2.48.010 - Unclaimed property defined.

As used herein "unclaimed property" means tangible personal property of every kind and description except:

A. Official property of the city and property belonging to officers and employees of the city;

B. Property which the chief of police determines as valueless;

C. Property having a possible use as evidence in a judicial hearing or processing;

D. Weapons as they are defined by California Penal Code, Section 12028;

E. Vehicles as they are defined by California Vehicle Code Section 670.

2.48.020 - Procedure.

A. Various items of personal property have from time to time been accumulated in the police department of the city, and the Civil Code of the state of California Section 2080.4 authorizes the legislative body of any city to provide by ordinance for the care, restitution, sale or destruction of such property.

B. Such unclaimed property shall be held by the police department or sheriff for a period of at least three months and that thereafter such property will be sold at public auction to the highest bidder or donated to nonprofit corporations approved by the city council.

2.48.030 - Proceeds from sale of unclaimed property.

The proceeds from such sale shall be immediately turned in to the city treasurer.
