When must documents be prepared by a registered design professional?
In California the CBC requires construction documents to be prepared by a registered design professional only when statutes of the jurisdiction require it; the building official can require additional RDP-prepared documents for special conditions or waive submittals where review isn’t needed, and when RDP preparation is required the owner may have to designate an RDP in responsible charge to coordinate plans and deferred submittals (see § 107.1 and related provisions).

What the code requires — 2–4 sentences
The California Building Code requires that construction submittal documents (construction documents, statement of special inspections, geotechnical report and other data) be prepared by a registered design professional (RDP) when such preparation is required by the statutes of the jurisdiction where the project is to be built — i.e., when law or the local authority requires it. The building official may also require additional documents to be prepared by an RDP where special conditions exist, and the official may waive submittals not required to be prepared by an RDP if review is unnecessary. See § 107.1 for these rules.
Requirements in detail
Trigger: “Where required by the statutes of the jurisdiction”
- What the rule says: Construction documents must be prepared by a registered design professional where required by statute (state or local law). That is the primary trigger — the CBC defers to the law that applies in the jurisdiction for which the permit is sought. § 107.1.
Building official discretion: additional requirements or waivers
- The building official is explicitly authorized to require additional construction documents to be prepared by an RDP where special conditions exist. Conversely, the building official may waive submission of documents not required to be prepared by an RDP if the work’s nature makes review unnecessary. § 107.1 (including the Exception).
Related administrative duties when RDP-prepared documents are required
- When RDP-prepared documents are required, the building official may require the owner to designate a registered design professional in responsible charge on the permit application; that RDP reviews and coordinates other submittals (including deferred submittals). § 107.3.4 and § 107.3.4.1.
- One set of approved construction documents will be retained by the building official and another returned to the applicant to keep on site. § 107.3.1 and § 107.5.

Exceptions & special cases
- Jurisdictional statutes control: The CBC does not itself list an exhaustive catalog of project types that always require an RDP; instead it requires RDP preparation where statutes of the jurisdiction require it. In other words, local/state law and any agency-adopted rules determine many of the “must” cases — § 107.1.
- Building official waiver: If the building official finds a particular project does not require construction document review to determine compliance, the official may waive submittals that would not otherwise be required to be prepared by an RDP. (Exception to § 107.1).
- Special inspections / statements: When special inspections or tests are required (see Section 1704), the CBC expects the statement of special inspections to be prepared by the RDP in responsible charge; an exception allows the building official to approve a qualified person to prepare it when the work was not designed by an RDP. §§ 1704.2.3 / 1704.3 (and cross-reference to § 107.1).
- Deferred submittals: Deferred submittal items must have prior approval; the RDP in responsible charge must list them and later review and forward deferred documents indicating general conformance. § 107.3.4.1.
Common mistakes
- Treating § 107.1 as a blanket requirement that every set of plans must be prepared by an RDP. The CBC requires RDP preparation only where statutes require it; local codes and state law can expand or limit that requirement. § 107.1.
- Failing to designate an RDP in responsible charge when the permit requires one. If documents must be prepared by an RDP, the building official may require the owner to designate that professional on the permit application (and to notify the official if the RDP changes). § 107.3.4.
- Forgetting to list deferred submittals on the construction documents and not obtaining prior approval for deferrals — deferred items cannot be installed until they are approved. § 107.3.4.1.
- Omitting required supporting reports (for example, geotechnical reports or a statement of special inspections) when statutes or other CBC sections require them; many of those reports are explicitly expected to be prepared by an RDP. § 107.1 and Section 1704.
- Assuming the building official has no discretion — in fact the official has explicit authority both to require additional RDP-prepared documents for special conditions and to waive certain submittals. § 107.1.
Worked example — mixed-use building (concrete framing, 3 stories)
Scenario:
- Owner proposes a three-story mixed-use building with commercial at ground level and two residential floors above. Local ordinance and state law require structural design documents prepared by a licensed structural engineer for buildings of this size/type.
Steps applying CBC requirements:
- Because statute/jurisdiction requires it, the structural, architectural and related construction documents must be prepared by the appropriate registered design professionals (architect and structural engineer). (Trigger: § 107.1.)
- The permit application includes two sets (or digital sets where allowed) of construction documents, a geotechnical report prepared by a registered geotechnical engineer, and a statement of special inspections prepared by the RDP in general responsible charge if special inspections are triggered (e.g., for concrete). (§ 107.1; cross-reference § 1704.)
- The building official requires the owner to designate a registered design professional in responsible charge on the permit application; that person lists any deferred submittals (for example, fire sprinkler shop drawings or glazing shop drawings) on the construction documents. (§ 107.3.4 and § 107.3.4.1.)
- The RDP in responsible charge receives deferred submittal documents later, reviews them for general conformance, and forwards them to the building official with a notation of review prior to installation. (§ 107.3.4.1.)
- Upon permit issuance, the building official stamps a reviewed set of construction documents and retains one set; the applicant keeps the other set at the job site. (§ 107.3.1, § 107.5.)

