Chapter 16.150

DEDICATION, PARK LAND OR FEES-IN-LIEU

As a condition of approval of any parcel map or final subdivision map for residential purposes, the subdivider shall dedicate land, pay a fee in-lieu thereof, or both, at the option of the city, for park or recreational purposes at the time and according to the standards and formula set forth in this chapter.

• A. Where a park and/or recreational facility has been designated in the community development plan or determined by the planning commission or council to be required and is to be located in whole or in part within a proposed subdivision of more than fifty parcels the subdivider shall dedicate land for park purposes in an amount prescribed in Section 16.150.050 and may be required to reserve additional land for city acquisition pursuant to Chapter 16.160.

• B. When only a portion of the land to be subdivided is proposed as a site for a park in the community development plan, or is required as a condition of approval of a tentative map or development plan, such portion shall be dedicated and a fee-in-lieu shall be paid for any additional land that would have been required to be dedicated pursuant hereto.

• C. When a major part of the local park or recreational site has already been acquired by the city and only a small portion of land is needed from the subdivision to complete the site, such remaining portion shall be dedicated and a fee-in-lieu shall be paid for any additional land that would have been required to be dedicated pursuant hereto.

In the case of a subdivision of fifty or less parcels or where required pursuant to Section 16.150.020B and C a fee-in-lieu of land dedication shall be paid in an amount determined based on the formula set forth in Section 16.140.050 and prescribed by separate city ordinance. (Ord. 471 § 3, 1990)

• A. The amount of land to be dedicated and reserved within a subdivision and its location shall be determined by the planning commission as a condition of tentative map or development plan approval.

• B. Land to be dedicated shall be suitable for park or other recreational purposes to serve the immediate and future needs of residents in the area.

• C. Fees-in-lieu shall be used to acquire land reserved pursuant to Chapter 16.160 and other park land and for the improvement of the existing park and recreational facility or for the improvement of other local parks and recreational facilities in the area serving the subdivision.

• A. The amount of land to be dedicated for park purposes and the basis for calculating the feein-lieu shall be based on the average number of persons/ dwelling unit X .0050 as set forth in subsection B of this section.

• B. The following table based on the above formula is to be followed:
