4.30.010. - Purpose of Commission.

It shall be the purpose of the Trails Commission to advise the Planning Commission, and through them the Board of Supervisors, of the riding, hiking and bicycle trail needs of the County of Yuba. The Trails Commission shall encourage community involvement in development, maintenance and use of the riding and hiking trail system and bicycle paths within the County of Yuba.

4.30.020. - Created.

There hereby is created a Trails Commission to implement the purpose stated, and to achieve the objectives expressed, in Section 4.30.010.

4.30.030. - Duties.

The duties of the Trails Commission shall include the following:

(1) Submit recommendations for trails related matters to the Planning Commission for consideration.

(2) Identify existing and future needs for trail development within the County, including interconnections with regional trails outside the County's boundaries.

(3) Review existing programs and standards, recommending changes as deemed necessary.

(4) Review the status of existing trails and recommend future improvements and additions to the trails system.

(5) Recommend priorities for trails development for budget consideration and grant applications.

(6) Seek out and identify potential new sources of funding for trail development improvement and maintenance.

(7) Encourage citizen involvement in the use, development and maintenance of trails.

(8) Receive input from members of the public about trails related matters.

(9) Undertake any special or additional projects desired by the Board of Supervisors or Planning Commission.

4.30.040. - Members.

(a) The Trials Commission shall consist of seven members; appointed and designated as follows:

(1) One member of the Planning Commission who shall serve as the Chairperson.

(2) One member shall be appointed by the City Council of the City of Marysville.

(3) One member shall be appointed by the City Council of the City of Wheatland.

(4) Four members shall be appointed by the Board of Supervisors of Yuba County representing each of the following located in the County of Yuba:

a. Equestrian Organizations,

b. Bicycle Organizations,

c. Environmental Organizations, and

d. One member appointed at large.

(b) Commissioners shall be residents of Yuba County.

(c) The Planning Director (Director) from the Community Development and Services Agency, or the Director's designee, shall be an ex-officio member of the Commission.

4.30.050. - Voting.

Each Commissioner shall be entitled to one vote. Approval of any matter requires an affirmative vote from a majority of the Trails Commission.

4.30.060. - Termination of membership.

If a member misses more than three consecutive meetings of the Trails Commission, without prior authorization from the Chairperson, such member shall be considered to have resigned the Commission. The Board of Supervisors may suspend the Trails Commission if there is a lack of a quorum for three consecutive meetings or if the Board of Supervisors determines that there are not a sufficient number of projects available for the Trails Commission to review. If the Board does terminate the Trails Commission, the Board may then reestablish the Commission at any time.

4.30.070. - Meetings.

The Trails Commission shall hold at least one regular meeting each month unless there is no business to conduct and, except for the first meeting, the time, place and manner of holding meetings shall be prescribed by the Trails Commission. Special meetings may be called at any time by the Chairperson, provided that notification to the public is made in accordance with any applicable laws.

4.30.080. - Officers.

The representative of the Planning Commission shall serve as Chairperson. The Trails Commission shall select one of its members as Vice-Chairperson. The Planning Director or the Director's designee, shall serve as Secretary to the Commission. Other officers may be appointed as necessary to carry out the work of the Commission.

4.30.100. - Duties of Commission officers.

Officers of the Commission shall have the following duties:

(1) Chairperson. The Chairperson shall preside at the meetings of the Trails Commission and shall act as the Trail Commissions liaison to the Planning Commission.

(2) Vice-Chairperson. In the absence or incapacity of the Chairperson, the Vice-Chairperson shall assume all duties of the Chairperson.

(3) Secretary. The Secretary shall keep or cause to be kept a book of minutes of all activities at meetings of the Trail Commission, including resolutions made, actions taken and the number of votes cast for, against and in abstention of each related action. The Secretary shall also prepare agendas and give notice of regular and special meetings of the Trails Commission.

4.30.200. - Ad-hoc committees.

The Commission may create such ad-hoc committees as the business of the Commission may require. Each shall be made up of at least two but fewer than a quorum of Commission members and shall have such authority and perform such duties as the Trails Commission may determine.

4.30.300. - Compensation.

Members of the Trails Commission shall serve without compensation. Trails Commission members may be reimbursed for expenses incurred in carrying out the duties of the Trails Commission as authorized by the Board of Supervisors.

4.30.400. - Rules.

Subject to approval by the Board of Supervisors, the Trails Commission may adopt such other rules as it may deem necessary for the transaction of businesses.

4.30.500. - Severability.

If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