[A] 107.2.2 Fire protection system shop drawings. Shop drawings for the fire protection systems shall be submitted to indicate conformance to this code and the construction documents and shall be approved prior to the start of system installation. Shop drawings shall contain all information as required by the referenced installation standards in Chapter 9.
[A] 107.2.3 Means of egress. The construction documents shall show in sufficient detail the location, construction, size and character of all portions of the means of egress including the path of the exit discharge to the public way in compliance with the provisions of this code. In other than occupancies in Groups R-2, R-2.1 and R-3, the construction documents shall designate the number of occupants to be accommodated on every floor, and in all rooms and spaces.
[A] 107.2.4 Exterior wall envelope. Construction documents for all buildings shall describe the exterior wall envelope in sufficient detail to determine compliance with this code. The construction documents shall provide details of the exterior wall envelope as required, including flashing, intersections with dissimilar materials, corners, end details, control joints, intersections at roof, eaves or parapets, means of drainage, water-resistive barrier and details around openings.

[A] 105.6 Suspension or revocation. The building official is authorized to suspend or revoke a permit issued under the provisions of this code wherever the permit is issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions of this code.
[A] 105.7 Placement of permit. The building permit or copy shall be kept on the site of the work until the completion of the project.
SECTION 106—FLOOR AND ROOF DESIGN LOADS
[A] 106.1 Live loads posted. In commercial or industrial buildings, for each floor or portion thereof designed for live loads exceeding 50 psf (2.40 kN/m [2] ), such design live loads shall be conspicuously posted by the owner or the owner’s authorized agent in that part of each story in which they apply, using durable signs. It shall be unlawful to remove or deface such notices. [DSA-SS, DSA-SS/CC] These posting requirements also apply to school and state-owned essential services buildings as regulated by DSA.
106.1.1 Snow load posting. [OSHPD 1, 1R, 2, 4 & 5] Snow loads used in design shall be posted as for live loads.
106.1.2 Snow load posting. [DSA-SS, DSA-SS/CC] When design snow loads at exterior balconies, decks and other elevated walking surfaces exceed 50 psf, the design snow loads shall be posted as for live loads. When design roof (not ground) snow loads exceed 20 psf, the roof design snow loads for each roof level of the building shall similarly be conspicuously posted with signs stating the maxi- mum design roof snow loads.

The provisions contained in this appendix are not mandatory unless specifically adopted by a state agency or referenced in the adopting ordinance.
User notes:
About this appendix: Appendix O provides an optional design, review and approval framework for use by the building official. Typical uses would include cases of alternate methods in Chapter 1, select areas of the code that require a rational analysis such as Section 909 and elsewhere. It simply extracts the relevant administrative provisions from the ICC Performance Code into a more concise, usable appendix format for a jurisdiction confronted with such a need. Currently there are multiple, varying jurisdictional rules and procedures in many communities regarding procedure and none in even more. The building official is often left alone to reach decisions not just on the merits of a design but must first also decide on the submittal and review process. As an appendix, the provisions herein are entirely optional to a jurisdiction. This appendix can be adopted, adopted with local modifications, or even used on a case-by-case basis as part of a Memorandum of Understanding or similar legal agreement between the jurisdiction and the owner/design team. It simply represents another tool for the jurisdiction to reach for in cases of need; it neither encourages nor creates any additional opportunity for performance-based design.

