16.16.010 - Designation.

The districts are established by this title and are designated as follows:

16.16.020 - Zoning District Uses.

The uses for each zoning district are set forth in Chapters 16.18 - 16.42.

16.16.030 - Boundaries - Map adopted.

The designations, locations an d boundaries of the districts established are delineated upon the map entitled "City of Yreka, California, Zoning Map" dated March 20, 1980, and as amended on February 19, 2004, which map and all notations and information thereon are made a part of this title by reference, which map is on file in the office of the City Clerk.

Where any uncertainly exists as to the correct location of any zoning district boundary shown on the zoning map, it shall be the duty of the Planning Commission to establish the correct location thereof according to the intent of this title.

16.16.040 - Prezoning of unincorporated territory.

The City may prezone unincorporated territory adjoining the city for the purpose of determining the zoning that will apply to such property in the event of subsequent annexation to the City.

Chapter 16.18 - SINGLE-FAMILY RESIDENTIAL R-1 (1-6 Units Per Acre) Sections:

16.18.010 - Purpose.

This zone district is intended to provide areas for conventional single-family homes. The assigned density is consistent with typical residential development with 7,000 square foot lot minimums. Nothing in this Zone District prohibits larger lot sizes.

16.18.020 - General Plan Consistency.

This Zone District is consistent with the Low Density General Residential Land Use Designation.

16.18.030 - Density/Intensity.

A.

One to six (6) housing units per gross acre.

B.

Minimum parcel size: Seven thousand (7,000) square feet. (Subject to the provisions of § 15.04.095).

C.

One family unit per seven thousand (7,000) square feet of lot area.

D.

Maximum Coverage Residential Uses: Forty (40) percent.

16.18.040 - Site Development Standards.

A.

Setbacks, minimum

Front:

(a)

Dwelling: Twenty (20) feet;

(b)

Attached garage or carport: Twenty (20) feet;

(c)

Detached garage or carport of six hundred and fifty (650) square feet or less: Twenty (20) feet;

(d)

Detached garage or carport exceeding six hundred and fifty (650) square feet: Sixty (60) feet;

(e)

Accessory Building: Sixty (60) feet.

Rear:

(a)

Dwelling: Twenty (20) feet;

(b)

Attached garage or carport: Twenty (20) feet;

Accessory Building(s): Five (5) feet.

Side: Ten (10) feet on one side and five (5) feet on the other. In the event the lot is located on a corner, the interior side shall be a minimum of five (5) feet and the exterior side shall be a minimum of twenty (20) feet.

Lot Dimensions (minimum)

Seventy (70) feet.

(b)

Cul-de-sac lot: Seventy (70) feet at seventeen (17) feet from property line, actual street frontage never to be less than twenty (20) feet.

2.

Depth: Seventy-five (75) feet.

D.

Parking, Required Minimum:

1.

Two (2) garage or carport spaces per residential unit;

2.

The driveway approach shall be paved with concrete for parcels improved with sidewalk, otherwise it may be paved with asphalt or double chip and seal. The access drive shall be paved with concrete, asphalt, double chip and seal, or other all weather surface for a distance of not less than twenty (20) feet from the public street with a minimum width of ten (10) feet.

16.18.050 - Permitted uses.

The following uses are permitted in the R-1 zone district subject to issuance of a building permit, business license or other required permit(s):

A.

Single-family dwellings.

B.

Group care home - small.

C.

Small family daycare facilities.

D.

Parks, picnic areas and playgrounds associated with approved development.

E.

Duplex on corner lot when the following standards can be satisfied:

1.

Ten thousand square foot minimum area.

2.

Eighty-foot minimum lot width.

3.

Each unit and garage shall face a separate street.

4.

The floor area of each dwelling unit shall not be less than eight hundred fifty square feet.

5.

Parking and access for each unit shall be provided as set forth in Section 16.20.040(D).

6.

Front yards within twenty feet to match both sides.

7.

No more than two duplexes shall be allowed per four-way intersection or one per three-way intersection.

F.

Hens may be kept or maintained as provided by Section 8.04.020(c).

G.

Employee housing - small.

H.

Supportive housing.

I.

Transitional housing.

J.

