§ 5-20 PARADES

§ 5-20.1. Permit Required. [Ord. 71-011, § 1; 1958 Code § 20.101]¶
No person shall hold, manage, conduct or carry on any parade, march or procession of any kind or any other similar activity, without first having applied for and obtained a permit therefor from the Chief of Police as provided in this section.
§ 5-20.2. Application for Permit. [Ord. 71-011, § 1; 1958 Code § 20.102; New]¶
Any person desiring to do any of the acts specified in subsection 5-20.1 shall file an application with the Chief of Police twenty (20) days in advance of the proposed event, upon a form supplied by the City without charge to the applicant, setting forth the following information in regard to the proposed event:
a. The name, address and telephone number of the applicant.
b. The name and address of the organization, if there be one.
c. The purpose.
d. The assembly area, the route and the dispersal area.
e. The hours when the parade will start and terminate.
f. The approximate number of persons who and the number and kind of vehicles and animals which will constitute the parade.

If there shall be no prior application for a parade at such time and place and a parade at the requested time and place will not cause an undue burden upon the movement of vehicular traffic, the Chief of Police shall issue a permit granting such application. In the event that there shall be a prior application for a parade to be held at such time or place or a parade at the requested time and place will cause an undue burden upon the movement of vehicular traffic, the Chief of Police may deny the permit therefor. The applicant for a parade permit shall be notified in writing of the action of the Chief of Police in granting or denying the permit at least thirteen (13) days prior to the date of the proposed parade. In the event the application is denied, the written notice of such denial shall set forth the reasons therefor.
Upon a denial of the Chief of Police of an application made in pursuance to this section, the applicant may appeal from the determination of the Chief of Police within two (2) days thereafter to the City Council by filing such application with the City Clerk who shall set such appeal for hearing by the Council at its next meeting. Upon such appeal, the City Council may reverse, affirm or modify in any regard the determination of the Chief of Police. To carry out the judgment of the City Council upon appeal, the Chief of Police shall act in conformity with the judgment of the Council.
In the event an application is not filed within the required time as specified in subsections 5-20.1 and 5-20.2, the applicant may request a waiver of such requirement by the City Council at its next regular meeting or at a special meeting which may be called prior thereto by the City Council to consider such matter, and the City Council, if it finds unusual circumstance and in the exercise of its sound discretion may waive such requirement.
