What fees apply and when must design-loads be posted?

If a commercial or industrial floor is designed for more than 50 psf live load (or a design snow load), the owner must post a durable, conspicuous sign in that part of the story stating the design load; snow loads are posted the same way. The building official will not issue a certificate of occupancy until the required signs are installed. Permit fees must be paid before a permit is valid, but the CBC leaves the actual fee amounts to the adopting authority’s schedule.

What the code requires — 2-4 sentences

The California Building Code requires owners (or their authorized agents) to conspicuously post design live loads for any floor or portion of a commercial or industrial building that is designed for live loads greater than 50 pounds per square foot (psf) (§ 106.1). Snow loads used as a design value must be posted in the same manner (§ 106.1.1). Permit-related fees (and the timing of payment) are controlled separately: a permit is not valid until the prescribed fees have been paid and fees are set in the schedule established by the applicable governing authority (§ 109.1–§ 109.2).

Requirements in detail

Which buildings and loads trigger posting

  • Commercial or industrial buildings: any floor (or portion of a floor) designed for live loads exceeding 50 psf must have the design live load posted in that story or area. (§ 106.1).
  • Snow loads: snow loads used in design are posted like live loads (§ 106.1.1). Where the code separately specifies thresholds for balconies/decks and roof snow loads, those thresholds apply (see Exceptions & special cases below). (§ 106.1.1 and § 106.1.2).

Who must post, where, and what the notice must convey

  • Who posts: the building owner or the owner’s authorized agent posts the signs. (§ 106.1).
  • Where posted: “conspicuously posted … in that part of each story in which they apply” — in the area of the floor or portion of the story designed for the higher live load. (§ 106.1).
  • What the sign must convey: the required information is the design live load (or design snow load) expressed in psf; signs must be durable and conspicuous. (§ 106.1, § 106.1.1).

Durability and tampering

  • Signs must be durable; it is unlawful to remove or deface the posted notices. (§ 106.1).

Timing and effect on occupancy

  • Certificate of occupancy: a certificate of occupancy required by § 111 shall not be issued until the floor-load signs required by § 106.1 are installed. (§ 106.2).

Permit fees and timing

  • Payment required before validity: a permit is not valid until the fees prescribed by law have been paid. (§ 109.1).
  • Fee schedule: fee amounts are determined by the schedule established by the applicable governing authority (local jurisdiction or state agency), i.e., the CBC requires payment but leaves amounts and schedule to the authority. (§ 109.2).

Valuation, penalties and related fee rules

  • Valuation: applicants must provide an estimated value of the work at time of application; the building official may adjust valuations for fee calculation. (§ 109.3).
  • Work before permit: starting work before obtaining required permits can trigger an additional fee as established by the building official (in addition to required permit fees). (§ 109.4).
  • Related fees and refunds: payment of one fee does not waive other legally prescribed fees; building officials are authorized to establish refund policies. (§ 109.5–§ 109.6).

Exceptions & special cases

  • DSA and OSHPD: the posting requirement language in § 106.1 carries notes for special enforcing agencies — for example, the Division of the State Architect (DSA-SS, DSA-SS/CC) and OSHPD have their applicability notes; those agency-regulated buildings are explicitly included where indicated in the CBC text. (§ 106.1 and headings).
  • Balconies, decks and elevated walking surfaces: where design snow loads at exterior balconies, decks and other elevated walking surfaces exceed 50 psf, post as for live loads. For roof snow loads, when design roof (not ground) snow loads exceed 20 psf, roof design snow loads for each roof level must be conspicuously posted. (§ 106.1.2).
  • Vehicle/garage loading: maximum allowed vehicle weights and similar postings for garages are required by other structural posting provisions and referenced to § 106.1 for posting location and responsibility (see § 1607.8.5). The posting format follows § 106.1, but the load values may be specified elsewhere (e.g., vehicle loads). § 1607.8.5 cross-references § 106.1 for posting.

