21.08.040 - Building site.

"Building site" means that portion of the lot or parcel of land upon which the building and appurtenances are to be placed, or are already existing, including adequate areas for sewage disposal, clearances, proper drainage, appropriate easements, and, if applicable, the requirements of other ordinances.

21.08.045 - Compact Lot Subdivisions.

The following terms are defined solely for the purpose of Section 21.24.375 (Compact lot subdivisions):

A.

"Compact lot" means a fee-simple, single-family residential lot less than 5,000 square feet in size, created within a compact lot subdivision. A parking-only lot or driveway lot created within such subdivision, if any, shall not be considered a compact lot. Undersized lots, underwidth lots, substandard lots or lots with the required area and/or width modified by a Housing Permit (Chapter 22.166), a Conditional Use Permit (Chapter 22.158), or a Variance (Chapter 22.194) shall not be considered compact lots if such lots are not shown on a tentative map and on the final map or parcel map with the words "DIVISION OF LAND FOR COMPACT LOT PURPOSES ONLY" printed on the face of the map. Development of single-family residences on compact lots shall be subject to the regulations set forth in Section 22.140.585 (SingleFamily Residences on Compact Lots).

B.

"Compact lot subdivision" means a division of land that creates fee-simple, single-family residential lots, each containing an area of less than 5,000 square feet.

C.

"Parking-only lot" means a commonly-owned lot designated for parking purposes in a compact lot subdivision.

D.

"Private common driveway" means a privately owned and maintained driveway located on a strip of land, connecting two or more compact lots to a public street. Each user of a private common driveway may own part of said driveway and has the legal right to use the entire driveway, or one owner may own the entire private common driveway, and, by a recorded easement, establish the other users' right to use the driveway for ingress, egress, drainage, sewer, water, utilities, right to grade, and maintenance purposes only.

21.08.050 - County surveyor.

"County surveyor" means county engineer.

21.08.060 - Cul-de-sac.

"Cul-de-sac" means a street which is designed to remain permanently closed at one end. For the purposes of this Title 21, the length of a cul-de-sac shall be measured along the centerline of the cul-de-sac from the

point where the centerline terminates within the turnaround to the right-of-way line of the street with which the cul-de-sac intersects.

21.08.070 - Division of land.

For the purpose of this Title 21, the term "division of land" refers to subdivisions unless a more restrictive meaning is clearly determinable from the context.

21.08.075 - Hearing officer.

"Hearing officer" means the person who is an employee of the department of regional planning appointed by the director and confirmed by the board of supervisors to perform the duties which are delegated to the advisory agency by this Title 21.

21.08.080 - Lease.

A.

"Lease" means and includes an oral or a written lease, tenancy at will, month-to-month or similar tenancy.

B.

Title 21 shall not apply to leases referred to in Subsection B of Section 21.08.090 (Lease Project).

21.08.090 - Lease project.

A.

"Lease project" refers to a development wherein two or more residential, commercial, or industrial buildings are constructed and maintained on a parcel of land, and apartments, offices, stores, or similar spaces are leased within one or more of the buildings, with overall control of the land and buildings comprising the project being retained by the lessor. Accessory or satellite buildings and parking structures shall not be included when computing the number of buildings within a lease project.

B.

The term "lease project" does not refer to the following:

1.

Notwithstanding Subsection A, above:

a.

The leasing of individual dwelling units, offices, stores, or similar spaces within one or more apartment houses, as defined in Section 22.14.130, commercial buildings, or industrial buildings; or

b.

A development wherein two or more residential buildings containing no more than a total of four dwelling units, not including any accessory dwelling unit, constructed and maintained on a lot, if:

i.

The development is located outside of a Hillside Management Area, as depicted in the General Plan, in its entirety; and

ii.