O101.1 Introduction. The following administrative provisions are excerpted from the International Code Council Performance Code for Buildings and Facilities and can be used in conjunction with the Alternate Methods provisions in Chapter 1, or for a review of submittals requiring a rational analysis or performance-based design. These provisions provide an established framework for the building official in terms of the design expertise needed, the necessary submittals, a review framework and related items.

The building official shall be notified in writing by the owner or the owner’s authorized agent if the registered design professional in responsible charge is changed or is unable to continue to perform the duties.
The registered design professional in responsible charge shall be responsible for reviewing and coordinating submittal documents prepared by others, including phased and deferred submittal items, for compatibility with the design of the building.
[A] 107.3.4.1 Deferred submittals. Deferral of any submittal items shall have the prior approval of the building official. The registered design professional in responsible charge shall list the deferred submittals on the construction documents for review by the building official.
Documents for deferred submittal items shall be submitted to the registered design professional in responsible charge who shall review them and forward them to the building official with a notation indicating that the deferred submittal documents have been reviewed and found to be in general conformance to the design of the building. The deferred submittal items shall not be installed until the deferred submittal documents have been approved by the building official. [OSHPD 1, 1R, 2, 4 & 5] Deferred submittals shall be in accordance with the California Administrative Code, Chapter 7, Section 7-126.
[A] 107.4 Amended construction documents. Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents.

R106.1.2 Manufacturer’s installation instructions. Manufacturer’s installation instructions, as required by this code, shall be available on the job site at the time of inspection.
R106.1.3 Information on braced wall design. For buildings and structures utilizing braced wall design, and where required by the building official, braced wall lines shall be identified on the construction documents. Pertinent information including, but not limited to, bracing methods, location and length of braced wall panels and foundation requirements of braced wall panels at top and bottom shall be provided.
R106.1.4 Information for construction in flood hazard areas. For buildings and structures located in whole or in part in flood hazard areas as established by Table R301.2, construction documents shall include:
- Delineation of flood hazard areas, floodway boundaries and flood zones and the design flood elevation, as appropriate.
- The elevation of the proposed lowest floor, including basement; in areas of shallow flooding (AO Zones), the height of the proposed lowest floor, including basement, above the highest adjacent grade.
- The elevation of the bottom of the lowest horizontal structural member in coastal high-hazard areas (V Zone) and in Coastal A Zones where such zones are delineated on flood hazard maps identified in Table R301.2 or otherwise delineated by the jurisdiction.
- If design flood elevations are not included on the community’s Flood Insurance Rate Map (FIRM), the building official and the applicant shall obtain and reasonably utilize any design flood elevation and floodway data available from other
sources.
R106.1.5 Information on storm shelters. Construction documents for storm shelters shall include the information required in ICC 500.
R106.1.6 Exterior balconies and elevated walking surfaces. Where balconies or other elevated walking surfaces are exposed to water from direct or blowing rain, snow or irrigation, and the structural framing is protected by an impervious moisture barrier, the construction documents shall include details for all elements of the impervious moisture barrier system. The construction documents shall include manufacturer’s installation instructions.

3104.4 Affidavit. The affidavit required by Section 3104.2 shall contain all of the information specified in Section 3104.3.

(d) Certificates of Flame Resistance or other documentation affirming the requirements of California Code of Regulations, Title 19, Division 1, Section 315, subsection (a) shall be made available upon request of the enforcement authority.
SECTION 3105—TEMPORARY SPECIAL EVENT STRUCTURES
3105.1 General. Temporary special event structures shall comply with Section 3104, Sections 3105.2 through 3105.8 and ANSI E1.21.
3105.2 Approval. Temporary special event structures required to have a permit, as set forth in Sections 105.5 and 105.6, shall not be erected, operated or maintained for any purpose without first obtaining approval and a permit from the fire code official and the building official.
3105.3 Use period. Temporary special event structures erected in accordance with ANSI E1.21 shall not be erected for a period of more than six consecutive weeks.
3105.4 Required documents. The following documents shall be submitted to the fire code official and the building official for review before a permit is approved:
- Construction documents: Construction documents shall be prepared by a registered design professional in accordance with the California Building Code and ANSI E1.21 where applicable. Construction documents shall include: 1.1. A summary sheet showing the building code used, design criteria, loads and support reactions. 1.2. Detailed construction and installation drawings. 1.3. Design calculations. 1.4. Operating limits of the structure explicitly outlined by the registered design professional including environmental conditions and physical forces. 1.5. Effects of additive elements such as video walls, supported scenery, audio equipment, vertical and horizontal coverings. 1.6.

R105.5 Expiration. Every permit issued shall become invalid unless the work authorized by such permit is commenced within 180 days after its issuance or after commencement of work if more than 180 days pass between inspections. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. The extension shall be requested in writing and justifiable cause demonstrated.
R105.5.1 Expiration . On or after January 1, 2019, every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 12 months after its issuance or if the work authorized on the site by such permit is suspended or abandoned for a period of 12 months after the time the work is commenced. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. R105.6 Suspension or revocation. The building official is authorized to suspend or revoke a permit issued under the provisions of this code wherever the permit is issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation or any of the provisions of this code.
R105.7 Placement of permit. The building permit or a copy shall be kept on the site of the work until the completion of the project.
R105.8 Responsibility. It shall be the duty of every person who performs work for the installation or repair of building, structure, electrical, gas, mechanical or plumbing systems, for which this code is applicable, to comply with this code.
R105.9 Preliminary inspection. Before issuing a permit, the building official is authorized to examine or cause to be examined buildings, structures and sites for which an application has been filed.

R106.1 Submittal documents. Submittal documents consisting of construction documents, and other data shall be submitted in two or more sets, or in a digital format where allowed by the building official, with each application for a permit. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional.
Exception: The building official is authorized to waive the submission of construction documents and other data not required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that reviewing of construction documents is not necessary to obtain compliance with this code.

[A] 106.2.3 Means of egress. The construction documents for Alterations—Level 2, Alterations—Level 3, additions and changes of occupancy shall show in sufficient detail the location, construction, size and character of all portions of the means of egress in compliance with the provisions of this code. The construction documents shall designate the number of occupants to be accommodated in every work area of every floor and in all affected rooms and spaces.
[A] 106.2.4 Exterior wall envelope. Construction documents for work affecting the exterior wall envelope shall describe the exterior wall envelope in sufficient detail to determine compliance with this code. The construction documents shall provide details of the exterior wall envelope as required, including windows, doors, flashing, intersections with dissimilar materials, corners, end details, control joints, intersections at roof, eaves or parapets, means of drainage, water-resistive barriers and details around openings.

O101.5.2 Design submittal. Applicable construction documents shall be submitted to the building official for review. The documents shall be submitted in accordance with the jurisdiction’s procedures and in sufficient detail to obtain appropriate permits.
O101.6 Review. Construction documents submitted in accordance with this code shall be reviewed for code compliance with the appropriate code provisions.