Common mistakes

  • Assuming numeric fee amounts are in the CBC. The CBC requires fees be paid but does not set exact fee amounts — those are set by the adopting authority (§ 109.2). Always check your local fee schedule.
  • Posting in the wrong location or omitting portions: a common error is posting at building entrances rather than “in that part of each story in which they apply.” The sign must be posted where the higher design load applies (§ 106.1).
  • Removing or defacing signs: owners or managers sometimes remove load signs during renovations; the CBC makes it unlawful to remove or deface required notices (§ 106.1).
  • Forgetting certificate-of-occupancy linkage: expecting a CO while required signs are not yet installed — § 106.2 blocks issuance of the CO until the signs are in place.
  • Beginning work before paying fees: starting construction without a permit can trigger extra fees in addition to the normal permit fees (§ 109.4).

Worked example — concrete scenario

Scenario: A business owner plans a new commercial mezzanine area within a warehouse. The mezzanine is designed for a live load of 125 psf.

  1. Posting: Because the mezzanine floor portion is designed for a live load exceeding 50 psf, the owner (or authorized agent) must conspicuously post a durable sign in the mezzanine area stating the design live load (125 psf). This is required by § 106.1. The owner must not remove or deface the sign. (§ 106.1).

  2. Certificate of occupancy: The building official will not issue the certificate of occupancy for the space until that required floor-load sign is installed per § 106.2.

  3. Permit fees: The owner must pay the permit fee(s) before the permit is valid; the exact fee amount will follow the local governing authority’s fee schedule (CBC requires payment and allows the authority to set the schedule, § 109.1–§ 109.2). If the owner started construction before obtaining the permit, an additional fee could apply (§ 109.4).

Note: The CBC gives the posting requirement and the timing relationship to occupancy and permits, but it does not prescribe the monetary fee in dollars — check the local fee schedule for numeric fee calculations.

    106.1.1 Snow load posting. [OSHPD 1, 1R, 2, 4 & 5] Snow loads used in design shall be posted as for live loads.

    106.1.2 Snow load posting. [DSA-SS, DSA-SS/CC] When design snow loads at exterior balconies, decks and other elevated walking surfaces exceed 50 psf, the design snow loads shall be posted as for live loads. When design roof (not ground) snow loads exceed 20 psf, the roof design snow loads for each roof level of the building shall similarly be conspicuously posted with signs stating the maxi- mum design roof snow loads.

    [A] 106.2 Issuance of certificate of occupancy. A certificate of occupancy required by Section 111 shall not be issued until the floor load signs, required by Section 106.1, have been installed.

    [A] 106.3 Restrictions on loading. It shall be unlawful to place, or cause or permit to be placed, on any floor or roof of a building, structure or portion thereof, a load greater than is permitted by this code.

    SECTION 107—CONSTRUCTION DOCUMENTS

    [A] 107.1 General. Submittal documents consisting of construction documents, statement of special inspections, geotechnical report and other data shall be submitted in two or more sets, or in a digital format where allowed by the building official, with each

    permit application. The construction documents shall be prepared by a registered design professional where required by the statutes of the jurisdiction in which the project is to be constructed. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional.

    Exception: The building official is authorized to waive the submission of construction documents and other data not required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that review of construction documents is not necessary to obtain compliance with this code.

    [A] 107.2 Construction documents. Construction documents shall be in accordance with Sections 107.2.1 through 107.2.8.

    [A] 105.4 Validity of permit. The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this code or of any other ordinance of the jurisdiction. Permits presuming to give authority to violate or cancel the provisions of this code or other ordinances of the jurisdiction shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the building official from requiring the correction of errors in the construction documents and other data. The building official is authorized to prevent occupancy or use of a structure where in violation of this code or of any other ordinances of this jurisdiction.

    [A] 105.5 Expiration. Every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 180 days after its issuance, or if the work authorized on the site by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. The extension shall be requested in writing and justifiable cause demonstrated.

  • CBC § 1607.8.2 Medium relevance — show source text

    1607.8.2 Fire truck and emergency vehicles. Where a structure or portions of a structure are accessed by fire department vehicles and other similar emergency vehicles, those portions of the structure subject to such loads shall be designed for the greater of the following loads:

    1. The actual operational loads, including outrigger reactions and contact areas of the vehicles as stipulated and approved by the building official.
    2. The live loading specified in Section 1607.8.1.

