10.20.010 - Cruising.¶
A. A peace officer, when authorized by the sheriff of the county, may establish a traffic control point in traffic which is congested at or near the control point for the purpose of regulating cruising on a public street or highway pursuant to Section 21100 of the Vehicle Code.
B. "Person" as used herein shall mean an occupant of the vehicle, who has been given adequate written notice by a peace officer on the second or later trip past the control point within the two-hour period that repetitive driving is prohibited by this section.
C. No person shall drive or, having care, custody, and control thereof, permit a motor vehicle to be driven past a control point for a third or more times within any two-hour period commencing with the vehicle's first trip past the control point.
D. This section shall not apply to official emergency vehicles, taxicabs for hire, and other business vehicles being driven for business purposes.
E. Any person who violates the provisions of this section is guilty of an infraction. The first violation of this section within each two-hour period shall be punishable by a fine of not less than fifty dollars ($50.00). Each trip thereafter past the control point within the same two-hour period constitutes a separate offense, and shall be punishable by a fine of not less than seventy-five dollars ($75.00).
F. If any part of this section is declared invalid, the remainder thereof shall be given full force and effect.
