Chapter 1.05 — THE CITY SEAL AND CITY LOGO, AND THE USE THEREOF

1.05.010 Declaration of Intent.

Prior to the adoption of this Chapter, there was no mechanism by which the City could prevent unauthorized placement of the City Seal or City Logo on documents or materials in a manner that could mislead, deceive, or confuse the viewer that the material bearing the City Seal or City Logo was generated by the City, or that the City otherwise approves of, consents to, sponsors, authorizes or endorses the materials or its contents. In the absence of the adoption of this Chapter, the public could become confused, deceived or misled by such documents or materials, which would be detrimental to the public health, safety and welfare, and the effective operation of the City.

1.05.020 Definitions.

A. The term “City Seal” means the official seal of the City of Adelanto that was adopted by the Adelanto City Council pursuant to Resolution No. 96-07, adopted on February 13, 1996. The image of the City Seal is substantially the same as the form shown below:

B. The term “City Logo” means the official logo of the City of Adelanto that is displayed on official City documents, notices, stationery, City uniforms and vehicles, the image of which is substantially the same as the form of the City Seal.

C. The term “document” means any tangible or intangible form of communication or representation, including, but not limited to, any writing, as that term is defined in the California Public Records Act.

1.05.030 Adoption.

The form of the City Seal and City Logo, set forth hereinabove, are hereby adopted as the City Seal and City Logo.

1.05.040 Prohibitions.

A. No person shall place the City Seal or City Logo, or any copy, facsimile, imitation, or replica thereof, on any document or materials in a manner that could cause a viewer to reasonably believe that the document or material was generated by the City; that the document or material bearing the City Seal or City Logo was generated by the City or that the person or entity responsible for creating the document or material bearing the City Seal or City Logo was generated by the City; that the City otherwise approves of, consents to, sponsors, authorizes or endorses the material or document or its contents; or that the person or entity generating the material is employed by, an officer of or otherwise affiliated with the City.

B. It shall be unlawful for any person to place or use the City Seal or the City Logo or any copy, facsimile, imitation or replica thereof on any written or printed material supporting or opposing any candidate or candidates for any elective public office or any local or statewide referendum, initiative or other ballot measure, except upon the approval of the City Council.

C. Any person who violates the provisions of this Chapter shall be guilty of an infraction and shall be subject to penalties pursuant to Chapter 1.20 of this Code.

D. The City Council may, by resolution, adopt a policy for the official use of the City Seal or City Logo by officers, employees and agents of the City, which policy may be in addition to the limitations included in this Chapter.