Large family daycare facility.

K.

Accessory dwelling units and junior accessory dwelling units pursuant to Section 16.46.170 of this code.

16.18.060 - Accessory uses and structures.

The following uses and structures are permitted in the R-1 zone district as an accessory to the primary permitted or conditional use:

A.

Garage or carport, in addition to required garage or carport, not exceeding six hundred fifty square feet of floor area.

B.

Swimming pool.

C.

Fences, walls in compliance with Section 16.46.050.

D.

Bed and breakfasts subject to permit as required in Chapter 16.50.

E.

Home Occupation subject to permit as described in Section 16.46.020.

F.

Usual and customary structures associated with a residence (not exceeding six hundred fifty square feet of floor area).

16.18.070 - Conditional Uses.

The following uses are permitted in the R-1 zone district upon approval and validation of a conditional use permit, in addition to any other permits or licenses required for the use:

A.

Places of assembly or learning:

Church or other place of worship or spiritual assembly;

2.

Grange halls, community centers, meeting halls;

3.

Schools, public or private.

B.

Public and quasi-public facilities:

1.

Public and quasi-public buildings and uses;

2.

Fire, police or sheriff substation;

3.

Parks, picnic areas and playgrounds not associated with approved development;

4.

Water treatment facilities.

C.

Landscaped public or private parking lots when adjacent to any "C" or "M" district.

D.

Garages and accessory structures larger than six hundred fifty square feet of floor area.

16.18.080 - Reserved.

16.18.090 - Placement of manufactured homes in residential zones.

Pursuant to Government Code Section 65852.3:

A.

Manufactured homes are permitted in residential zone districts as a single-family residence if such manufactured home is placed on a permanent foundation. Such manufactured home is subject to all requirements for a single-family residence in the applicable zone district in which it is proposed to be located.

B.

Each manufactured home shall have a minimum eave overhang of at least sixteen (16) inches.

C.

Any manufactured home proposed within the designated Historic District is subject to the processing, reviews and standards of said district.

D.

Any home for which more than ten (10) years have elapsed between the date of the manufacture of the manufactured home and the date of the application for the issuance of a permit to install the manufactured home are prohibited on lots where conventional single-family residential dwellings are permitted.

Chapter 16.20 - MEDIUM DENSITY RESIDENTIAL R-2 (1 - 13 Units Per Acre)

Sections:

16.20.010 - Purpose.

This zone district is intended to provide areas for medium density residential development, particularly for duplex, triplex and fourplex units.

16.20.020 - General Plan Consistency.

This Zone District is consistent with the Medium Density Residential Land Use Designation.

16.20.030 - Density/Intensity.

A.

One to thirteen (13) housing units per gross acre.

B.

Minimum parcel size: Eight thousand (8,000) square feet.

C.

Not to exceed one dwelling unit for each three thousand three hundred and thirty three (3,333) square feet of lot area.

D.

Maximum Coverage Residential Uses: Fifty (50) percent.

16.20.040 - Site Development Standards.

A.

Duplex, triplex or fourplex units:

(a)

Two parking spaces per family unit. One parking space shall be covered, and one improved parking space not to be located within the front yard setback and not interfering with access to the garage or carport for each dwelling unit.

(b)

Parking spaces shall not be tandem.

(c)

The driveway approach shall be paved with concrete for parcels improved with sidewalk, otherwise it may be paved with asphalt or double chip and seal. The access drive shall be paved with concrete, asphalt, double chip and seal, or other all weather surface for a distance of not less than twenty feet from the public street with a minimum width of ten feet.

16.22.010 - Purpose.

This zone district is intended to provide areas for higher density apartment or condominium development.

16.22.020 - General Plan Consistency.

This Zone District is consistent with the High Density Residential Land Use Designation.

16.22.030 - Density/Intensity.

A.

One to sixteen (16) housing units per gross acre;

B.

Minimum parcel size: Fourteen thousand (14,000) square feet;

C.

Maximum: One family unit per two thousand seven hundred and twenty three (2,723) square feet of lot area;

D.

Maximum Coverage: Seventy-five (75) percent.

16.24.010 - Purpose.

