1.04.120 PUBLIC WORKS DEPARTMENT.

.010 The Public Works Department shall be under the supervision of the Director of Public Works, which office is created. The City Engineer of the City of Anaheim may serve as, and have the title of, the Director of Public Works subject to appointment to such position by the City Manager and approval thereof by the City Council pursuant to Section 604 of the Anaheim City Charter.

.020 The Director of Public Works shall exercise supervision and control over all City-owned property, buildings, equipment and public works, except the maintenance and repair thereof other than as specified in this section, and including the construction of all City-owned buildings and public works.

.030 The Director of Public Works shall exercise supervision and control over maintenance of domestic sewers, street cleaning, refuse collection, maintenance of city streets, maintenance of curbs and sidewalks and maintenance of minor structures, drains and culverts.

.040 Any and all engineering functions, as defined by Section 6731 of the Business and Professions Code of the State of California, necessary or required to be performed in connection with any of the above-mentioned public works or properties, shall be done and performed by the City Engineer of the City of Anaheim, or such other registered engineer as may be authorized. 1.04.130 PUBLIC UTILITIES DEPARTMENT.

The Public Utilities Department shall be under the supervision of the Public Utilities General Manager, which office is created. The Public Utilities General Manager shall have the supervision of the maintenance, operation and upkeep of the electrical and water production, transmission and distribution systems and any other public utility of the City unless otherwise specified by the City Council. 1.04.140 MAINTENANCE DEPARTMENT.

.010 The Maintenance Department shall be under the supervision of the Deputy City Manager.

.020 The Assistant City Manager- Development shall exercise supervision and control over the maintenance and repair of all City-owned property, buildings, equipment and public works, including all mechanical and mobile equipment, welding, building, fabrication of metal parts, and maintenance of safety devices and other property, except such City-owned properties or equipment as are, by the provisions of this Code, declared to be under the supervision and control of the head of some other City Department. 1.04.150 PLANNING DEPARTMENT — OFFICES OF PLANNING DIRECTOR AND CHIEF BUILDING INSPECTOR.

.010 The Planning Department shall be under the supervision of the Director of the Planning and Building Department of the City of Anaheim, which office is hereby created. All references in this Code to the “Planning Director” shall mean the Director of the Planning and Building Department of the City of Anaheim. The Planning Director shall perform the functions and duties of the Planning Director as set forth in this Code unless such functions and duties, or any of them, are delegated by the Planning Director to a duly authorized designee.

.020 The Building Division, a division of the Planning Department under the supervision of the Planning Director, is hereby created. The Building Official shall be, and perform the duties of, the Chief Building Inspector and the Building Official as required by this Code. 1.04.160 HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT.

The Housing and Community Development Department shall be under the supervision of a Director of Housing and Community Development which office is hereby created. The Housing and Community Development Director shall have direct responsibility for the administration and technical operations of the Housing and Community Development Department and the acquisition, maintenance, demolition and repair of City-owned properties purchased with state and/or federal funding, including other sources of funding the City is able to secure. 1.04.240 PURCHASES OF SUPPLIES PROHIBITED.

None of the department heads of the various departments or any of the division heads of the various divisions of the City shall have authority to purchase any supplies or materials or contract any debts for supplies or materials to be used in said departments or divisions, and all supplies used by each department or division shall be obtained only through the Purchasing Division, except as permitted pursuant to Section 1.04.310 of this Code or as may be permitted under the City's authorized purchase card program under such restrictions and regulations as may be established and monitored by the Department of Finance. Any purchase or contract made by a department or division head that does not strictly conform to the requirements of this section shall be invalid unless ratified by the City Council, City Manager or Purchasing Agent, in accordance with their applicable approval authority. 1.04.250 CENTRALIZED PURCHASING SYSTEM ESTABLISHED.

A centralized purchasing system is hereby established for the purpose of the procurement of all materials, supplies and contractual services required by any and all departments of the City. The City Manager, acting for and in behalf of the Council shall have the power to issue instructions as deemed necessary for the operation of this system. 1.04.260 PURCHASING AGENT — POWERS.

The Purchasing Agent is hereby designated as an officer of the City and, as such, is empowered to sign contracts in the name of the City. The Purchasing Agent is authorized to bind the City on contracts in writing without previous approval of the Council when the value of the contract does not exceed one hundred thousand dollars, except as may be limited by Section 1211 of the City Charter. 1.04.270 PURCHASES — COMPETITIVE BIDS.

For purchases involving over Ten Thousand Dollars but not greater than Fifty Thousand Dollars, the Purchasing Agent shall make a reasonable effort to obtain competitive bids without the necessity of advertising, but with solicitation by letter, telephone or otherwise. Purchases shall then be made from the lowest responsible bidder. In the event competitive bids are not obtained, the Purchasing Agent shall document the reason(s) therefor in the files of the Purchasing Division. 1.04.290 PURCHASES — INSPECTION OF GOODS.

