5-29.008 Standards.

a.

All permits or approvals subject to the provisions of this chapter shall result in lots which are capable of being developed and used in accordance with the zoning designation which applies to the property. No development shall create lots which are impractical of improvement due to steepness of terrain, lack of reasonable access and parking, lack of utilities, location of watercourses, excessive grading or similar constraints.

b.

Lots, other than corner lots, having double street frontage and with depths of less than 200 feet, will not be approved except where necessitated by topographic or other physical conditions or where ingress or egress to and from one of the streets is prohibited.

c.

Flag (panhandle) lots may be created where the stated requirements of this chapter are clearly met and where the access route, to the buildable area of the lot, is within the pole or panhandle portion of the lot. (Also, note the additional parking requirement for residential units served by driveways longer than 150 feet, subsection 19.16.008b, 1(a).

d.

Area, Frontage and Depth Minimums.

1.

This section only applies to those affected permit or approval processes which result in lots for which details of development, such as specific building design and location, parking location, lighting, walkways, etc., are yet to be presented, as opposed to lots which are sized in response to the details of an approved development plan.

2.

The minimum area and frontage requirements of lots for all affected permit or approval processes not exempted by paragraph 1 above shall be governed by the largest lot size determined as follows:

(a)

The lot size specified by the zoning which is in effect on the subject property; or

(b)

The lot size determined by the following slope requirements.

40% Plus Five acres 300 ft. or that distance of
frontage abutting the 40% plus
slope, whichever is greater.
  • For panhandle lots both the panhandle portion and the first 40 feet of the lot proper are calculated for slope to determine area.

Lots shall have a minimum depth (front to rear dimension) of 80 feet. The pole/panhandle portions of flag lots is not counted in measuring lot depth.

4.

Unless the provisions of the zoning of the subject property or the provisions of this section require a greater amount of street frontage, nonflag lots shall have a minimum street frontage of 40 feet and flag lots shall have a minimum frontage of 20 feet.

5.

In cases where an access easement including panhandles exists on a lot, the total square footage necessary to meet zoning requirements for that particular zone shall be calculated excluding the access easement or panhandle area.

6.

In cases where an access easement exists on a lot, the total footage necessary to meet minimum lot width requirements for that particular zone shall be calculated excluding the access easement.
