Chapter 16.060 — PARCEL MAP PROCEDURE

§ 16.060.010. Filing.

Following tentative map approval a subdivider may file with the city a parcel map for any of the following subdivisions:

  • A. The subdivision is to create four or less parcels, exclusive of any portion of the parcel designated as a remainder pursuant to Section 66424.6 of the Map Act.

  • B. The land before division contains less than five acres, each parcel created by the division abuts upon a maintained public street or highway and no dedications or improvements are required by the city; or

  • C. Each parcel created by the division has a gross area of twenty acres or more and has an approved access to a maintained public street or highway; or

  • D. The land consists of a parcel or parcels of land having approved access to a public street or highway which comprises part of a tract of land zoned for industrial or commercial development, and which has the approval of the city as to street alignments and widths; or

  • E. Each parcel created by the division has a gross area of not less than forty acres or is not less than a quarter of a quarter section.

At the time of filing of a parcel map the subdivider shall pay the fee for plan checking and processing in the amount set forth in the current city fee schedule. (Ord. 471 § 3, 1990)

§ 16.060.030. Procedure.

  • A. City Engineer Review. Following receipt of a parcel map the city engineer shall review the map and if it is in compliance with the Map Act and local ordinance, and if the conditions of tentative map approval have been met, he shall certify the parcel map. The time limits for action or approval of a tentative map and parcel map for which a tentative map is not required shall be no larger than the time limits contained in Section 16.050.030(F).

  • B. Improvement Plans Approval Required. Review of a parcel map and certification shall not proceed until the improvement plans for the subdivision have been submitted to the city engineer and approved.

  • C. Appeal. In the event that the subdivider is dissatisfied with any determination of the city engineer either as to whether a proposed subdivision qualifies as a parcel map or as to any requirements or conditions which the city engineer seeks to impose, the subdivider may appeal such determination pursuant to Chapter 16.170.

map to the Contra Costa County recorder's office for recordation.

  • B. Failure to file a parcel map with the county recorder within sixty days from the date of certification of such map shall terminate all proceedings after which any subdivision of the same land shall require the filing of a new map.

  • C. Approval by the city engineer shall include authority to accept or reject dedications and offers of dedication made by statement on the map.

§ 16.060.050. Waiver of parcel map.

  • A. Purpose. It shall be the purpose of this chapter to implement and supplement the Subdivision Map Act through the adoption of local procedures and regulations for the subdivision of land through parcel maps.

  • B. Applicability. A property owner/ subdivider may file an application for a waiver of the requirements for a parcel map and the community development director and city engineer may waive the requirements for a parcel map for any of the following divisions of property (Government Code Section 66428):

    1. A division of real property or interests therein created by probate, eminent domain procedures, partition, or other civil judgments or decrees; or

    2. A division of property resulting from conveyance of land or interest therein to or from a governmental agency, including the city, or a public entity or public utility for a public purpose, such as a school site, public building sites, or rights-of-way or easements for streets, sewers, utilities, drainage, etc., unless a showing is made in individual cases that public policy necessitates a parcel map. "Land conveyed to or from a governmental agency" includes a fee interest, a leasehold interest, an easement or a license; or

    3. Subdivisions of a portion of the operating right-of-way of a railroad corporation, as defined by Section 230 of the Public Utilities Code, that are created by short-term leases.

  • C. Findings. Upon request of the property owner/subdivider, the community development director and city engineer, pursuant to Government Code Section 66428(b), may waive the parcel map requirements when they so find that the proposed division of land complies with requirements as to:

    1. Zoning and land use; and

    2. Area; and

    3. The city's standard engineering specifications for improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability and environmental protection.

  • D. Requirements and Conditions. A waiver of a parcel map shall be required to conform to the city's, and all other jurisdictional agencies, ordinances, laws and policies relating to:

    1. Payment of fees and land dedication as identified in this code, the city's development

fee program and other policies as established by the city and all other jurisdictional agencies relating to payment of fees, division of land and development; and

  1. Any property specific requirements that may be conditioned for division of land; and

  2. Deferral of conditioned improvements pursuant to Section 16.166.020; and

  3. Environmental Review pursuant to the California Environmental Quality Act.

  • E. Certificate of Compliance. Upon waiving the parcel map requirement, the city engineer shall cause to be recorded with the Contra Costa County recorder's office, a certificate of compliance for the land to be divided. at a minimum, the certificate shall contain:

    1. A plat map showing the parcels;
  1. Legal descriptions of the divided parcels; and

  2. Any conditions to be fulfilled and implemented prior to subsequent permit issuance or other approval for development of the parcels.