Inspections will be the responsibility of the receiving agency and costs of inspection will be borne by the department requesting the purchase, excepting in the case of items placed in stock. (Ord. 969 § 6; February 8, 1955.)

1.04.300 PURCHASING AGENT — FEDERAL TAX EXEMPTION CERTIFICATES.

The Purchasing Agent shall be authorized to sign certificates requesting exemption from federal tax on all materials purchased. (Ord. 969 § 7; February 8, 1955.)

1.04.310 PURCHASING AGENT — AGENCIES SERVED.

The Purchasing Agent shall be responsible for procurement of all materials, supplies, and contractual services required by any and all departments of the city, except, to the Chief of Police, such purchases as to which, because of their nature as related to confidential, special or covert operations of the Police Department, the public interest in maintaining confidentiality outweighs the public interest in public disclosure thereof, as determined by the Chief of Police; technical and special advisory or engineering services procured by the City Council; subsistence and travel expenses procured in accordance with instruction issued by the City Council; election expenses incurred by the City Clerk; library books and supplies procured by the person designated as City Librarian; Data Processing technical computer hardware and software leased or procured by the Data Processing Manager; special investigative services and rehabilitation services procured by the City’s Risk Manager; purchases through the Stadium, Arena, Convention Center, and Golf Courses food and beverage reserve accounts which are approved by the Executive Director of Convention, Sports and Entertainment or the Golf General Manager; recoverable event-related services and materials reimbursed by tenants of the Stadium or Convention Center; equipment, materials, supplies, and support services used for emergency repairs to, or operation, maintenance, or construction of, electric and water utility infrastructure contracted or procured by the Public Utilities General Manager; and purchases made pursuant to the authority of the City Manager. All services, leases, or purchases by the above Departments, Divisions or Sections shall not exceed appropriations. 1.04.311 CONFIDENTIAL POLICE OPERATIONS.

All purchases of equipment, supplies, materials and services made by the Police Department for confidential, special or covert operations pursuant to authority granted in Section 1.04.310 of this Chapter shall be subject to the following requirements:

.010 The Chief of Police, under the direction of the City Manager, shall be responsible for all procurement of materials, supplies, equipment and contractual services where, because of the nature of the purchase, as related to confidential, special or covert operations, the public interest in maintaining confidentiality outweighs the public interest in public disclosure of such purchase, as determined by the Chief of Police.

.020 Such purchases shall be limited to such materials, supplies and equipment as are needed for confidential or covert operations, and services for Special Operations, where the Chief of Police determines that the public interest in maintaining confidentiality outweighs the public interest in public disclosure of such purchases.

.030 The authority granted to the Chief of Police for confidential purchases hereunder shall be limited to a maximum of fifty thousand dollars per transaction, except when a larger amount is expressly authorized in writing by the City Manager. Expenditures pursuant to this section shall not exceed amounts appropriated and available for such purpose pursuant to the budget approved by the City Council.

.040 The Chief of Police shall maintain adequate internal controls and accurate accounting records of the confidential purchases made, identifying the expenditures or use of funds and whether made from forfeiture funds or general fund monies. He shall maintain all original documents and records regarding the use of the funds and the nature of the expenditures, subject to audit by the City's internal control staff, and shall report expenditures monthly to the City Manager.

.050 Such purchases shall follow the same procurement requirements as are required for purchases by the Purchasing Agent, including competitive bidding requirements, except in the case of those procurements to which the Chief of Police and the City Manager determine that some or all of the procurement requirements are inapplicable or inappropriate, and except that procurements exceeding twenty thousand dollars shall be reported timely to the City Manager rather than approved by the City Council.

.060 The confidentiality of all information and records pertaining to such purchases shall be maintained by all persons having access to them until the Chief of Police determines, in writing, that the need for confidentiality as to a particular purchase no longer exists. 1.04.312 CRITICAL UTILITY OPERATIONS, REPAIRS, INFRASTRUCTURE.

Equipment, supplies, materials and services contracted or procured by the Public Utilities Department for emergency repairs to, or operation, maintenance, or construction of, electric and water utility infrastructure pursuant to authority granted in Section 1.04.310 of this Chapter shall be subject to the following requirements:

.010 Contracts and purchases shall be limited to such equipment, materials, supplies, and support services needed for emergency repairs to, or operation, maintenance, or construction of, electric and water utility infrastructure, where the criticality of maintaining safe and reliable electric and water service requires sufficient inventory and effective supply chain processes that provide timely execution and delivery of such purchases.

.020 The authority granted to the Public Utilities General Manager to contract or procure equipment and support services used hereunder shall be limited to a maximum of three million dollars per transaction. Transactions greater than three million dollars shall require City Council approval. Expenditures pursuant to this section shall not exceed amounts appropriated and available for such purposes pursuant to the budget approved by the City Council.

