10.32.010 - Construction of chapter—Definitions.

"Parking lanes" are areas of seven feet width or less within a public highway in the unincorporated area designated for parking of vehicles.

10.32.020 - Purpose.

The board of supervisors finds that on certain public highways in the unincorporated area of the county, vehicles parked on the side of a highway may obstruct emergency vehicle access to homes and other structures located on such highways. As a result, certain restrictions on parking are necessary to protect the health and safety of county residents.

10.32.030 - Parking lanes.

In order to maintain adequate access for emergency vehicles, the board of supervisors may, pursuant to this section, require that certain public highways in the unincorporated area have parking lanes. The director of public works shall maintain a list of public highways that have parking lanes.

10.32.040 - Parking within parking lanes.

On public highways with parking lanes, all vehicles must be parked entirely within a marked parking lane. All vehicles parked so that any portion of the vehicle is outside of a parking lane shall be towed at the expense of the vehicle owner.

10.32.050 - Parking lane designation.

Parking Lanes shall be designated by appropriate signs and pavement markings which indicate vehicles must be parked entirely within the marked parking lane and that vehicles parked outside of a designated parking lane shall be towed at the expense of the vehicle owner.

10.32.060 - Duty of community development agency.

It is the duty of the director of the community development agency to enforce the provisions of Section 10.32.040. The director of the community development agency may delegate, by written order, authority to enforce Section 10.32.040 to other community development agency employees.

10.32.070 - Exempt vehicles.

Persons parking vehicles being used to provide delivery or moving services shall be exempt from this chapter while such vehicles are being used to provide delivery and moving services.

10.32.080 - Violation—Penalty.

A. Any person, firm or corporation violating, or causing or permitting to be violated, any of the provisions of this chapter shall be deemed guilty of an infraction unless such violation is described as a misdemeanor by specific provisions of this chapter.

B. Any person, firm or corporation convicted of a misdemeanor under the provisions of this chapter shall be subject to a fine or imprisonment or both, not to exceed the limits set forth in California Penal Code Section 19.

C. Any person, firm or corporation convicted of an infraction under the provision of this chapter shall be punishable upon a first conviction of a fine of not more than one hundred dollars ($100.00), and for a second conviction within a period of one year by a fine of not more than two hundred dollars ($200.00), and for a third or any subsequent conviction within a one-year period by a fine of not more than five hundred dollars ($500.00). Any violation beyond the third conviction within a one-year period may be charged by the District Attorney as a misdemeanor and the penalty for conviction of the same shall be subject to a fine or imprisonment or both not to exceed the limits set forth in California Penal Code Section 19.

D. Each person, firm or corporation shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this chapter is committed, continued or permitted by such person and shall be punishable accordingly.
