It is unlawful for any person to commence or operate or permit the operation of a public dance or a public dance hall without first obtaining a license to do so pursuant to this Chapter.

Application for such license shall be made to the Collector in writing and shall state the names and addresses of the persons having authority and control over the location and the owners of the location and the place where the dance, or dance hall is to be conducted. Upon receipt of such application, together with the license fee, as in this Title provided, the Collector shall thoroughly investigate the application and shall deny the same if:

A. The applicant, whether an individual, any partner, corporate officer or director, has been convicted of a felony or of any crime involving moral turpitude;

B. The structures or real property where the applicant intends to conduct business pursuant to a license do not comply with all applicable laws or are injurious to the public health or safety; or

C. The applicant has previously had a dance hall license forfeited, suspended or revoked under the provisions of this Chapter or any City ordinance.

A. Upon approval of such license by the Collector, the Collector shall issue a license to the applicant; such license shall set forth the name of the applicant and the place where the dance or dance hall is to be conducted. Each license shall be nontransferable, shall be posted in a conspicuous place on the premises in respect to which it is issued and shall be exhibited to any law enforcement officer or City official upon demand.

B. Each license issued hereunder is separate and distinct and no person shall seek to exercise the privileges granted thereunder except the person to whom it is issued and at the specific place for which it was issued.

The Collector may, upon its own decision and shall upon the verified complaint in writing of any person, investigate the conduct of any such dance or dance hall and shall have power to temporarily suspend or permanently revoke a license issued hereunder in accordance with this Chapter.

It is unlawful for any person, corporation or association of persons to operate, conduct or carry on a public dance, or a public dance hall, or for any person to dance at any public dance or in any public dance hall, between the hours of 2:00 a.m. and 8:00 a.m.

It is unlawful for any person, to employ anyone on a salary or on a commission or for anything of value, directly or indirectly, whose obligation, duty or business it is or shall be to dance with or act as a dancing partner at any public dance or at any public dance hall. It is further unlawful and a violation of this Chapter for anyone to engage in such employment.

It is unlawful for any person to operate, conduct or carry on a public dance or a public dance hall in any manner which is detrimental to public health, welfare or safety or which causes a disturbance of the peace or a public nuisance.
