§ 16.24

All improvements required by the city in the division or subdivision of land, including the placing of monuments, shall be installed in accordance with the standard specifications and subdivision improvement requirements adopted by resolution of the city council, and shall be subject to inspection and approval by the city engineer and acceptance by the city council.

A.

The subdivider shall improve, or agree to improve, all streets, highways or public ways in the subdivision. Improvements shall be installed to permanent line and grade and to the satisfaction of the city engineer, in accordance with the standard specifications of the city as they exist or may be established from time to time.

B.

The minimum street and other improvements which the subdivider shall make or agree to make prior to acceptance and approval of the final subdivision map shall be as follows:

1.

Grading of streets and alleys, installations of curbs, gutters and drainage structures and disposition of drainage;

2.

Placing of base material and pavement of a thickness, width and quality specified for the particular type of street;

3.

Sidewalks as may be required in accordance with standard cross-sections for various width streets as adopted by the city;

4.

A water system of efficient design and capacity to furnish an adequate water supply for each lot in the subdivision and for adequate fire protection to the area through mains and hydrants, or an acceptable alternate water supply;

5.

Sanitary sewer main facilities and lateral connections for each lot, or an acceptable alternate, and storm drainage sewers where required;

6.

Services from all utilities for each lot shall be made in such manner as will obviate the necessity for disturbing completed street improvements;

7.

Species and location of trees as approved by the planning commission to be planted for landscaping in rights-of-way;

8.

Street lighting system, street signs, traffic warning devices or other such features as may be required in the particular subdivision.

C.

The planning commission may recommend, and the city council may, when in its judgment a necessity exists for such improvement, require telephone, telegraph and electric wires in, along or across certain streets, alleys, highways, ways, easements or public places in the subdivision, to be placed underground and may regulate the placing of poles and suspending of any wires in, along or across any of such streets, alleys, highways, ways, easements or public places. The difference in costs between normal aboveground and required underground installations shall be borne by the subdivider.

D.

The planning commission may approve street improvements for hillside streets consisting of appropriate base and street pavement, valley gutters and improved four- to six-foot shoulders.

A.

1.

Before approval of the final map by the city council, the subdivider shall execute and file an agreement between himself and the city specifying the period within which he shall complete all improvement work to the satisfaction of the city council and; providing, that if he shall fail to complete such work within the specified period, the city council may complete such work and recover the full cost and expense thereof from the subdivider. The agreement shall also cover any costs and fees for map checking, improvement plan checking and constitution or improvement inspections.

The agreement may also provide for the construction of the improvements in units; for an extension of time under conditions therein specified; for the termination of the agreement upon the completion of proceedings under an assessment district act for the construction of improvements deemed by the city council to be at least the equivalent of the improvements specified in such agreement and required to be constructed by the subdivider; and for progress payments to the subdivider from any deposit money which the subdivider may have filed in lieu of a surety bond, as provided by this chapter.

B.

The subdivider shall also file with such agreement, to assure his full and faithful performance thereof, a bond for such sum as is sufficient to cover the cost of such improvements, maintenance, corrections and inspection. Such bond shall be executed by a surety company authorized to conduct a surety business in the state and shall meet requirements of the city council as to form and sufficiency. In lieu of such bond the subdivider may deposit cash or a certified or cashier's check with the city council.

C.

In the event the subdivider shall fail to complete all improvement work in accordance with the provisions of this title and the agreement, the city shall have the same completed, or if fees and inspection costs have not been paid and are due, the city shall call on the surety for reimbursement, or shall appropriate from any cash deposit funds for reimbursement.

D.

No extension of time, progress payments from cash deposits or releases of surety bond or cash deposit shall be made except upon certification by the engineer that work covered thereby has been satisfactorily completed, and upon approval of the city council.