    Emergency vehicle loads need not be assumed to act concurrently with other uniform live loads.

    1607.8.3 Heavy vehicle garages. Garages designed to accommodate vehicles that exceed a 10,000-pound (4536 kg) gross vehicle weight rating, shall be designed using the live loading specified by Section 1607.8.1. For garages the design for impact and fatigue is not required.

    Exception: The vehicular live loads and load placement are allowed to be determined using the actual vehicle weights for the vehicles allowed onto the garage floors, provided that such loads and placement are based on rational engineering principles and are approved by the building official, but shall be not less than 50 psf (2.39 kN/m [2] ). This live load shall not be reduced.

    1607.8.4 Forklifts and movable equipment. Where a structure is intended to have forklifts or other movable equipment present, the structure shall be designed for the total vehicle or equipment load and the individual wheel loads for the anticipated vehicles as specified by the owner of the facility. These loads shall be posted in accordance with Section 1607.8.5.

    1607.8.4.1 Impact and fatigue. Impact loads and fatigue loading shall be considered in the design of the supporting structure. For the purposes of design, the vehicle and wheel loads shall be increased by 30 percent to account for impact.

    1607.8.5 Posting. The maximum weight of vehicles allowed into or on a garage or other structure shall be posted by the owner or the owner’s authorized agent in accordance with Section 106.1.

    STRUCTURAL DESIGN

    1607.9 Loads on handrails, guards, grab bars , shower seats, dressing room bench and seats. Handrails and guards shall be designed and constructed for the structural loading conditions set forth in Section 1607.9.1. Grab bars, shower seats and accessible benches shall be designed and constructed for the structural loading conditions set forth in Section 1607.9.2.

    1607.9.1 Concentrated load. Handrails and guards shall be designed to resist a concentrated load of 200 pounds (0.89 kN) in accordance with Section 4.5.1 of ASCE 7. Glass handrail assemblies and guards shall comply with Section 2407.

    1607.9.1.1 Uniform load. Handrails and guards shall be designed to resist a linear load of 50 pounds per linear foot (plf) (0.73 kN/m) in accordance with Section 4.5.1.1 of ASCE 7. This load need not be assumed to act concurrently with the concentrated load specified in Section 1607.9.1.

    Exception: Where alternative design criteria are specifically permitted.

    302 A .5 Occupancy and use. Where determining the appropriate application of the referenced sections of this code, the occupancy and use of a building shall be determined in accordance with Chapter 3 of the California Building Code .

    302A.6 Maintenance. Buildings and structures, and parts thereof, shall be maintained in a safe and sanitary condition. Devices or safe- guards which are required by this code shall be maintained in conformance with the code edition under which they were installed. The owner or the owner’s designated agent shall be responsible for the maintenance of buildings and structures. To determine compliance with this subsection, the building official shall have the authority to require a building or structure to be re-inspected. The requirements of this chapter shall not provide the basis for removal or abrogation of fire protection and safety systems and devices in existing structures.

    302A.7 Construction documents for retrofit or rehabilitation. The design loads and other information pertinent to the structural design required by California Building Code Section 1603A shall be included in the drawings. In addition to the information required by California Building Code Section 1603A.1.5, the drawings shall show the ground motion hazard used for the retrofit or rehabilitation as either a percentage of the California Building Code prescribed ground motion for new hospital buildings, or ASCE 41 seismic hazard designation, or a probability of exceedance in a specified time period, or a return period for exceedance of the specified ground motion.

    SECTION 304 A —STRUCTURAL DESIGN LOADS AND EVALUATION AND DESIGN PROCEDURES

    304 A .1 Live loads. Where an addition or alteration does not result in increased design live load, existing gravity load-carrying structural elements shall be permitted to be evaluated and designed for live loads approved prior to the addition or alteration. If the approved live load is less than that required by Section 1607 A of the California Building Code, the area designated for the nonconforming live load shall be posted with placards of approved design indicating the approved live load. Where the addition or alteration results in increased design live load, the live load required by Section 1607 A of the California Building Code shall be used.

