Adelanto Municipal Code Ch. 13.70 Banners

The provisions of this Chapter apply to the making of applications for and the granting and control of permits for the placement, erection, maintenance and removal of banners extending over, upon or along any highway or any portion thereof.

An applicant for a banner permit shall complete and file with the Public Works Department an application which shall include the following:

• 1. The location, dimensions and purpose of the banner;
• 2. A facsimile of the proposed banner, including any legend or written matter;
• 3. The proposed date and time of day when the banner will be installed;
• 4. The proposed date and time of day when the banner will be removed;
• 5. Such other information as the City Engineer may require.

Permits issued pursuant to this Chapter shall be granted only to civic organizations or public bodies for the purpose of bringing to the attention of the public events which are of general public interest in the community. No permit shall be issued to further political, religious or private purposes.

No permit shall be granted for a period in excess of forty (40) days.

Every applicant for a banner permit shall pay the application and any other fees established by resolution of the City Council.

An applicant shall submit proof of public liability and property damage insurance to the City Engineer in the amounts and otherwise as required by the City, as a condition of and prior to issuance of the banner permit.

The City Engineer may require that the installation of any banner be under the supervision of a City inspector, for which the permittee shall reimburse the City’s costs.

The permittee shall, as a condition of any permit issued pursuant to this Chapter, post any fee or deposit required by the City Engineer, to cover the following:

A. The permit issuance fee;

B. The cost of any required City administration or inspection;

C. The cost of any repairs made necessary as a result of installation or removal of the banner.

The balance of any special deposit required, if any, shall be refunded to the permittee upon satisfactory removal of the banner.

A permittee, upon the removal of any banner for which a permit under this Chapter has been issued, shall remove all material and debris resulting from the installation, maintenance or removal of any banner, within twenty-four (24) hours after removal of the banner.