The lot is:

(a)

In Zones R-2 or R-3;

(b)

Outside of a Very High Fire Hazard Severity Zone, as depicted in the General Plan, in its entirety;

(c)

Outside of the Coastal Zone, as defined in Division 2 (Definitions) of Title 22, in its entirety;

(d)

Outside of a Significant Ecological Area, as depicted in the General Plan, in its entirety;

(e)

Outside of the 70 or above decibel Community Noise Equivalent Level (dB CNEL) noise contour of an Airport Influence Area, as depicted in the General Plan, in its entirety;

(f)

Served by a public water system;

(g)

Served by a public sewer system;

(h)

Fronting a highway or a public street; and

(i)

Of 15,000 net square feet or less;

2.

The leasing of accessory dwelling units or junior accessory dwelling units;

3.

The leasing of mobilehome parks or trailer parks;

4.

The leasing of any parcel of land, or any portion thereof, in conjunction with the construction of commercial or industrial buildings on a single parcel; or

5.

Mineral, oil, or gas leases.

C.

To ensure compliance with this Section, lessors may be required to execute a covenant and agreement with the County at the discretion of the Director.

21.08.100 - Lot.

"Lot" and parcel shall be used synonymously.

21.08.110 - Minor land division.

"Minor land division" means a subdivision creating four or less parcels, a condominium project creating four or less condominiums as defined in Section 783 of the Civil Code, a community apartment project containing four or less parcels, or a lease project containing four or less building sites.

21.08.120 - Ordinance.

A reference to an ordinance by number means an ordinance of the county of Los Angeles.

21.08.130 - Pad.

"Pad" means a building site prepared by artificial means including grading, excavation or filling, or any combination thereof.

21.08.140 - Section.

"Section" means a section of the ordinance codified in this Title 21 unless reference is made to some statute or other ordinance.

21.08.150 - Shall and may.

"Shall" is mandatory; "may" is permissive.

21.08.160 - Sloping terrain.

"Sloping terrain" means any ground surface having a grade of eight percent or more. The latest available Six and Seven and one-half minute United States Geological Survey Quandrangles or a survey by a registered civil engineer or licensed land surveyor shall be utilized to determine such grade.

21.08.170 - Subdivision.

A.

"Subdivision" means the division by any subdivider of any unit or units of improved or unimproved land, or any portion thereof, shown on the latest equalized county assessment roll as a unit or as contiguous units, for the purpose of sale, lease, financing or transfer of title, whether immediate or future.

Property shall be considered as contiguous units even if it is separated by roads, streets, utility easements or drainage or railroad rights-of-way.

2.

The provisions of Section 66424.2 of the Subdivision Map Act concerning the merger of contiguous parcels of land shall be applied in determining whether the sale, lease, financing or transfer of title of contiguous parcels is a subdivision under the terms of this section.

3.

"Subdivision" includes a condominium project, as defined in Section 1350 of the Civil Code; a community apartment project, as defined in Section 11004 of the Business and Professions Code; or a lease project, as defined in this Title 21.

4.

Any conveyance of land to a governmental agency, public entity or public utility shall not be considered a division of land for purposes of computing the number of parcels.

5.

The qualification contained in Section 66424.1 of the Subdivision Map Act concerning the division of a unit of land before a change in the equalized county assessment roll shall apply to subdivisions as defined in subsection A of this section.

B.

Division of Land For Mobilehome Purposes. The term "subdivision" shall also refer to any area or tract of land designed to accommodate mobilehomes used for human habitation approved as a division of land for mobilehome purposes and for which a final map or parcel map has been recorded pursuant to the provisions of this Title 21. For the purpose of this title, this type of subdivision shall be considered a residential subdivision.

21.08.180 - Subdivision Map Act.

"Subdivision Map Act" means Division 2 of Title 7 of the Government Code.

21.08.190 - Vesting tentative map.

"Vesting tentative map" shall mean a tentative map for a subdivision that when approved or conditionally approved by the advisory agency confers a vested right to proceed with development for a specified period of time after recordation in accordance with applicable ordinances and general and specific plans in effect at a predetermined date.