.030 The Public Utilities Board shall be provided with periodic reports of procurement activities detailing transaction amounts, vendors, and the quantities and descriptions of equipment, supplies, materials and services procured. The Public Utilities General Manager shall maintain documents and records regarding the use of the funds and the nature of the expenditures, subject to periodic audits by the City’s Audit Division.

.040 Such purchases shall follow the same procurement requirements as are required for purchases by the Purchasing Agent, including competitive bidding requirements. City Council approval is required for purchases that require waiver of competitive bidding requirements. (Ord. 6594 § 2; November 13, 2024.)

1.04.315 PURCHASING AGENT — SURPLUS PERSONAL PROPERTY.

The Purchasing Agent shall be empowered to and is responsible for the sale of City surplus personal property having a value of fifty thousand dollars or less after the Department Head having custody of the property has determined that such property is not needed for public use. The Purchasing Agent is authorized to execute any necessary title documents in connection with the sale of such surplus personal property. (Ord. 4794 § 1; January 13, 1987.)

1.04.380 EXPENSE ALLOWANCES — PLANNING COMMISSION AND CITY COUNCIL MEMBERS.

There shall be allowed to each member of the Planning Commission, except ex officio and advisory members, the sum of fifty dollars per official meeting attended by the member not to exceed one meeting per week, and there shall be allowed to each member of the City Council the sum of twenty-five dollars per official meeting attended by the member, not to exceed one meeting per week, and in addition thereto there shall be allowed an additional sum of twenty-five dollars to the Mayor. For the purpose of his expense allowance, a council member will be deemed to be in attendance at any meeting from which he or she may be absent while engaged in official City business determined to be such by a majority vote of the City Council either in advance of or following such absence. These allowances are authorized to reimburse members for the expense of attending meetings, traveling to and from their usual place of business to meetings, traveling to and from property under consideration for action by the respective body of which they are members, and all other expenses connected with the performance of their duties as commissioners or council member. It is recognized that the Mayor will have additional expenses by reason of official appearances for the City not ordinarily incurred by council members. The expenses authorized hereunder need not be accounted for by the recipients, but no other expenses shall be allowed except as specifically authorized by the City Council. 1.04.390 BONDS REQUIRED OF CITY OFFICERS AND EMPLOYEES.

.010 Before entering upon the duties of their respective offices, the Finance Director and the City Treasurer of the City of Anaheim shall execute faithful performance bonds to the City in amounts which may, from time to time, be set by the City Council.

.020 The following employees shall be bonded under a public employees’ faithful performance blanket bond in amounts which may, from time to time, be set by the City Council:

.030 All of the employees not specifically set forth above shall be bonded by a public employees’ blanket honesty bond in amounts which may, from time to time, be set by the City Council.

.040 Nothing contained in this section shall prohibit the City Council from requiring such other additional bonds for officers and employees as it shall in its discretion deem necessary or desirable. 1.04.391 DISTRICT-BASED APPOINTMENT OF CITY BOARD AND COMMISSION MEMBERS.

.010 Appointment. In order to fulfill the purpose of district-based elections and correspond in number to the members of the City Council, all City boards and commissions shall be comprised of seven members with the following exceptions: Library Board and Sister City Commission, which shall retain their existing membership and method of appointment and removal, and the Housing and Community Development Commission, which shall be governed by section 1.04.500 of this Chapter. The Mayor and each district City Council member may directly nominate a member to each seven-member board and commission. Nominations shall be at the discretion of the nominating official, however priority shall be given to eligible district residents. Once nominated, individuals shall be selected for appointment by a majority vote of the City Council.

.020 Removal. For those boards and commissions named and established in Article IX of the City Charter (Planning Commission, Parks and Recreation Commission, Library Board, and Public Utilities Board), members shall be removed as provided in the City Charter. All other board and commission members may be removed by a majority vote of the City Council.

.030 Term of Service. The terms of service of members of boards and commissions named and established in the City Charter shall be as set forth in the Charter. The terms of service of members of City boards and commissions for which a term of service is not otherwise specified in either the City Charter or this Chapter shall run concurrently with the current term of the district elected official or Mayor who nominated the member. The number of terms of service of a board or commission member shall be calculated from the date the member was first appointed.

.040 Applicability. This section 1.04.391 shall not apply to the Anaheim Resort Maintenance District Advisory Board. (Ord. 6401 § 2 (part); March 21, 2017: Ord. 6415 § 1; July 11, 2017: Ord. 6458 § 1; January 29, 2019).

1.04.392 BOARD AND COMMISSION ORIENTATION.

.010 Staff liaison to City boards and commissions will arrange for new members to receive appropriate orientation, incorporating Brown Act and ethics training, following the scheduled annual appointments set forth in Section 1.04.391.030 of the Anaheim Municipal Code of when a new member assumes their official duties. 1.04.395 LIMITATIONS ON CITY BOARD AND COMMISSION SERVICE.

.010 Statement of Purpose.

