2.16.010 - Purpose and intent.¶
It is the intent of this chapter to establish fees to recover the maximum reasonable cost for the county surveyor's examination of records of survey, corner records, amended maps, and certificates of correction. The county surveyor acknowledges that professional practitioner surveyors who file records of survey, corner records, amended maps, and certificates of correction are accorded considerable discretion in the preparation of these work products, and will strive to establish examination methods which are not unduly restrictive.
A. Records of Survey. Section 8766.5, Article 5, Chapter 15, Business and Professions Code, provides that the county surveyor may charge a reasonable fee for examining a record of survey pursuant to said Section 8766.5, and that said fee shall be fixed by an ordinance adopted for that purpose.
Section 8766.5 also provides that the fee shall not exceed the cost of the service or one hundred dollars ($100.00), whichever is the lesser, unless the fee is adopted pursuant to a staff report demonstrating that the cost of providing the examination service actually exceeds one hundred dollars ($100.00) per record of survey.
A staff report has been prepared and filed in the office of the county surveyor demonstrating that the cost of providing the examination service actually exceeds one hundred dollars ($100.00) per record of survey.
B. Amended Maps and Certificates of Correction. Section 66451.2, Article 1, Chapter 3, Division 2, Title 7, Government Code, provides that the local agency may establish reasonable fees for procedures required or authorized by said Division 2, "Subdivisions."
Procedures required by said Division 2, "Subdivisions," include that the county surveyor shall examine amended maps or certificates of correction.
C. Corner Records. Section 8773.2, Article 5, Chapter 15, Business and Professions Code, provides that the county surveyor may charge a fee for examining, indexing, and filing the corner record in an amount not to exceed that required for the recording of a deed.

2.16.020 - Collection of fees.¶
The fees for examining records of survey, amended maps, and certificates of correction, and corner records shall be as follows:
A. For a record of survey, the fee shall be five hundred dollars ($500.00) per sheet, or the cost of the service, whichever is the lesser amount.
B. For an amended map, the fee shall be two hundred dollars ($200.00) per sheet, or the cost of the service, whichever is the lesser amount.
C. For a certificate of correction, the fee shall be two hundred dollars ($200.00) per sheet, or the cost of the service, whichever is the lesser amount.
D. For a corner record, the fee shall be six dollars ($6.00).
If a record of survey includes a cover sheet which predominately contains nontechnical information such as but not limited to vicinity maps, legends, references to other information sources, or required statements, etc., that sheet shall not be counted in computing the five hundred dollars ($500.00) per sheet fee.
The county surveyor shall not begin examination until the fee has been received. Within thirty (30) days after completion of the examination and filing for record with the county recorder, a refund shall be paid if the fee exceeded the cost of the service by more than twenty-five dollars ($25.00).
(Ord. 94-39 § 1 (part): prior gen. code § 2-215.2)
