Sec. 6-9.401. - Establishment of development permit.¶
A development permit shall be obtained before construction or development begins within any area of special flood hazard established in Section 6-9.302. Application for a development permit shall be made on forms furnished by the Public Works Director and may include, but not be limited to: plans in duplicate scale showing the nature, location, dimensions, and elevation of the area in question; existing or proposed structures, fill, storage of materials, drainage facilities; and the location of the foregoing. Specifically, the following information is required:
(a) Proposed elevation in relation to mean sea level, of the lowest habitable floor (including basement) of all structures; in zone AO elevation of existing grade and proposed elevation of lowest habitable floor of all structures;
(b) Proposed elevation in relation to mean sea level to which any structure will be floodproofed;
(c) Certification by a registered professional engineer or architect that the floodproofing methods for any nonresidential structure meet the floodproofing criteria in Section 6-9.501(c)(3);
(d) Description of the extent to which any watercourse will be altered or relocated as a result of proposed development.

Sec. 6-9.402. - Designation of the Administrator.¶
The Public Works Director or his/her designee is hereby appointed to administer and implement this chapter by granting or denying development permit applications in accordance with its provisions.

Sec. 6-9.403. - Duties and responsibilities of the Public Works Director.¶
The duties and responsibilities of the Public Works Director shall include, but not be limited to:
(a) Permit review.
(1) Review all development permits to determine that the permit requirements of this chapter have been satisfied.
(2) All other required State and Federal permits have been obtained.
(3) The site is reasonably safe from flooding.
(4) The proposed development does not adversely affect the carrying capacity of the floodway. For purposes of this chapter, "adversely affects" shall mean that the cumulative effects of the proposed development when combined with all other existing and anticipated development will not increase the water surface elevation of the base flood more than one ft. at any point.
(b) Review and use of other base flood data. When base flood elevation data has not been provided in accordance with Section 6-9.302, the Public Works Director shall obtain, review, and reasonably utilize any base flood elevation and floodway data available from a Federal, State or other source, in order to administer Article 5. Any such information shall be submitted to the City Council for adoption.
(c) Notification of other agencies. In alteration or relocation of a watercourse:
(1) Notify adjacent communities, the California Department of Water Resources, and flood control districts (including, but not limited to, reclamation districts, levee districts and drainage districts) prior to alteration or relocation;
(2) Submit evidence of such notification to the Federal Insurance Administration and Federal Emergency Management Agency; and
(3) Assure that the flood carrying capacity within the altered or relocated portion of said watercourse is maintained.
(d) Documentation of floodplain development. Obtain and maintain for public inspection and make available as needed:
(1) The certifications required in Section 6-9.501(c).
(2) The certified elevation required in Section 6-9.503.
(3) The certification required in Section 6-9.506.
(e) Base flood elevation changes due to physical alterations.
(1) Within six months of information becoming available or project completion, whichever comes first, the floodplain administrator shall submit or assure that the permit applicant submits technical or scientific data to FEMA for a Letter of Map Revision (LOMR).
(2) All LOMRs for flood control projects must be approved prior to the issuance of building permits. Building permits shall not be issued based on Conditional Letters of Map Revision (CLOMRs). Approved CLOMRs allow construction of the proposed flood control project and land preparation as specified in the "start of construction" definition.
(f) Map determinations. Make interpretations where needed, as to the exact location of the boundaries of the areas of special flood hazards, areas of flood-related erosion hazards or areas of mudslide (i.e., mudflow) (for example, where there appears to be a conflict between a mapped boundary and actual field conditions). The person contesting the location of the boundary shall be given a reasonable opportunity to appeal the interpretation as provided in Article 6.
(g) Remedial action. Take action to remedy violations of this chapter as specified in Section 6-9.303 herein.