.0101 City boards and commissions perform a valuable service to the City of Anaheim by providing a means by which the City Council can obtain the advice, opinions and recommendations of City residents and other members of the community. The City has a large number of talented and qualified individuals who are capable of serving as board and commission members. The City is best able to draw upon the talents and abilities of its people by the periodic, systematic and continual infusion of new members to serve on the City’s appointed boards and commissions.

.0102 For the above reasons, it is the desire of the City Council to encourage and solicit service on its boards and commissions by those who have not previously or recently served in such capacity. Neither the establishment of limitations on board and commission service set forth in this section, nor the failure of the City Council or any of its members to reappoint a board or commission member eligible for reappointment, should be viewed as a criticism of any person’s performance or service, but, rather, as a desire to encourage and facilitate public service by the greatest number of qualified individuals.

.020 Limitation on Length of Service.

.0201 No person shall serve more than two consecutive terms as a member of a City board or commission.

.0202 Any person who has served two consecutive terms on a City board or commission shall not be eligible for reappointment to that board or commission until expiration of a period of two years from the date of such person’s most recent service on that board or commission.

.0203 Any period of service equal to at least one-half of the length of a complete term shall be considered a term of service for purposes of this section.

.0204 Any person who serves less than one-half of a complete term on a board or commission and, within two years, is reappointed to that same board or commission to fill an unexpired term, shall be deemed to have served a full term if the total period of service for both such partial terms equals at least one-half of a full term of service.

.030 Prohibition on Concurrent Service.

.0301 No person shall concurrently serve as a member of two or more City boards or commissions.

.0302 Any person appointed by the City Council to serve as a member of any City board or commission who is then currently serving as a member of another City board or commission shall be deemed to have vacated the prior position upon acceptance of the new appointment.

.040 Any person serving as an ex-officio member, educational sector voting stakeholder member, or non-voting emeritus member of any City board or commission shall not be deemed a member of such board or commission for purposes of the limitations imposed by this section. 1.04.396 REMOVAL OF BOARD AND COMMISSION MEMBERS DUE TO EXCESSIVE ABSENCES FROM MEETINGS.

.010 If a member of a City board or commission shall be absent with or without cause from three meetings of the board or commission on which that member serves within any six (6) month period, the secretary or staff liaison to such board or commission shall immediately file a written report thereof with the City Clerk, who shall notify the nominating Council Member or Mayor of such report. At the discretion of the nominating Council Member or Mayor, such board or commission member may be subject to possible removal by the nominating Council Member or Mayor, respectively, at a public meeting. If a member of a city board or commission is absent with or without cause from two (2) additional meetings within the six (6) months immediately succeeding the first three (3) absences, the secretary or staff liaison to such board or commission shall immediately file a written report thereof with the City Clerk, who shall schedule consideration of the possible removal of the member as an agenda item at the next regular meeting of the City Council, or as soon thereafter as the matter can be considered. Such board or commission member shall be subject to removal by the affirmative votes of a majority of the total membership of the City Council.

.020 An absence shall be considered an absence for cause if either (1) the member informs the chairperson or the City staff liaison of such City board or commission of such member's intended absence at least 24 hours prior to the scheduled time of the meeting, or (2) such absence is due to unforeseeable and unavoidable circumstances which circumstances are orally reported and explained by the member at the next regular meeting of the board or commission following such absence, or which are reported and explained in writing to the secretary and staff liaison of the board or commission prior to the next regular meeting of the board or commission.

.040 For purposes of this section and sections 1.04.391 and 1.04.395, the term "City board or commission" shall mean and include any board or commission of the City of Anaheim whose members are appointed by the City Council as specified in Article IX of the City Charter or as otherwise created by formal action of the City Council, including the members of any board created by a joint exercise of powers agreement to which the City is a party and pursuant to which the City Council has the power to appoint at least a majority of the board members.

.050 For purposes of this section, the term "meeting" shall mean and include any regular, adjourned or special meeting of the City board or commission to which the provisions of this section are being applied. 1.04.450 CULTURAL AND HERITAGE COMMISSION.

The Cultural and Heritage Commission is hereby established pursuant to Section 900 of the Charter of the City of Anaheim.

.010 Duties. The Cultural and Heritage Commission shall:

(a) Advise the City Council on matters concerning the arts, culture and historic preservation and heritage;

(b) Develop prioritized strategies providing recommendations to City Council related to the implementation of the Cultural Arts Plan;

(c) Oversee the City’s cultural and historical assets (including, but not limited to, the Anaheim Museum and the Mother Colony House).

(d) Facilitate cooperative efforts of private individuals, community organizations, and businesses that promote and enhance the cultural and historic environment of the City through events and programs;

(e) Develop recommendations concerning the allocation of City resources, as available, for the support of cultural and historic works of art, events, and programs within the City;

(f) Explore the need for cultural facilities in the City of Anaheim;

(g) Advise and make recommendations with respect to the temporary and/or permanent placement and maintenance of works of art at City-owned facilities;

(h) Advise and make recommendations related to the acceptance of gifts of art to the City;

(i) Develop a mechanism for soliciting and including public input in the process of selection of works of art and their placement, when appropriate;

(j) Recommend for City Council a set of policies and procedures pertaining to visual art in public places;

(k) Recommend for City Council a set of goals and annual objectives that will serve the visual, performing, literary, and multi-media arts.

