12.16.010 - Land description.

The land and areas and appurtenances hereinafter described are declared to be and to constitute an airport and aviation field and shall be known as the Woodlake Municipal Airport. Such areas are situated within the city of Woodlake, county of Tulare, state of California and are more particularly described as follows:

Lots 296 and the North 300 feet of Lot 294 and Lot 295 of Woodlake Tract No. 2 as per Map recorded in Book 11, Page 24 of Maps in the Office of the County Recorder of Tulare County.

12.16.020 - Administration.

Municipal powers and jurisdiction and the powers and administrative functions of the several departments of the city are extended and made applicable to the Woodlake Municipal Airport and every part thereof. All laws and ordinances of the city; all resolutions, orders, rules and regulations of the council of the city and all orders, rules and regulations of any and all officers, boards and commissions of the city so far as the same may be adaptable shall be applicable to the Woodlake Municipal Airport.

12.16.030 - Airport use.

The Woodlake Municipal Airport is and shall be conducted and managed as a terminal facility of the city and for the accommodation of aircraft and for the promotion of aviation and air commerce in and around the Woodlake community.

12.16.040 - Airport manager.

The airport manager is that person or persons designated by the fixed base operator operating at the Woodlake Municipal Airport. The fixed base operator will inform the city as to the name or names of the individual or individuals designated as the airport manager or managers. Such person or persons shall perform all acts required of the airport manager pursuant to this chapter.

12.16.050 - Liability.

All permissions, leases, agreements and all permits granted by the city to use the Woodlake Municipal Airport facilities shall be conditioned upon the assumption of full responsibility for any and all damages occasioned by or arising out of each use. Each permitted user shall release from and hold harmless and indemnify the city and its officers, agents and employees from any and all responsibilities, liabilities, loss or damage caused by or arising out of the use of the airport facilities by such permitted user.

12.16.060 - Insurance.

All fixed base operators shall secure and maintain throughout the terms of their lease or agreement with the city a public liability and property damage insurance policy in the amounts to be specified by separate agreement with the city and such policies shall name the city as a co-insured, A certificate of insurance shall be filed with the city clerk.

12.16.070 - Accident reports.

Every person involved in an accident on the Woodlake Municipal Airport, including but not limited to, pedestrian, aircraft or automotive, shall make a report thereof to the airport manager not later than twenty-four (24) hours after the accident occurs who shall in turn forthwith notify the city manager of the city.

12.16.080 - Loitering.

No person shall loiter in or about any building or structure located upon the Woodlake Municipal Airport or upon the Woodlake Municipal Airport property itself nor interfere with, tamper with or put into motion an aircraft or vehicle or other equipment without the express permission of the owner thereof unless so directed to do by the airport manager.

12.16.090 - Compliance with rules and regulations.

Any person, firm or corporation refusing to comply with the rules and regulations of the Woodlake Municipal Airport after proper request from the airport manager shall be considered a trespasser and treated as such.

12.16.100 - Motor vehicles.

All operators of motor vehicles on the Woodlake Municipal Airport most possess a current and valid California driver's license and must possess liability insurance covering the motor vehicle operated by him in each instance.

12.16.110 - Right-of-way.

Pedestrians and aircraft shall have the right-of-way over all other vehicles on the Woodlake Municipal Airport. Vehicles shall pass to the rear of taxiing aircraft and vehicles must remain clear of the runway and all taxi ways. When parked adjacent to a runway, vehicles must be placed parallel to the runway and at least one hundred (100) feet from the outside of the runway lights or from the runway shoulder where there are no lights.

12.16.120 - Trash disposal.

The fixed base operator shall provide metal disposal bins, the location of which shall be approved by the airport manager.

12.16.130 - Petroleum products.

Petroleum products and chemicals shall not be placed in drains, basins or ditches on the Woodlake Municipal Airport.

12.16.140 - Flying clubs.

Each flying club wishing to operate on the Woodlake Municipal Airport shall receive prior written permission from the airport manager to so operate. Each flying club shall file with the airport manager a list of the names and addresses of its members, a copy of the by-laws of the flying club and all other rules and regulations covering the flying club's operations. Each flying club shall designate not less than three persons to be contacted by the airport manager concerning the affairs of the flying club.

12.16.150 - Commercial activity.

Persons engaged in a commercial activity of any nature on the Woodlake Municipal Airport, including flight instruction, shall be required to enter into a written contract with the city or with the fixed base operator should such commercial activity be within the purview of the activities of the fixed base operator. In the event the commercial activity involves a charge for a fee or service a city business license shall be obtained.

12.16.160 - Signs.

Signs, posters, advertisements, circulars or other written or printed matter, shall not be placed or posted on the Woodlake Municipal Airport or any buildings located thereupon without the prior written permission of the airport manager, except that a sign evidencing the fact that an aircraft is for sale or lease may be placed in any aircraft. The fixed base operator is required to maintain a bulletin board on which shall be posted the names and telephone numbers of the police, the fire department, airport manager, licensed physician, and a copy of these rules and regulations concerning the activities to be conducted upon the Woodlake Municipal Airport.

