2-5-100 - Findings and Intent.

Pursuant to Article XIIIB of the California Constitution and Government Code Section 53150 et seq., it is the intent of the Town Council, to the extent allowed by law, to require the ascertainment and recovery of costs reasonably related to fees and charges for providing the public safety emergency response services to motorists under the influence of an alcoholic beverage or any drug, whose negligent operation of a motor vehicle, boat, vessel or aircraft caused by that influence proximately causes any incident resulting in an appropriate emergency response, or motorists whose intentionally wrongful conduct proximately causes any incident resulting in an appropriate emergency response.

2-5-105 - Collection of Costs.

The expense of an emergency response shall be charged against the motorist liable for the expenses under this section. The charge constitutes a debt of that motorist to the Town of Windsor and is collectible by the Town of Windsor in the same manner as any obligation under a contract, express or implied.

2-5-110 - Fees.

The Town Council shall establish fees and charges for emergency response services by resolution. The resolution may include procedures to implement an emergency response cost recovery program.
