13.65.010 Permit Required.¶
A. No person shall hold, conduct, participate in, or carry on any parade, march or procession on any street in the City, or beat any drum, gong, triangle or tambourine, or blow, use or play any wind or stringed instrument, or provide amplified sound, upon any street in the City, unless the person has made written application for an received from the City Engineer, a permit authorizing the person to do so. All applications for the permit shall set forth the following:
A map detailing the route along which the parade, march or procession proposes to travel;
The date, time of the proposed parade, march or processing, starting time and length of same;
- The names and addresses of the persons in control of the same or responsible therefor;
- The purpose of the parade, march or procession; and
- The number of people that will be participating in the activity.
B. All permits which include closing or blocking of any streets or portions of streets, sidewalks or intersections shall be forwarded to the Public Works Department for a cost estimate for traffic control/traffic control devices for the parade, march or procession, and to the Police Department for a cost estimate to provide an adequate level of public safety for the parade, march or procession.
C. Any request for a parade, march or procession which will involve the closure of any portion of a street designated as a major arterial or greater shall be reviewed by an appropriate City commission or committee for a determination as to whether the proposed parade, march or procession is of general benefit or interest to the community, and for its recommendation to the City Engineer. The City Engineer may refer any request for a parade, march or procession which will involve the closure of any portion of a street designated as an arterial to the appropriate commission or committee for its recommendation.
13.65.020 Permit Fee.¶
Upon submission of an application for a parade, march or procession, the applicant shall pay an application fee established by resolution of the City Council. Upon approval of the application, the applicant shall pay a fee or deposit established by the City Engineer estimated to cover the actual cost to the City of providing traffic control, regulation and law enforcement services determined by the City to be necessary for the parade, march or procession.
13.65.030 Exemptions - Permit Fee.¶
No application fee shall be required for, of or from any non-profit organization providing a service, by contract or other arrangement, to the City without remuneration or which otherwise is beneficial to the City.
13.65.035 Cost Reimbursement.¶
Applicants for a parade permit must agree in writing to pay or reimburse the City for its costs incurred, on behalf of the organizers of the parade, march or procession. Applicants will be required to post a deposit of at least one-half (1/2) of the estimated costs, with the balance to be billed to the responsible party following the event and the calculation and submittal of actual costs incurred. The City may determine, in its sole discretion, the manner and timing of payment.
13.65.050 Notification Along Parade Route.¶
If any parade, march or procession that is located on a street designated as a major arterial or arterial, and that has been referred to a City commission or committee, will block access to homes or businesses for any length of time, all affected homes or businesses along the proposed route must be notified of the time and place of the commission or committee meeting at which the permit is to be considered. Notices of the meeting shall be mailed by the City at the applicant’s expense, or the organizers of the activity may elect to notify affected residents and businesses with proof that such notice has been given.
13.65.060 Appeals.¶
Any person aggrieved by any decision or determination of the City Engineer may within ten (10) business days of the date of the decision or determination appeal to the City Council, which shall hold a hearing on the appeal upon giving at least ten (10) days’ notice to the appellant of the time and place of the hearing. All costs of notice and hearing by the City Council shall be borne by the appellant. The decision of the City Council and the subject of the appeal at the hearing shall be final and conclusive.