(l) Encourage support by private individuals and organizations of the arts and of cultural and historic facilities and programs;

(m) Advocate and enlist community interest and participation in the arts and in cultural and historic programs; and

(n) Perform such additional functions as may be delegated or required by the City Council from time to time.

.020 Advisory Committees. The Commission may appoint advisory committees to oversee the historical and cultural assets of the community. Separate advisory committees may be appointed to address the needs of the Mother Colony House, the Anaheim Museum, Art in Public Places, and other cultural, historical or City heritage purposes as needed.

.030 Composition. The Cultural and Heritage Commission shall consist of seven (7) members.

(a) The Director of the Department of Community Services or his or her designee shall serve as the liaison to the Commission.

(b) The City Manager, the Superintendent of the Anaheim Union High School District and a representative of the Parks and Recreation Commission and the Library Board shall be ex-officio members of the Cultural and Heritage Commission. Such ex-officio members shall have no voting rights at meetings of the Cultural and Heritage Commission and shall not be counted for purposes of determining a quorum for purposes of such meeting.

.040 Qualifications. Each member of the Cultural and Heritage Commission shall be a resident of the City of Anaheim at the time of appointment and during the entire tenure of service on the Commission. Appointed members shall not hold any paid office or employment in the City government and shall not be a current officer or board member of any Anaheim-based arts or cultural organization at the time of the appointment and during the entire tenure of service on the Commission.

.050 Term of Office. Each member of the Commission shall serve a term that runs concurrently with the current term of the elected official who nominated the member, and until his or her respective successor is appointed and qualified.

.060 Unscheduled Vacancies. A vacancy occurring before the expiration of a term of a board or commission member shall be filled by appointment for the remainder of the term in the manner prescribed for appointments in Section 1.04.391.

.070 Meetings. The Cultural and Heritage Commission shall meet regularly at least once a month in the City of Anaheim or in a location authorized by the City Council or as otherwise provided by law. Regular meeting dates and times shall be established by the Commission. A majority of the total number of members of the Commission then in office shall constitute a quorum. The Commission shall comply with the provisions of the Ralph M. Brown Act (commencing with Government Code Section 54950, et seq.).

.080 Procedures. The meetings and procedures of the Commission shall be subject to and governed by the resolutions and ordinances of the City Council establishing rules and regulations for City boards and commissions.

.090 Organization. The Cultural and Heritage Commission shall elect one of its members as chairperson on an annual basis, which chairperson shall preside at meetings of the Commission and shall serve at the pleasure of the Commission.

1.04.955 ANAHEIM SISTER CITY COMMISSION.

.010 Establishment. The Anaheim Sister City Commission is hereby established pursuant to Section 900 of the Charter of the City of Anaheim.

.020 Duties. The Anaheim Sister City Commission shall have the power and duties to:

(a) Advise the City Council on matters concerning sister city relationships including the promotion of cultural/educational exchange and knowledge sharing.

(b) Recommend to the City Council by-laws, for City Council approval, which govern the Commission's own internal procedures consistent with the Charter, ordinances and resolutions of the City of Anaheim and all other applicable laws, rules and regulations.

(c) Make recommendations to the City Council of goals, objectives and programs to ensure the successful management of the existing sister city relationships.

(d) Make recommendations to the City Council on how to effectively manage the existing sister city relationships and ensure their success and effectiveness, as measured by City Council approved goals, strategies and programs.

(e) Make recommendations to the City Council regarding criteria for the establishment of new sister city relationships, including the creation of selection criteria that aim to match the City with a suitable partners.

(f) Make recommendations to the City Council regarding the expenditure of funds that further the approved goals, strategies and programs.

(g) Establish the appropriate subcommittees tasked with implementing specific programs, strategies and goals, consistent with the approved by-laws and other applicable laws, rules and regulations.

(h) Provide the Mayor and Council with an annual report outlining the programs and accomplishments of the Commission and its affiliations.

(i) Perform such additional advisory functions as may be delegated or required by the City Council from time to time.

.030 Composition, Appointment and Removal of Members.

(a) The Anaheim Sister City Commission shall consist of fifteen (15) members. The Mayor and each City Councilmember shall each directly nominate one member to the Commission, which nomination shall be approved by a majority vote of the City Council. The remaining eight (8) members shall be appointed by a majority vote of the City Council, and shall consist of two (2) educational sector members and six (6) at large members. Commission members may be removed by a majority vote of the City Council.

(b) Each member of the Commission nominated by the Mayor or a member of the City Council shall be a resident of the City of Anaheim. Nominations shall be at the discretion of the nominating official, however priority shall be given to eligible district residents. Representatives from the educational sector shall be employees or officials of schools or school districts that serve Anaheim residents. At large members may consist of other parties, including non-profit organizations, business owners, and their respective representatives that have a vested interest in Anaheim and the success of the Sister City Program. Appointed members shall not hold any paid office or employment in the City government.