    304 A .2 Snow loads on adjacent buildings. Where an alteration or addition changes the potential snow drift effects on an adjacent building, the code official is authorized to enforce Section 7.12 of ASCE 7.

    304 A .3 Additions, alterations, repairs and seismic retrofit to existing buildings or structures.

    304 A .3.1 Structures designed in accordance with pre-1973 building code. Provisions of this section shall apply to hospital build- ings which were originally designed to pre-1973 building codes and not designated as SPC 3 or higher in accordance with Chapter 6 of the California Administrative Code.

    SECTION 304 A —STRUCTURAL DESIGN LOADS AND EVALUATION AND DESIGN PROCEDURES

    304 A .1 Live loads. Where an addition or alteration does not result in increased design live load, existing gravity load-carrying structural elements shall be permitted to be evaluated and designed for live loads approved prior to the addition or alteration. If the approved live load is less than that required by Section 1607 A of the California Building Code, the area designated for the nonconforming live load shall be posted with placards of approved design indicating the approved live load. Where the addition or alteration results in increased design live load, the live load required by Section 1607 A of the California Building Code shall be used.

    304 A .2 Snow loads on adjacent buildings. Where an alteration or addition changes the potential snow drift effects on an adjacent building, the code official is authorized to enforce Section 7.12 of ASCE 7.

    304 A .3 Additions, alterations, repairs and seismic retrofit to existing buildings or structures.

    304 A .3.1 Structures designed in accordance with pre-1973 building code. Provisions of this section shall apply to hospital build- ings which were originally designed to pre-1973 building codes and not designated as SPC 3 or higher in accordance with Chapter 6 of the California Administrative Code.

    304A.3.1.1 Incidental and minor structural alteration, additions, or repairs. Incidental and minor structural additions shall be permitted, provided the additions meet the California Building Code for new construction using importance factor, I e , equal to or greater than 1.0. Alterations or repair to existing gravity and lateral force-resisting systems shall be made to conform to the requirements of Section 503A or Chapter 4A, respectively, using importance factor, I e , equal to or greater than 1.0. 1. Nonstructural components. Component importance factor, I p , shall be permitted to be 1.0.

    Exception: Components required for life-safety purposes after an earthquake, including emergency and standby power systems, mechanical smoke removal systems, fire protection sprinkler systems, fire alarm control panels and egress stairways shall have a component importance factor (I p ) of 1.5.

    304A.3.1.2 Major structural alteration, additions or repairs. Major structural alterations, additions or repairs shall be in accor- dance with Section 304A.3.4.1 or 304A.3.4.3 as applicable.

    304A.3.2 Seismic evaluation and retrofit of general acute care hospitals for compliance with the California Administrative Code, Chapter 6. Notwithstanding any other requirements of this code, existing general acute care hospitals shall comply with the seismic evaluation requirements specified in Chapter 6, of the California Administrative Code, when applicable. Seismic retrofit to comply with requirements specified in Chapter 6 of the California Administrative Code shall be permitted to be in accordance with these provisions. When load combinations which do not include seismic forces are required, the new building provisions of this code shall be applicable.

    [A] 106.4 Amended construction documents. Work shall be installed in accordance with the reviewed construction documents, and any changes made during construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents.

    [A] 106.5 Retention of construction documents. One set of approved construction documents shall be retained by the code official for a period of not less than the period required for retention of public records.

    [A] 106.6 Design professional in responsible charge. Where it is required that documents be prepared by a registered design professional, the code official shall be authorized to require the owner or the owner’s authorized agent to engage and designate on the building permit application a registered design professional who shall act as the registered design professional in responsible charge. If the circumstances require, the owner or the owner’s authorized agent shall designate a substitute registered design professional in responsible charge who shall perform the duties required of the original registered design professional in responsible charge. The code official shall be notified in writing by the owner or the owner’s authorized agent if the registered design professional in responsible charge is changed or is unable to continue to perform the duties. The registered design professional in responsible charge shall be responsible for reviewing and coordinating submittal documents prepared by others, including phased and deferred submittal items, for compatibility with the design of the building. Where structural observation is required, the inspection program shall name the individual or firms who are to perform structural observation and describe the stages of construction at which structural observation is to occur.

