Scope & applicability (where CBC points to energy law)

The CBC sets scope and application in Chapter 1 and applies energy requirements by referencing the California Energy Code (Title 24, Part 6) and agency adoptions.

Overview

This part of the California Building Code (CBC) explains the limits of the code and how it incorporates and references other regulatory schemes for subject areas—including energy—so those requirements apply to buildings and their systems. Section §101.2 defines the CBC’s scope for construction, alteration and related work; §101.3 expressly lists energy conservation among the code’s purposes; and §101.4 makes referenced standards and other codes a part of the CBC “to the prescribed extent” of each reference .

Practically, that means energy requirements are usually implemented through Title 24, Part 6 (the California Energy Code) and related Title 24 parts, and the CBC points to those energy regulations rather than restating them. State adopting agencies and program-specific sections in Chapter 1 also identify where agency adoptions require enforcement of the Energy Regulations (for example, OSHPD adoptions and agency enforcement cross-references), and local energy ordinances or local modifications that change energy requirements must follow the California Energy Commission’s approval rules (see §101.7.1) . The CBC’s matrix of adopted parts and agency banners further shows that Title 24, Part 6 (and the CEC) are the primary paths where the CBC “points” to energy law .

  • CBC § 101.7.1. Medium relevance — show source text

    This code does not limit the authority of city, county, or city and county governments to make necessary changes to the provisions contained in this code pursuant to Section 101.7.1. The effective date of amendments, additions or deletions to this code for cities, counties, or cities and counties filed pursuant to Section 101.7.1 shall be the date on which it is filed. However, in no case shall the amendments, additions or deletions to this code be effective any sooner than the effective date of this code.

    Local modifications shall comply with Health and Safety Code Section 18941.5(b) for Building Standards Law, Health and Safety Code Section 17958.5 for State Housing Law or Health and Safety Code Section 13869.7 for Fire Protection Districts.

    101.7.1 Findings and filings.

    1. The city, county, or city and county shall make express findings for each amendment, addition or deletion based upon climatic, topographical or geological conditions. For the purpose of this section, climatic, topographical or geological conditions include local environmental conditions as established by the city, county, or city and county.

    2. The city, county, or city and county shall file the amendments, additions or deletions expressly marked and identified as to the applicable findings. Cities, counties, cities and counties, and fire departments shall file the amendments, additions or deletions and the findings with the California Building Standards Commission at 2525 Natomas Park Drive, Suite 130, Sacramento, CA 95833.

    3. Findings prepared by fire protection districts shall be ratified by the local city, county, or city and county and filed with the California Department of Housing and Community Development at 9342 Tech Center Drive, Suite 500, Sacramento, CA 95826.

    4. The city, county, or city and county shall obtain California Energy Commission approval for any energy- related ordinances consistent with Public Resources Code Section 25402.1(h)(2) and Title 24, Part 1, Section 10-106. Local governmental agencies may adopt and enforce energy standards for newly constructed buildings, additions, alterations and repairs, provided the California Energy Commission finds that the standards will require buildings to be designed to consume no more energy than permitted by Part 6. Such local standards include, but are not limited to, adopting the requirements of Part 6 before their effective date, requiring additional energy conservation measures, or setting more stringent energy budgets.

    101.8 Alternate materials, designs and methods of construction. The provisions of this code are not intended to prevent the use of any alternate material, appliance, installation, device, arrangement, method, design or method of construction not specifically prescribed by this code, provided that any such alternative has been approved. An alternate shall be approved on a case-by-case basis where the enforcing agency finds that the proposed alternate is satisfactory and complies with the intent of the provisions of this code and is at least the equivalent of that prescribed in this code in planning and design, energy, water, material conservation and resource efficiency, environmental air quality, performance, safety and the protection of life and health. Consideration and compliance provisions for occupancies regulated by adopting state agencies are found in the sections listed below.

    SECTION 101—SCOPE AND GENERAL REQUIREMENTS

    [A] 101.1 Title. These regulations shall be known as the Building Code of [ NAME OF JURISDICTION ], hereinafter referred to as “this code.”

    [A] 101.2 Scope. The provisions of this code shall apply to the construction, alteration, relocation, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures.

    Exception: Detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories above grade plane in height, shall comply with this code or the California Residential Code .

    [A] 101.2.1 Appendices. Provisions in the appendices shall not apply unless specifically adopted.

    [A] 101.3 Purpose. The purpose of this code is to establish the minimum requirements to provide a reasonable level of safety, health and general welfare through structural strength, means of egress, stability, sanitation, light and ventilation, energy conservation, and for providing a reasonable level of life safety and property protection from the hazards of fire, explosion or dangerous conditions, and to provide a reasonable level of safety to firefighters and emergency responders during emergency operations.

    [A] 101.4 Referenced codes. The other codes specified in Sections 101.4.1 through 101.4.7 and referenced elsewhere in this code shall be considered to be part of the requirements of this code to the prescribed extent of each such reference.

    Enforcing agency— Health Care Access and Information/Office of Statewide Hospital Planning and Development (OSHPD). The office shall also enforce the California Energy Commission—Energy Regulations, the Division of the State Architect—Access Compliance regulations and the regulations of the Office of the State Fire Marshal for the above-stated facility type.

    The one- and two-family dwelling code is intended to be adopted as a legally enforceable document, and it cannot be effective without adequate provisions for its administration and enforcement. The provisions of Chapter 1 establish the authority and duties of the building official appointed by the authority having jurisdiction and also establish the rights and privileges of the design professional, contractor and property owner.

    Division II is not adopted by the Department of Housing and Community Development except where specifically indicated. Note: Specific sections of Chapter 1, Division II adopted by the State Fire Marshal will be indicated in the Matrix Adoption Table.

    PART 1—SCOPE AND APPLICATION

    SECTION R101—SCOPE AND GENERAL REQUIREMENTS

    R101.1 Title. These provisions shall be known as the Residential Code for One- and Two-family Dwellings of [ NAME OF JURISDICTION ], and shall be cited as such and will be referred to herein as “this code.”

    R101.2 Scope. The provisions of this code shall apply to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress and their accessory structures not more than three stories above grade plane in height.

    Exception: The following shall be permitted to be constructed in accordance with this code where provided with an automatic sprinkler system complying with Section R309 :

    1. Live/work units located in townhouses and complying with the requirements of Section 508.5 of the California Building Code.

    2. Owner-occupied lodging houses with five or fewer guestrooms.

    3. A care facility with five or fewer persons receiving custodial care within a dwelling unit.

    4. A care facility with five or fewer persons receiving medical care within a dwelling unit.

    5. A day care facility for five or fewer persons of any age receiving care within a dwelling unit.

    R101.2.1 Appendices. Provisions in the appendices shall not apply unless specifically adopted.

    R101.3 Purpose. The purpose of this code is to establish minimum requirements to provide a reasonable level of safety, health and general welfare through affordability, structural strength, means of egress, stability, sanitation, light and ventilation, energy conservation and safety to life and property from fire and other hazards and to provide a reasonable level of safety to firefighters and emergency responders during emergency operations.

    SECTION R102—APPLICABILITY

    R102.1 General. Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall be applicable. Where, in any specific case, different sections of this code specify different materials, methods of construction or other requirements, the most restrictive shall govern.
