1-6-200 - Claims for Money or Damages, Procedure.

a. Claims against the Town for money or damages which are exempted by Government Code Section 905 from Chapter 1 and Chapter 2 of Part 3 of Division 3.6 of Title 1 of the Government Code of the State of California, and which are not governed by any other statutes or regulations expressly related thereto, shall be governed by this section. A claim relating to such a cause of action shall be presented not later than one (1) year after the accrual of the cause of action. Such claims shall be presented and processed as provided by Chapters 1 and 2 of Part 3 of Division 3.6 of Title 1 of the Government Code insofar as said divisions are not in conflict with this section.

b. No suit for money or damages may be brought against the Town of Windsor until a written claim therefor has been presented to the Town Council and has been acted upon and has been deemed to have been rejected by the Town Council, in accordance with this article.

c. Pursuant to Chapter 5 of Part 3 of Division 3.6 of Title 1 of the Government Code, written agreements entered into by or in behalf of the Town of Windsor may provide all claims arising out of or related to the agreement must be presented not later than six (6) months after the accrual of the cause of action, include the correct signature and otherwise comply with the Act. Checks over one hundred thousand ($100,000.00) dollars will require two (2) manual signatures.

1-6-205 - Rejection and Settlement of Claims.

Pursuant to Government Code § 935.4, the Town Attorney is authorized to perform those functions of the Town Council under Chapter 2 of Part 3 of Division 3.6 of Title 1 of the Government Code, commencing with Section 910 of the Government Code, relating to presentation and consideration of claims. The Town Attorney is further authorized to allow, compromise or settle a claim against the Town if the amount to be paid is less than five thousand ($5,000.00) dollars.
