4.25.010. - Statement of policy.

The Board of Supervisors of the County of Yuba hereby finds and determines that racial tension and conflict contribute substantially to the creation of juvenile delinquency and adult crime; that prejudice, intolerance, and discrimination against any individual or group because of race, religion, national origin, or group because of race, religion, national origin or cultural background promote tension and conflict; that such prejudice, discrimination, tension and conflict are, therefore, a menace to peace, the public health, safety, and welfare; that to eliminate prejudice, intolerance, and discrimination and thereby promote the public health, welfare, and security and to create an environment in which all men, women and children of Yuba County, without regard to race, religion, national origin or cultural background can live, learn and work in peace and harmony, an instrumentality for such purposes should be established.

4.25.020. - Creation.

There hereby is created a Human Relations Commission to implement the public policy stated in Section 4.25.010 of this Chapter and to achieve the objectives expressed in said Section.

4.25.030. - Members; number and appointing authority.

The Commission shall consist of ten regular members and three student members appointed and designated as follows:

(1) One member shall be appointed by the Marysville Ministerial Association.

(2) One member shall be appointed by Central Labor Council.

(3) One member shall be appointed by the Superintendent of Schools of Yuba County.

(4) One member shall be appointed by the City Council of the City of Marysville.

(5) One member shall be appointed by the City Council of the City of Wheatland.

(6) Five members shall be appointed by the Board of Supervisors of Yuba County.

(7) One student shall be designated by Yuba Community College.

(8) One student, who shall be either a third or fourth year high school student, shall be designated by the Marysville Joint Unified School District.

(9) One student, who shall be either a third or fourth year high school student, shall be designated by the Wheatland Unified School District.

4.25.040. - Members; qualifications.

All members of the Commission shall be residents of Yuba County.

4.25.050. - Members; compensation.

The members of the Commission shall serve without pay but shall be paid the actual and necessary traveling expenses incurred in connection with the performance of the duties of their office.

4.25.060. - Members; term, commencement of term, vacancies.

(a) The term of office of non-student members shall be for four years.

(b) The term of office of student members shall be one year.

(c) The term of office of all members shall commence on the effective date of this Chapter.

(d) When vacancies occur in the representation specified in Section 4.25.030, it shall be filled in the same manner as the original appointment. The person selected to fill the vacancy shall hold office for the unexpired term.

4.25.070. - Meetings.

The Commission shall hold at least one regular meeting each month and, except for the first meeting, the time, place and manner of holding meetings shall be prescribed by the Commission.

4.25.080. - Rules.

The Commission shall adopt rules for the transaction of business. It shall keep a record of its resolutions, transactions, findings, and determinations, which records shall be public records. The secretary of the Commission shall regularly transmit copies of the minutes of the various meetings to the following:

(1) Marysville Ministerial Association.

(2) Central Labor Council.

(3) Superintendent of Schools of Yuba County.

(4) County Clerk of Yuba County.

(5) City Clerk of the City of Marysville.

(6) City Clerk of the City of Wheatland.

(7) Yuba Community College.

(8) Marysville Joint Unified School District.

(9) Wheatland Union High School District Superintendent of Schools.

4.25.090. - Staff and operating requirements.

(a) The Board of Supervisors shall furnish the Commission with necessary quarters, personnel, equipment, and supplies, together with usual and necessary operating expenses in accordance with established County policy on budget and personnel. The Executive Director shall be a person professionally experienced in intergroup relations and shall be responsible directly to the Commission.

(b) It shall be the function of the Commission to determine policy within the framework of this Chapter, and it shall be the function of the staff to carry out Commission policy. In addition, the Board of Supervisors may, at the request of the Commission, direct County departments or agencies to cooperate with the Commission to aid it in the performance of its duties.

4.25.100. - Duties and powers.

The duty of the Commission is to implement throughout the County of Yuba the public policy announced herein. To this end, the Commission shall, among other things:

(1) Foster mutual understanding, respect and good will among the varied racial, religious and nationality groups of the County.

(2) By persuasion and conference seek to arrive at voluntary solutions designed to discourage and prevent any and all discriminations based upon race, religion or national origin, and particularly those discriminations in the areas of housing, employment and education.

(3) Conduct education programs.

(4) Locate and anticipate potential areas of friction which might erupt into a breach of the peace. Consult and advise with the groups, public officials and individuals primarily involved.

(5) Initiate and enlist the cooperation for various racial, religious and nationality groups, community, labor and business organizations, fraternal and benevolent associations, and other groups in programs and campaigns devoted to eliminating prejudice and discrimination.

(6) Cooperate in the area of human relations with Federal, State, municipal and other governmental agencies.

(7) The Commission may study the employment practices of various public agencies and report its findings, together with its recommendations, to the Board of Supervisors and to the public agency affected by such study and report.

(8) Make recommendations as to the legislation to the Board of Supervisors and to the various public agencies in the County in the area of human relations.

(9) Annually submit a report of its activity to the Board of Supervisors.

4.25.110. - Severability.

If any section, subsection, sentence, clause, phrase, provision or portion of this Chapter, or the application thereof to any person or circumstances, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions or provisions of this Chapter or their applicability to distinguishable situations or circumstances. In enacting this Chapter, it is the desire of the Board of Supervisors to validly regulate to the full measure of its legal authority in the public interest, and to that end, the Board of Supervisors declares that it would have adopted this Chapter and each section, subsection, sentence, clause, phrase, provision, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions thereof might be declared invalid or unconstitutional in whole or in part, as applied to any particular situation or circumstances, and to this end the provisions of this Chapter are intended to be severable.
