Alameda County Municipal Code Art. I General

A. This chapter shall apply to junk dealers and secondhand dealers as defined in Chapter 9 of Division 8 of the Business and Professional Code.

B. A "cash for gold" business is a secondhand dealer that purchases goods made of gold, silver or other precious metals from individual sellers, or that prepares for such conduct of business as evidenced by the securing of applicable federal, state or local licenses, or that holds itself out as engaged in the business of buying secondhand items made of gold, silver or other precious metals. Cash for gold businesses shall be subject to all legal and regulatory requirements applicable to secondhand dealers.

It shall be unlawful to conduct, manage, or carry on a business as a secondhand dealer or a junk dealer without a license, as required by this chapter.

All articles purchased, received, exchanged or otherwise taken into possession by any second-hand or junk dealer, the retention of which is not otherwise provided by law, shall be held for a period of five days before being placed on exhibition, sold, exchanged or removed from the place of business where it was received, or delivered to any person or otherwise disposed of, provided, however, that any such article may be delivered or returned at any time to the true owner thereof or his authorized agent. Violation of this section shall be deemed a misdemeanor.