This zone district is intended to provide areas for conventional single-family homes on estate sized lots, permitting limited agricultural use in conjunction with the permitted residential use. The assigned density is consistent with residential development with one acre lot minimums. Nothing in this Zone District prohibits larger lot sizes.

16.24.020 - General Plan Consistency.

This Zone District is consistent with the Residential Agricultural Land Use Designation.

16.24.030 - Density/Intensity.

A.

One dwelling per gross acre;

B.

Minimum parcel size: 43,560 square feet;

C.

One family unit per 43,560 square feet of lot area;

D.

Maximum Coverage Residential Uses: Twenty (20) percent;

Maximum Coverage Non-Residential Uses: Sixty (60) percent.

16.24.070 - Conditional uses.

16.24.090 - Placement of manufactured homes in residential zones.

Pursuant to Government Code Section 65852.3:

A.

Manufactured homes are permitted in residential zone districts as a single-family residence if such manufactured home is placed on a permanent foundation. Such manufactured home is subject to all requirements for a single-family residence in the applicable zone district in which it is proposed to be located.

B.

Each manufactured home shall have a minimum eave overhang of at least sixteen inches.

C.

Any manufactured home proposed within the designated historic district is subject to the processing, reviews and standards of said district.

D.

Any home for which more than ten years have elapsed between the date of the manufacture of the manufactured home and the date of the application for the issuance of a permit to install the manufactured home are prohibited on lots where conventional single-family residential dwellings are permitted.

Chapter 16.26 - RESIDENTIAL PROFESSIONAL OFFICE RPO

Sections:

16.26.010 - Purpose.

This zone district is intended to provide for a mixture of residential and professional office uses in areas which are typically transitional between commercial and residential uses.

16.26.020 - General plan consistency.

This zone district is consistent with the medium density residential land use designation.

16.26.030 - Density/intensity.

Residential uses per R-2.

B.

Minimum parcel size: Seven thousand square feet.

Maximum coverage: Seventy-five percent.

16.26.040 - Site development standards.

A.

Setbacks, minimum:

Front: Twenty feet.

Rear:

(a)

Office and non-residential uses: Fifteen feet.

(b)

Residential uses: See R-2 zone district.

Ten feet on one side and five feet on the other. If the lot has an exterior side, the remaining interior side minimum shall be the five feet.

B.

Building:

Dwelling: Thirty-five feet.

(b)

Churches, parks, playgrounds, schools, public and quasi-public buildings and uses: Forty-five feet.

(c)

Accessory: Fifteen feet; twenty-five feet if it is determined by the planning director that there is no significant view obstruction to adjacent properties.

16.26.050 - Permitted uses.

The following uses are permitted in the RPO zone district as an accessory to the primary permitted or conditionally permitted use:

Professional offices as defined in Section 16.12.710 except dentist, doctor, chiropractor and beauty parlor.

All permitted uses in R-2 zone district.

C.

Group care home - small.

D.

Employee housing - small.

E.

Supportive housing.

F.

Transitional housing.

Chapter 16.28 - RECREATION, SCHOOL, CONSERVATION, AND OPEN SPACE RSC

Sections:

16.28.010 - Purpose.

The RSC zone district is intended to allow a wide variety of public and quasi-public uses, projects, activities and facilities deemed necessary for the maintenance of the public health, safety and welfare, plus such other public purposes consistent with the General Plan, including non -public activities permitted by governmental agencies. Public facilities include any activity undertaken or structures held, used or controlled for public or quasi public purposes. Such determination shall be made without reference to the ownership of the structure or the property upon which it is situated.

16.28.020 - General Plan Consistency.

This Zone District is consistent with the Open Space Land Use Designation.

16.28.030 - Site Development Standards.

Public and quasi-public uses of an administrative, recreational, public service or cultural nature including city, county, state or federal administrative centers, courts, libraries, police and fire stations, and other public buildings and structures, public playgrounds, parks, open space, community centers, cemeteries, flood control channels, water pumping stations and reservoirs, irrigation and canal rights of way, settling and water conservation recharge basins and parkways.

16.28.050 - Accessory Structures.

The following structures are permitted in the RSC Zone District subject to issuance of a building permit, business license or other required permit(s):

A.

Garage or carport.
