Chapter 17.124 — WATER EFFICIENT LANDSCAPING

§ 17.124.010. Purpose.

Intelligent, skillful design and water management can enable the citizens of the Town of Yountville to enjoy a well landscaped community, while at the same time conserving natural resources. The purpose of this chapter is to reduce water waste and provide for efficient water use in new and rehabilitated landscaping by promoting the use of regionally appropriate plants that require minimal supplemental irrigation and by establishing standards for irrigation efficiency and landscape maintenance. The goal of this chapter is to achieve water conservation, prevention of the waste of this natural resource, improved water quality, and enhancement to the environment.

§ 17.124.020. Documentation.

Prior to issuance of a building permit or grading permit, each landscape project shall provide documentation to the satisfaction of the Planning Officer that demonstrates compliance with either:

  • A. The requirements of this chapter and the Water Efficient Landscape Guidelines.

  • B. The requirements of the State of California Model Water Efficient Landscape Ordinance, California Code of Regulations Title 23, Division 2, Chapter 2.7, in a manner that meets or exceeds the design requirements of the Guidelines, as may be amended.

§ 17.124.030. Penalties.

Any property owner, person, firm, or corporation, whether as principal agent, employee or otherwise, violating any provision of this chapter shall be guilty of a misdemeanor and subject to administrative enforcement in accordance with Chapter 8.05 of this code. Any property owner, person, firm, or corporation shall be deemed guilty of a separate offense for each and every day during any portion of which any violation of this chapter is committed, continued, or permitted by such person, firm or corporation, and shall be punishable as provided herein. Penalties under the administrative enforcement provisions of Chapter 8.05 of this code may be imposed in lieu of, but not in addition to, penalties imposed by the court for any single violation. § 17.124.040. Timing.

The provisions of this chapter shall not apply to landscape projects that have received approval for design review, building permit, or grading permit prior to the effective date of the ordinance codified in this chapter.