(c) The City Manager shall appoint a City representative to serve as the staff liaison to the Commission. This member of City staff shall be an ex official member and will not have voting rights at meetings of the Commission and shall not be counted for purposes of determining a quorum at the Commission meetings.

.040 Term of Office.

(a) Each member of the Commission nominated by the Mayor or a district elected official shall serve a term that runs concurrently with the current term of the elected official who nominated the member and until his or her successor is appointed and qualified.

(b) Of the remaining eight (8) members of the Commission, four (4) members (including one educational sector member) shall serve initial terms of four (4) years, expiring when their respective successors are appointed and qualified, with the other four (4) members (including the second educational sector member) serving initial terms of two (2) years, expiring when their respective successors are appointed and qualified. The City Council shall select by casting of lots which members shall serve initial terms of two years. Following their initial terms, each of the aforementioned Commission members shall serve terms of four years.

(c) Limitations on the total length of service of Commission members shall be as provided in section 1.04.395.020.

.050 Unscheduled Vacancies. A vacancy occurring before the expiration of the term shall be filled for the remainder of the term in the same manner as provided above.

.060 Meetings and Procedures. The Anaheim Sister City Commission shall meet regularly at least once a month in the City of Anaheim or in a location authorized by the City Council or as otherwise provided by law. Regular meeting dates and times shall be established by the Commission. A majority of the total number of members of the Commission then in office shall constitute a quorum. .080 Organization. The Anaheim Sister City Commission shall annually, at its first regular meeting following the first day of January, select one (1) of its members as chairperson and one (1) of its members as vice-chairperson, who shall serve in this capacity for one year or until his or her successor is selected. The Commission shall recommend to the City Council by-laws for approval by the City Council to govern the Commission's own internal procedures consistent with the Charter, ordinances and resolutions of the City of Anaheim and all other applicable laws, rules and regulations.

.0702 Meet at least six times per year to act on matters referred to it by the City Council and receive input regarding older adult needs and projects that would assist in meeting those needs; and

.0703 Perform such additional functions as may be delegated or required by the City Council from time to time.

1.04.996 BUDGET, INVESTMENT AND TECHNOLOGY COMMISSION.

.010 Establishment. The Budget, Investment and Technology Commission is hereby established pursuant to Section 900 of the Charter of the City of Anaheim.

.020 Composition. The Commission shall consist of seven (7) members.

.030 Qualifications. Each member of the Commission shall be a resident of the City of Anaheim at the time of appointment and during the entire tenure of service on the Commission and shall not hold any paid office or employment in the City government. The members shall also meet and retain certain qualifications, if any, as may be established by resolution of the City Council. No member shall be financially interested in any contract, or otherwise conduct any business with, the City or any of its agencies, either on an individual basis or as a partner, shareholder, member or employee of any firm.

.040 Term of Office. Each member of the Commission shall serve a term that runs concurrently with the current term of the elected official who nominated the member and until his or her successor is appointed and qualified.

.050 Unscheduled Vacancies. Any vacancy occurring before the expiration of the term of a Commission member shall be filled by appointment for the remainder of such term in the manner prescribed for appointments in Section 1.04.391.

.060 Organization, Meetings and Procedures.

.0601 The Commission shall elect one of its members as a chairperson on an annual basis, which chairperson shall preside at meetings of the Commission and shall serve at the pleasure of the Commission.

.0602 The Commission shall meet regularly at least four times each year and shall hold such other meetings as from time to time shall be called in the manner and form required by law. Meetings shall be conducted in accordance with Section 904 of the Anaheim City Charter. Regular meeting dates and times shall be established by the Commission. A majority of the total number of members of the Commission then in office shall constitute a quorum.

.0603 The meetings and procedures of the Commission shall be subject to and governed by the resolutions and ordinances of the City Council establishing rules and regulations for City boards and commissions.

.0604 The Commission shall have the power to appoint subcommittees of less than a quorum of the Commission to perform tasks within the scope of the Commission’s responsibility and to make reports and recommendations for consideration by the Commission.

.070 Appropriations. The City Council shall include in its annual budget such appropriations of funds as, in its opinion, shall be sufficient for the efficient and proper functioning of the Commission.

.080 No Compensation. Members of the Commission shall serve without compensation.

.090 Powers and Duties. The Budget, Investment and Technology Commission is an advisory body to the City Council and, as such, shall have the following powers and duties:

.0901 Investment Policy.

.01 Review the annual investment policy proposed by the City Treasurer and the monthly City Treasurer’s report as submitted to the City Council pursuant to Section 53607 of the Government Code; and review other investment reports, if any, prepared for submission to the City Council.

.02 Make recommendations to the City Council regarding said investment policy, monthly City Treasurer’s reports, and other investment reports, if any, submitted to the City Council.

