3.40.010 - Definitions.

The definitions of this section shall govern the construction of this chapter, unless the context otherwise requires:

"County communications system" means any telephone, facsimile, video or computer equipment or any radio transmitting or receiving apparatus owned by or under the control of the county of Alameda and provided for the use of any county officer, board, commission, deputy, assistant, clerk or other county employee in the performance of official duties.

"Use in conduct of county business" means using, operating or otherwise communicating by means of the county communications system in the performance of or necessary to or in the course of duties of county employment; it also includes use in emergencies and cases where family, health or safety would be best served through the use of the system.

3.40.020 - Use of the county communications system.

The county communications system shall be used only in the conduct of county business, except as stated in the definition of "use in conduct of county business" in Section 3.40.010. No county officer or employee shall use or permit the use of the system for other than the conduct of county business, except as stated in Section 3.40.010(B).

3.40.030 - Penalty for misuse of county communications system.

Any employee or appointive officer who uses the county communications system for other than use as defined in this chapter 3.40 shall be subject to disciplinary action, after an order to that effect in writing by the appointing authority, pursuant to the provisions of Section 40 of the Charter of the county.

3.40.040 - Liability for costs of misuse.

Any employee or officer who uses the county communications system for other than county business shall be liable to the county for all costs so incurred, and to the extent that a superior directs or authorizes the misuse, the superior shall also be liable.

3.40.050 - Costs of misuse.

Actual costs of misuse of the county communications system shall include the following:

A. For leased common carrier facilities including telephone and data communications circuits the actual cost of use in terms of message units, toll charges or circuit time as billed by the common carrier;

B. For computer equipment including circuits interconnected to or switched through the county data center charges as determined by the extrapolation of actual network costs;

C. For radio, microwave or other forms of nonwire communications channels costs of misuse shall be based on the cost of a common carrier wire circuit for the same distance and time.