O101.8 Verification of compliance. Upon completion of the project, documentation shall be prepared that verifies performance and prescriptive code provisions have been met. Where required by the building official, the registered design professional shall file a report that verifies bounding conditions are met.
O101.9 Extent of documentation. Approved construction documents, the operations and maintenance manual, inspection and testing records, and certificates of occupancy with conditions shall be included in the project documentation of the building official’s records.
O101.10 Analysis of change. The registered design professional shall evaluate the existing building, facilities, premises, processes, and contents, and the applicable documentation of the proposed change as it affects portions of the building, facility, premises, processes and contents that were previously designed for compliance under a performance-based code. Prior to any change that was not documented in a previously approved design, the registered design professional shall examine the applicable design documents, bounding conditions, operation and maintenance manuals, and deed restrictions.

CBC § 107.3.4.1 High relevance — show source text
The registered design professional in responsible charge shall be responsible for reviewing and coordinating submittal documents prepared by others, including phased and deferred submittal items, for compatibility with the design of the building.
[A] 107.3.4.1 Deferred submittals. Deferral of any submittal items shall have the prior approval of the building official. The registered design professional in responsible charge shall list the deferred submittals on the construction documents for review by the building official.
Documents for deferred submittal items shall be submitted to the registered design professional in responsible charge who shall review them and forward them to the building official with a notation indicating that the deferred submittal documents have been reviewed and found to be in general conformance to the design of the building. The deferred submittal items shall not be installed until the deferred submittal documents have been approved by the building official. [OSHPD 1, 1R, 2, 4 & 5] Deferred submittals shall be in accordance with the California Administrative Code, Chapter 7, Section 7-126.
[A] 107.4 Amended construction documents. Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents.
[A] 107.5 Retention of construction documents. One set of approved construction documents shall be retained by the building official for a period of not less than 180 days from date of completion of the permitted work, or as required by state or local laws.
SECTION 108—TEMPORARY STRUCTURES, EQUIPMENT AND SYSTEMS
[A] 108.1 General. The building official is authorized to issue a permit for temporary structures, equipment or systems. Such permits shall be limited as to time of service, but shall not be permitted for more than 180 days. The building official is authorized to grant extensions for demonstrated cause. Structures designed to comply with Section 3103.6 shall not be in service for a period of more than 1 year unless an extension of time is granted. [OSHPD 1, 1R, 2, 4 & 5] OSHPD shall grant only one extension when cause is demonstrated.
[A] 108.2 Conformance. Temporary structures shall comply with the requirements in Section 3103.
[A] 108.3 Temporary service utilities. The building official is authorized to give permission to temporarily supply service utilities in accordance with Section 112.
[A] 108.4 Termination of approval. The building official is authorized to terminate such permit for a temporary structure, equipment or system and to order the same to be discontinued.
SECTION 109—FEES
[A] 109.1 Payment of fees. A permit shall not be valid until the fees prescribed by law have been paid, nor shall an amendment to a permit be released until the additional fee, if any, has been paid.
[A] 109.2 Schedule of permit fees. Where a permit is required, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.
Frequently asked questions
Who decides whether my project requires documents prepared by an RDP?
The applicable statutes of the jurisdiction control whether an RDP is required; the CBC (§ 107.1) defers to those laws and also gives the building official authority to require additional RDP-prepared documents for special conditions.
Can the building official waive submission of RDP-prepared documents?
Yes — the building official may waive submission of construction documents and other data not required to be prepared by an RDP if the official finds that review of those documents is unnecessary to obtain compliance with the code (Exception to § 107.1).
If documents must be prepared by an RDP, must the owner name an RDP on the permit?
Yes — where documents must be prepared by an RDP, the building official may require the owner to designate a registered design professional in responsible charge on the permit application; that professional coordinates and reviews submittals. § 107.3.4.
Who prepares the statement of special inspections?
When special inspections are required, the statement of special inspections is generally prepared by the registered design professional in general responsible charge, unless the building official permits preparation by a qualified person for work not designed by an RDP (§ 1704.2.3 / § 1704.3).
Are deferred submittals allowed if an RDP prepared the base documents?
Yes, but deferral requires prior building official approval; deferred items must be listed on the construction documents by the RDP in responsible charge and later reviewed and forwarded to the building official before installation. § 107.3.4.1.
