§ 11.36.010 HOURS WHEN PARKING RESTRICTED.

Except as specifically provided herein, no person shall stop, stand or park a vehicle on any street between the hours of 2:00 a.m. and 6:00 a.m. of any day.

§ 11.36.014 VEHICLES EXCEPTED.

The provisions of § 11.36.010 of this chapter shall not apply to emergency vehicles.

§ 11.36.016 PERMIT REQUIRED.

(A) Annual permit. Except for those streets set forth in division (B) hereof, an annual all-night parking permit may be issued as provided in this chapter, authorizing the parking of a vehicle between the hours of 2:00 a.m. and 6:00 a.m. on any street within the city; and any person may park a vehicle between these hours on any such street, provided such all-night parking permit has been issued to the vehicle, or provided a virtual permit has been purchased and is current.

(1) A separate permit shall be required for each vehicle.

(2) No such annual permit shall be issued to commercial vehicles exceeding 6,000 pounds gross vehicle weight, non-motorized vehicles, trailers, vehicles exceeding six feet in width, vehicles exceeding 20 feet in length, vehicles exceeding eight feet in height, or any combination thereof; provided, however, that merchants/businesses located in Alhambra may apply for annual permits for any vehicles used in their business, which are otherwise authorized to be parked on the streets adjacent to their business during the day, to be parked adjacent to such business during the hours of 2:00 a.m. and 6:00 a.m.

(B) Streets excepted. Atlantic Boulevard, Fremont Avenue, Garfield Avenue, Main Street, Mission Road and Valley Boulevard.

§ 11.36.020 PERMIT APPLICATION.

Each application for an all-night parking permit shall be filed with the Finance Department via a webpage for virtual permits, and shall be accompanied by the fee specified in this chapter. A virtual permit allows the holder to park according to the type of permit purchased without displaying a physical sticker. A virtual permit relies on referencing the vehicle’s license plate and/or temporary license plate with the city’s parking permit database to identify any valid parking permits for that vehicle.

(A) Each such application shall set forth the name and Alhambra address of the applicant; the license plate number of the vehicle; the make, model and type of vehicle; and such other information as the Police and/or Finance Department may require.

§ 11.36.030 FEES.

(A) Application fee. Except as expressly waived in § 11.36.080 of this chapter, all applications for an all-night parking permit shall be accompanied by a nonrefundable fee in an amount established by City Council resolution to partially defray the expense to the city of conducting the investigation required by this chapter.

(B) Annual permit fee. Effective as of September 1, 2003, the annual fee for an all-night parking permit shall be in an amount established by City Council resolution.

(C) Payment of fee at a kiosk or via internet website. Fees for temporary overnight parking permits may be paid at a kiosk designated by the city or via the webpage.

§ 11.36.040 PERMIT ISSUANCE OR DENIAL; APPEAL.

(A) Upon the filing of each original application provided for by § 11.36.020, the Finance Department shall confirm the accuracy and completeness of such application. Any false or incomplete application, or one that does not otherwise meet the requirements set forth on such application may be denied by the Finance Department.

(B) In the event of denial, notice of denial shall be emailed to applicant by the Finance Department and the applicant may within 14 days of receipt of such notice file a written appeal from the denial with the City Council.

§ 11.36.050 ALL-NIGHT GUEST PARKING; TEMPORARY RECREATIONAL VEHICLE PARKING.

(A) Temporary parking. Notwithstanding the provisions of the foregoing sections of this chapter, whenever a resident of the city is entertaining an overnight guest or guests and is without off-street parking facilities for additional vehicles, or whenever other circumstances of a temporary nature prevent compliance by a resident with the provisions of this chapter, such person may obtain for a fee from the Police Department a temporary all-night parking permit for such vehicle or vehicles. The City Council shall establish the fee for such temporary all-night parking permit by resolution. No such permit shall be issued pursuant to this subsection to vehicles exceeding 6,000 pounds gross vehicle weight, non-motorized vehicles, trailers, vehicles exceeding six feet in width, vehicles exceeding 20 feet in length, vehicles exceeding eight feet in height or any combination thereof.

(B) Purchase of temporary permits. The temporary, all-night parking permit shall be obtained from and purchased at a self-service parking machine located at the Alhambra Police Facility, or at any other location deemed appropriate by the Chief of Police, or on the internet website for virtual permits. With the kiosk keyboard or on the internet website for virtual permits, the permittee will enter the vehicle license or temporary license number. The permit shall not be effective unless and until such vehicle license number is provided.

(C) Temporary permit for recreational vehicles. Notwithstanding the overnight parking prohibitions set forth elsewhere in this chapter, a temporary 72-hour permit may be obtained by a resident a maximum of two times for each calendar month for parking of mobile home, camper, house trailer or recreational vehicles, provided that any vehicle using such permit must also comply with all other posted or marked parking restrictions (such as limited duration parking, no parking on street sweeping days, etc.). Such vehicle, once permitted, shall be parked in front of and/or adjacent to the side yard (if corner lot) of the owner’s principal place of residence or as close thereto as reasonably possible, and further, such vehicle may only be parked where the street is not less than 32 feet in width measured from curb to curb. The permit shall be obtained from the Alhambra Police Department.

§ 11.36.060 SUBSTITUTION OF VEHICLES UNDER PERMIT.

If a permittee surrenders an unexpired permit for a certain vehicle, he or she may obtain a permit for a substituted vehicle for the unexpired term upon payment of a fee in an amount established by City Council resolution.

§ 11.36.070 CHANGE OF ADDRESS BY PERMITTEE.

If the permittee shall change his or her address, he or she shall pay an additional fee in an amount established by City Council resolution to continue in effect the remaining portion of his or her existing permit at the new location.

§ 11.36.080 PERMITS; REFUNDS, EXPIRATION AND RENEWALS.

(A) Refunds. There shall be no refunds upon any permit.

(B) Expiration. Regardless of what day of the month an all-night parking permit is issued, for the purposes of this chapter each such permit shall be deemed to have been issued on the day the permit was paid for. Each such permit shall expire 365 days after the date set forth by the applicant.

(C) Renewals. Each application for a renewal of such a permit shall be considered as a new application, except that no application fee as required in division (A) of § 11.36.030 of this chapter shall be charged unless and until the Police Department deems it necessary to conduct an investigation in accordance with § 11.36.040 of this chapter.

§ 11.36.090 PENALTY.

Whenever in this chapter any act is prohibited or is made or declared to be unlawful or an offense or the doing of any act is required or the failure to do any act is declared to be unlawful, the violation of any such provision shall be subject to civil penalties, the enforcement of which shall be governed by the civil administrative procedures set forth in Chapter 11.38 of this code.