.03 Act in an advisory capacity to the City Council in matters pertaining to the investment of City funds and the funds of other agencies governed by the City Council and which funds are invested by the City Treasurer (including but not limited to funds of the Anaheim Housing Authority and Anaheim Public Financing Authority).

.04 Review and make recommendations on the City Treasurer’s investment strategies and portfolio asset and maturity structure. Emphasis of the Commission shall be on overall investment activities incorporating cash flow, permitted investments and risk/return factors. The Commission shall function in a general oversight capacity and shall not make investment decisions on individual securities.

.0902 Budget.

.01 Review the annual budget proposed by the City Manager pursuant to Section 1201 of the City Charter.

.02 Hold public meetings concerning the proposed annual budget and make recommendations regarding said budget to the City Council in conjunction with, and prior to the conclusion of, the public hearing thereon required pursuant to Section 1202 of the City Charter.

.03 Act in an advisory capacity to the City Council in matters pertaining to short- and long-range financial planning and funding of City activities.

.04 Review the City’s general fund, capital improvement program, and special funds budgets, including review of policies and procedures, time frames, format, and specific allocation proposals. Emphasis of the Commission shall be on programs and/or major expenditures, not on line item detail.

.05 Review proposals and make recommendations regarding new and increased revenue sources.

.06 Review proposals and make recommendations regarding service delivery alternatives.

.07 Explore alternative approaches for financing future capital improvement projects.

.08 It shall not be the purpose of the Commission to advise on regular or routine Treasury administration. It is intended that the Commission act in an advisory capacity to the City Council only and that the Commission not be vested with final authority in the establishment of investment strategies or the purchase of specific securities nor that it direct City staff to conduct costly analyses unless specifically directed and approved by the City Council.

.0903 Technology.

.01 Act in an advisory capacity to the City Council in matters relating to the use of that information technology that will assist in the accomplishment of the City’s goals and objectives.

.02 Partner with City leaders and key stakeholders, businesses and residents to identify long-term, strategic goals and objectives of City technology uses.

.03 Recommend technologies aimed at addressing the needs of a diverse cross-section of the City’s residents, businesses and visitors.

.04 Review and maintain knowledge of current and future technology trends.

.0904 Perform such additional duties and functions as may be required from time to time by specific action and direction of the City Council.

.0905 Receive such administrative support, assistance and information from the City Manager, and/or such other appointed officers or employees of the City as directed by the City Manager, and/or such consultants, advisors or professionals as engaged by the City for such purpose, as may be directed by the City Council, or as may from time to time reasonably be requested by the Commission for purposes of performing the duties and functions specified herein; provided, however, any such requests must be consistent with the City Charter and all City ordinances, resolutions, contracts, policies and rules, including any limitations contained in the City Charter which are otherwise applicable to the City Council or its members. 1 .04.998 ANAHEIM RESORT MAINTENANCE DISTRICT ADVISORY BOARD.

.010 Establishment. The Anaheim Resort Maintenance District Advisory Board ("Advisory Board") is hereby established pursuant to Section 900 of the Charter of the City of Anaheim.

.020 Membership. The Advisory Board shall consist of seven members.

.030 Election of advisory board.

.0301 Elections. The initial Advisory Board shall be elected by the property owners in the Anaheim Resort Maintenance District at a property owners' meeting held within the time and manner provided in subsection .060 of this section. Thereafter, the Advisory Board members shall be elected for all seats then coming vacant at an annual meeting of all property owners as described in subsection .060 of this section.

.0302 Qualifications. In order to serve on the Advisory Board, an individual must be nominated by the owner of an assessable lot or parcel within the Anaheim Resort Maintenance District at the Initial Meeting or the Annual Meeting at which the election will be held. Both the nominating property owner (or such owner's duly authorized representative) and the nominee of that property owner must be present at the Initial Meeting or the Annual Meeting at which the election is held in order for the candidate to be eligible for election to the Advisory Board. Each owner of an assessable lot or parcel within the Anaheim Resort Maintenance District may nominate up to one candidate for each seat then coming vacant on the Advisory Board.

.0303 Cumulative Voting. Each owner of an assessable lot or parcel within the Anaheim Resort Maintenance District shall have a total number of votes in the Advisory Board election equal to the number of Advisory Board seats then up for election multiplied by the amount of such owner's assessment (including any zone assessment). Each owner of an assessable lot or parcel within the Anaheim Resort Maintenance District may vote for a number of Advisory Board candidates up to, but not in excess of, the number of seats then open for election on the Advisory Board. Each owner may allocate his total number of votes at his discretion, including, if so desired by an owner, allocating all of his votes to one candidate even if multiple seats on the Advisory Board are then open for election. A representative of the owner of an assessable lot or parcel within the Anaheim Resort Maintenance District must be present at the Initial Meeting or the Annual Meeting in order for that owner to be eligible to vote in the Advisory Board election held at that meeting. The candidate receiving the largest number of votes shall be considered elected to the first open seat on the Advisory Board; the candidate receiving the second largest number of votes shall be considered elected to the second open seat on the Advisory Board, and so on, until all open seats are filled. With respect to the seven members of the Advisory Board first appointed, the four candidates receiving the most votes shall be elected for four-year terms and the three candidates receiving the next highest number of votes shall be elected to two-year terms. Ties in voting shall be settled by the casting of lots.