    SECTION 107—TEMPORARY USES, EQUIPMENT AND SYSTEMS

    [A] 107.1 General. The code official is authorized to issue a permit for temporary uses, equipment and systems. Such permits shall be limited as to time of service but shall not be permitted for more than 180 days. The code official is authorized to grant extensions for demonstrated cause. [OSHPD 1, 1R, 2, 4 & 5] OSHPD shall only grant one extention when cause is demonstrated.

    [A] 107.2 Conformance. Temporary uses shall conform to the requirements of this code as necessary to ensure health, safety and general welfare.

    [A] 107.3 Temporary service utilities. The code official is authorized to give permission to temporarily supply service utilities in accordance with Section 111.

    [A] 107.4 Termination of approval. The code official is authorized to terminate such permit for a temporary use and to order the same to be discontinued.

    SECTION 108—FEES

    [A] 108.1 Payment of fees. A permit shall not be valid until the fees prescribed by law have been paid, nor shall an amendment to a permit be released until the additional fee, if any, has been paid.

    [A] 108.2 Schedule of permit fees. Where a permit is required, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.

    R108.2 Schedule of permit fees. On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.

    R108.3 Building permit valuations. Building permit valuation shall include total value of the work for which a permit is being issued, such as electrical, gas, mechanical, plumbing equipment and other permanent systems, including materials and labor.

    R108.4 Related fees. The payment of the fee for the construction, alteration, removal or demolition for work done in connection to or concurrently with the work authorized by a building permit shall not relieve the applicant or holder of the permit from the payment of other fees that are prescribed by law.

    R108.5 Refunds. The building official is authorized to establish a refund policy.

    R108.6 Work commencing before permit issuance. Any person who commences work requiring a permit on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to a fee established by the applicable governing authority that shall be in addition to the required permit fees.

    SECTION R109—INSPECTIONS

    R109.1 Types of inspections. For on-site construction, from time to time the building official, upon notification from the permit holder or his agent, shall make or cause to be made any necessary inspections and shall either approve that portion of the construction as completed or shall notify the permit holder or his or her agent wherein the same fails to comply with this code.     The registered design professional in responsible charge shall be responsible for reviewing and coordinating submittal documents prepared by others, including phased and deferred submittal items, for compatibility with the design of the building.

    [A] 107.3.4.1 Deferred submittals. Deferral of any submittal items shall have the prior approval of the building official. The registered design professional in responsible charge shall list the deferred submittals on the construction documents for review by the building official.

    Documents for deferred submittal items shall be submitted to the registered design professional in responsible charge who shall review them and forward them to the building official with a notation indicating that the deferred submittal documents have been reviewed and found to be in general conformance to the design of the building. The deferred submittal items shall not be installed until the deferred submittal documents have been approved by the building official. [OSHPD 1, 1R, 2, 4 & 5] Deferred submittals shall be in accordance with the California Administrative Code, Chapter 7, Section 7-126.

    [A] 107.4 Amended construction documents. Frequently asked questions

Who is responsible for posting the design-load sign?

The building owner or the owner’s authorized agent is responsible for conspicuously posting the required design-load sign in the applicable part of each story (§ 106.1).

What if my design live load is exactly 50 psf?

The CBC requires posting for floors designed for live loads exceeding 50 psf. If the design value is 50 psf or less, the posting requirement in § 106.1 does not apply.

Does the CBC specify the exact wording or format of the sign?

The CBC specifies that the design live loads must be “conspicuously posted … using durable signs” but does not prescribe exact wording or sign layout; use clear wording that states the design live (or snow) load in psf. (§ 106.1, § 106.1.1).

Can I occupy the building before the signs are posted?

No — a certificate of occupancy required by § 111 will not be issued until the floor-load signs required by § 106.1 are installed, so occupancy dependent on a CO will be delayed until posting is complete. (§ 106.2).

Where do I find the dollar amount of the permit fee I’ll owe?

The CBC requires fees be paid and requires a fee schedule be established by the applicable governing authority, but it does not set specific dollar amounts; consult your local jurisdiction’s fee schedule (CBC §§ 109.1–109.2).
