Chapter 22.82 — CERTIFICATE OF COMPLIANCE

Any person owning real land in the city or a vendee of that person pursuant to a contract of sale of the real property may request that the city file a certificate of compliance with the county of Orange recorder's office. If said certificate is found to be in compliance with the requirements of Section 22.82.020, the directors of public works and development services shall approve the certificate for the city.

Prior to the issuance of a certificate of compliance the following shall be accomplished:

• (1) An application shall be submitted which identifies the real property (map and legal description) together with the required fee as established by city council resolution;

• (2) If a determination is made that the real property complies with the provisions of this section and the Subdivision Map Act, a certificate of compliance shall be issued;

• (3) If a determination is made that the real property does not comply with the provisions of this section and the Subdivision Map Act, a conditional certificate of compliance shall be issued which imposes conditions which would be applicable to a current division of the property. This conditional certificate shall serve as notice to the property owner and/or vendee or any subsequent transferee or assignee of the property that the fulfillment and implementation of these conditions shall be required prior to subsequent issuance of a permit or other grant of approval for development of the property;

• (4) The property owner and/or vendee shall be responsible for the recordation of the (conditional) certificate of compliance and shall pay all costs associated with this recordation.