.040 Term of appointment. Each member of the Advisory Board shall serve for a term of four years and until his or her respective successor is elected; provided, however, that the terms of the Advisory Board members first appointed shall expire as follows:

Four at the end of four years following their election;

Three at the end of two years following their election.

.050 Vacancies. Any vacancy occurring before the expiration of the term of an Advisory Board member shall be filled by election of the property owners in the Anaheim Resort Maintenance District at the next Annual Meeting following the vacancy.

.060 Organization, meetings and procedures.

.0601 No later than ninety days after the hearing of the formation of the Anaheim Resort Assessment District as described is Streets & Highways Code Section 22587(e) a meeting of the property owners shall be held (the "Initial Meeting") at which time the first Advisory Board shall be elected. Thereafter, the Advisory Board members shall be elected for all seats then coming vacant at an annual meeting of all property owners (the "Annual Meeting").

.0602 With the exception of the year in which the Initial Meeting is held, the Annual Meeting shall be held between July 1 and September 30 of each year. Notice of the Annual Meeting shall be mailed by first-class mail to each property owner within the Anaheim Resort Maintenance District, the local Hotel/Motel Association, and the Anaheim Visitor and Convention Bureau no less than fourteen days prior to each meeting by the Anaheim City Manager or his or her designee. The Advisory Board shall meet each fiscal quarter following the Annual Meeting as deemed necessary.

.0603 All meetings shall be held within the City of Anaheim at a location to be determined by the Anaheim City Manager, and shall be coordinated in all respects and chaired by the Anaheim City Manager or his or her designee who shall be a nonvoting member of the Advisory Board.

.0604 The Advisory Board shall be required to comply with the provisions of the Ralph M. Brown Act (Chapter 9 [commencing with Section 54950] of Part I of Division 2 of Title 5 of the Government Code).

.0605 Recommendations forthcoming from any meeting of the Advisory Board shall be recorded by the Anaheim City Manager or his or her designee and distributed to all property owners and owners of businesses situated in the Anaheim Resort Maintenance District who annually submit a written request for such information in writing to the Anaheim City Manager.

.070 Costs and expenses. The costs and expenses of the Advisory Board, including the cost of the Annual Meeting of property owners at which members of the Advisory Board are elected and the cost of the report to be prepared annually by the Advisory Board, shall be included in the costs financed by the Anaheim Resort Maintenance District.

.080 No compensation. Members of the Advisory Board shall serve without compensation.

.090 Report regarding assessments. The Advisory Board shall prepare or cause to be prepared a written report to the Anaheim City Council for each fiscal year for which assessments are to be levied and collected in the Anaheim Resort Maintenance District. The report shall be filed with the City Clerk on or before May 31 of each year and shall contain all of the following information:

.0901 the maintenance, servicing, and promotions recommended by the Advisory Board to be provided for the forthcoming fiscal year, including specifications for each;

.0902 an estimate of the costs of the maintenance, servicing and promotions recommended by the Advisory Board to be provided for the forthcoming fiscal year;

.0903 the amount of any surplus or deficit revenues estimated to be carried over from the current to subsequent fiscal year;

.0904 the amount of any contributions to be made from sources other than assessments levied in the Anaheim Resort Maintenance District;

.0905 the third party providers, if any, recommended by the Advisory Board to be used to provide maintenance, servicing and/or promotions in that fiscal year; and

.0906 an evaluation of the Anaheim Resort Maintenance District's performance in the immediately preceding twelve month period against the specifications previously recommended by the Advisory Board and the specifications set forth in the final engineer's report. 1.04.999 BOARDS AND COMMISSIONS — CONFLICTS OF INTEREST.

.010 It shall be unlawful for any member of any board or commission of the City of Anaheim to make, participate in making, or in any way attempt to use his or her official position to influence a governmental decision in which he or she knows or has reason to know he or she has a financial interest.

.020 The provisions of subsection .010 above shall apply only to members of boards and commissions of the City not subject to the provisions of Section 87100 of the Government Code of the State of California.

.030 The definition of terms, interpretation and application of subsection .010 above shall be as set forth in Article 1 of Chapter 7 of Title 9 (commencing with Section 87100) of the Government Code and all applicable provisions of the California Administrative Code adopted pursuant thereto, as the same may be hereinafter amended, except that the term "public official" as used in the aforesaid provisions of the Government Code and California Administrative Code shall refer to members of boards and commissions which perform a solely advisory function and which members for such reason would not otherwise be subject to the provisions of Section 87100 of the Government Code.
