taxes may be levied upon the taxable property in said City for the raising of moneys for said fund but no levy so made shall exceed the limitation imposed by the general laws of the State upon the right of said City to impose taxes, without the assent of two-thirds of the qualified electors of said City voting at any general or special election at which such proposition may be submitted. (Ord. 652 § 3; May 19, 1942.)

1.08.080 SPECIAL FUND FOR CAPITAL OUTLAYS — TRANSFERS TO FUND.

The City Council may transfer to such fund any unencumbered surplus funds remaining on hand in the City at the end of any fiscal year. (Ord. 652 § 4; May 19, 1942.)

1.08.100 Local Housing Trust Fund.

.010 Establishment and Purpose. The City Council hereby establishes the City of Anaheim Local Housing Trust Fund (“LHTF”) to provide assistance in developing and maintaining affordable housing in the City.

.020 Funding Sources. The LHTF shall receive funding from voluntary developer contributions and grant opportunities. The LHTF may also receive funds from any other legally available source.

.030 Eligible Uses; Guidelines.

.0301 Generally. Funds deposited in the LHTF, and all interest thereon, shall be used to increase, improve, and preserve the City’s supply of affordable housing.

.0302 Guidelines. The terms and conditions governing the City’s expenditure of funds from the LHTF shall be set forth in guidelines adopted by the City Council (“Guidelines”). Among other things, the Guidelines shall establish eligible project types, eligible and ineligible costs, funding criteria and priorities, typical loan terms, and the application process. Adoption of the Guidelines, and any amendments, shall be by City Council resolution.

.0303 City Council Approval. Notwithstanding subsection .0302 (Guidelines) above, all expenditures from the LHTF shall require City Council approval.

.040 Administration.

.0401 Housing and Community Development Department. The Director of Housing and Community Development, or designee, shall serve as the administrator of the LHTF. The Director’s administrative responsibilities shall be set forth in the Guidelines.

.0402 Finance Department. The Finance Director/City Treasurer, or designee, shall provide financial management and accounting services for the LHTF. In addition to any responsibilities provided in the Guidelines, these responsibilities shall include: disbursing and collecting LHTF funds; maintaining and managing a separate account or accounts for LHTF funds; and, maintaining financial records for the LHTF.

.050 Annual Report. The Director of Housing and Community Development, or designee, shall prepare and present an annual report to the City Council regarding the activities undertaken with funds from the LHTF in the previous year and any other topics required by the Guidelines.