12.16.170 - Equipment or facility damage.

Any person damaging any light fixture or device or structure or any facility of any kind located upon the Woodlake Municipal Airport shall report such damage to the airport manager and shall be responsible for any and all costs required to replace and repair the damaged facility or device. The airport manager shall in turn notify the city manager.

12.16.180 - Aircraft operation.

Aircraft being operated upon or around the Woodlake Municipal Airport shall comply with the following rules and regulations:

A. General.

  1. Aircraft permanently based at the Woodlake Municipal Airport shall be registered with the airport manager.

  2. Permanently based aircraft shall be parked or hangered in specific areas designated by the airport manager.

  3. Disabled aircraft and aircraft parts shall be promptly removed from runways and taxi-ways to a designated storage area, If the owner or operator fails to remove such disabled aircraft or parts within a reasonable time, the airport manager my require removal and storage at the owner's expense.

B. Ground Operations.

  1. Engine warmup, prolonged engine test operations or pre-flight engine operational checks may not be performed in any area that would result in a hazard to other aircraft, persons or property.

  2. Aircraft shall be taxied in accordance with the prescribed taxiing patterns established by the airport manager. Taxiing is permitted only on the surfaced area prepared for that purpose or unless otherwise authorized by the airport manager.

C. Air Operations.

  1. The Woodlake Municipal Airport is an uncontrolled airport operating without a control tower. Aircraft using the Woodlake Municipal Airport shall operate in accordance with Federal Aviation regulations pertaining to operation of airports without air traffic control towers.

  2. Pilots of aircraft are encouraged to establish radio contact on the assigned unicom frequency prior to landing or take-off, Landings or take-offs shall be confined only to the designated runways.

  3. Aircraft shall not fly directly over the Airport at an altitude of less than five hundred (500) feet above designated pattern altitude unless in the process of landing or taking off or executing a go-around.

  4. Turns shall not be made after take-off until the aircraft is outside the boundary of the Woodlake Municipal Airport and a safe altitude has been reached.

  5. Aircraft shall enter the traffic pattern at a 45° angle. Straight in landing approaches are prohibited except in emergencies or by prearranged agreement.

  6. Landing aircraft shall maintain not less than the assigned traffic pattern altitude until turning onto the base leg, prior to commencing final approach.

  7. Three hundred sixty (360) degree tactical approaches are discouraged.

  8. The airport manager may delay or restrict any flight or other operations at the Woodlake Municipal Airport or may refuse take-off clearance to any aircraft in order to safeguard the safety of persons or property.

D. Fire Regulations. All orders emanating from the office of the fire chief of the city shall be complied with by the fixed base operator, all tenants and personnel at the Woodlake Municipal Airport.

E. Agricultural Operations. No dusting, spraying insecticide or other flights of an agricultural nature shall he permitted off the Woodlake Municipal Airport without the prior and direct permission of the airport manager. This provision shall apply only to the hauling of such materials to aircraft from the Woodlake Municipal Airport and does not preclude the normal empty operation of agricultural aircraft to and from the airport. Fees or charges will be made by the fixed base operator.

F. Glider Operations. All glider operations shall be conducted in compliance with applicable F.A.A. regulations.

12.16.190 - Fees.

Fees shall be established from time to time by the fixed base operator after approval by the city council. The fixed base operator shall notify the city council of its intention to increase fees at least thirty (30) days prior to the effective date of the change in fees. This notice of proposed new fees will include the amount of the new fees and the reasons therefor. Payment for the use of airport facilities, storage or other services shall be made before flight departure. The airport manager may impound the subject aircraft if such payment has not been made or suitable credit arranged.

12.16.200 - Enforcement.

Any person, firm or corporation operating or handling aircraft, operating any vehicle, equipment or apparatus, or using the Woodlake Municipal Airport or any of its facilities in violation of the rules and regulations contained herein may be removed from the airport by the direction of the airport manager. Such person may be refused further use of the Woodlake Municipal Airport facilities for such length of time as the airport manager deems necessary in order to safeguard the public safety of the Woodlake Municipal Airport facilities. Any person violating or aiding in the violation of the provisions of this chapter shall be deemed guilty of an infraction. The airport manager shall be responsible for the enforcement of the provisions of this chapter. If any portion of this chapter is declared invalid or unenforceable, all other portions shall remain in full force and effect.

12.16.210 - Appeal.

Any person aggrieved by a decision of the airport manager under the terms of this chapter may appeal such decision to the city council in writing. The city council shall review the decision of the airport manager and may affirm, reverse or modify such decision. The action of the city council in affirming, reversing or modifying the decision shall be concluded within thirty (30) working days after the appeal has been instituted by the person aggrieved.
